After five Police Officers who responded have been hurt. It happened at a business that manufacturers Industrial Equipment in aurora, illinois, and adriana diaz is at the scene adriana. Reporter jeff, the shooter was 45yearold gary martin, and he worked at the facility, but police havent released a motive. Cbs news has learned that during the confrontation, the swat team sent in a robot that showed the shooter dead. He had been shot by police. sirens reporter the shooter opened fire at the henry pratt manufacturing company, about 40 miles west of chicago, this afternoon. A total of five officers were struck by gunfire. The other officers on the scene located gunshot victims inside the building. At this time, we have confirmed that five victims are deceased. Reporter Margie Saldana lives nearby. We saw a squad car coming really, really fast. And i told my husband, lets get inside, because something was happening. Reporter john probst told a local chicago station that he works in the facility. He says the shooter did, too. Reporter at least five Area Police Departments responded. The 911 calls started flooding in at 1 24, and police were here at the scene just four minutes later at 1 28. Two of the initial officers to arrive were shot. Adriana diaz, thanks. Another big story we are following tonight President Trump declared a National Emergency today to help build a wall on the southern border. Opponents are already working on lawsuits to stop it. Heres major garrett. I didnt need to do this. Reporter the National Emergency declaration means the president will try to sidestep congress and divert billions from other federal programs to accelerate border wall construction. Were going to do it one way or the other. We have to do it. We have an invasion of drugs and criminals coming into our country. Reporter the administration said it intends to spend roughly 8 billion to build 234 miles of steel wall. Congress approved a fraction of that, just under 1. 4 billion for border barriers. I got 1. 4 billion, but im not happy with it. Reporter the rest comes from the treasury department, and the pentagon. 2. 5 billion that would have been used to fight drug trafficking, and 3. 6 billion for military construction l ojects. The administration refused to say which projects will now lose money. I wont go into details, but didnt sound too important to me. Fortunately, donald trump is not the last word. The courts will be the last word. Reporter californias democratic governor gavin newsom is already preparing a lawsuit challenging mr. Trumps Emergency Declaration. Other states and advocacy groups may also sue. The democratically led house is likely to move to block the president. Sadly, well be sued, and, sadly, it will go through a process, and happily, well win, i think. Reporter building the wall and having mexico pay for it was one of candidate trumps Signature Campaign promises. And mexico is going to pay for the wall dont worry about it. The bureaus former deputy director, andrew mccabe, told en0 minutes and scott pelley, he spoke about the 25th amendment, which could remove a president , with Deputy Attorney general Rod Rosenstein. A discussion of the 25th amendment was was simply rod raised the issue and discussed it with me in the context of thinking about how many other cabinet officials might support such an effort. Reporter rosenstein was actually openly talking about whether there was a majority of the cabinet who would vote to remove the president. Thats correct. Counting votes. Or possible votes. Reporter well, jeff, the Justice Department does not deny that rosenstein mentioned the 25th amendment. But i talked to sources who were at this meeting and they dispute mccabes characterization that this was a serious suggestion, and they point to who was in the cabinet at that point jeff sessions, mike pompeo, wilber ross. And they said, look, someone as politically savvy and as smart as Rod Rosenstein would not think that this was a viable option back in may of 2017. Glor okay, interesting point. Prosecutors have revealed that they have evidence that roger stone communicated with wikileaks. And theyve been investigated whether roger stone coordinated with wikileaks as it released thousands of democratic emails that were believed to have been stolen by russian operatives. Chicago detectives tore through an apartment overnight, looking for clues, and an evidence log of the search included ropes, masks, and bleach. When they first learned about what happened to him, they were horrified. Reporter Gloria Schmidt is their lawyer. U they really dont understand how they even got information that linked them to this horrific crime, but theyre not guilty of it. Reporter smollett said he was sure the men in the photo were his attackers. I dont have any doubt in my mind that thats them, never did. Reporter he also said he didnt know his assailants, but in a strange twist, the aspects lawyer said they all knew each other. And while smollett alleged his attackers yelled racial slurs and said, this is maga country, that seemed unlikely coming from two black africans. And their arrest could undermine the initial view that this was a racially motivated hate crime.
