The nsa faces historic changes in how it collects phone data. President obama will reveal the changes in about an hour at 8 00 a. M. Pacific. A Senior Administration official tells our Major Garrett that the president is ordering the nsa to try and transform the way it Stores Information collected from millions of americans cell phones. The nsa will collect new phone data to search for signs of terrorist activity and the fact that immediately the new policy will require a judges approval before the nsa can access any existing database. Cbs News National security analyst juan suarte is a former advisor to president george w. Bush. Good morning. Good morning, charlie. Whats your reaction and take on what the president is expected to say . Well, this is a dramatic shift. We knew that the president was going to have to articulate the balance between preserving the capabilities of the nsa and the Intelligence Community to gather data and analyze it with privacy and civil liberties. But the move here to shift the data out of the hands of the nsa is a fairly dramatic one, one that will take greater detail, perhaps some legislation but more importantly, charlie, i think the revelation that the president will order judicial findings, or order, before any query of the database can happen, thats a dramatic shift as to how the Intelligence Community has used the information in the past and will no doubt raise concerns in that community about how it does its business. Why do you think the president made this shift and this change . Well i think the president was certainly hearing the concerns about the Government Holding mass amounts of telephone meta data. And he couldnt ignore it. He cant ignore it. And so, hes trying to balance here the ability to query these kinds of databases, which are important to connect the dots. But clearly with the concerns over the government having access not just now but in the future, and for potential abuse, and i think the president certainly wants to strike that balance. Juan, let me ask you, the president gives speeches. He calls for reforms, but doesnt necessarily mean that they become action. They require a lot of approval by the Intelligence Community, by congress, and the president , were told, is not going to say who should eventually hold this data. Who could hold this data . And will it to answer critics questions, will it slow the intelligence efforts to quickly retrieve the data to prevent a terrorist attack . Well theres no question that it will slow the Intelligence Communitys ability to access the data. It doesnt collect, it doesnt have it in one place. Its going to be slower. Thats just the obvious fact. The reality is there is no clear option at this point. You could have the Telephone Companies keep it, but theres no legislation that requires retention beyond a certain point. You could have some third party, a clearinghouse, keep the data about you that doesnt exist, and its not clear that that would be any safer for privacy and civil liberties. So thats why the president will punt the bid on that issue, declare thats the desire but he wont necessarily articulate what that looks like. Juan, thank you so much. Thank you charlie. Southern california faces another day of severe fire danger. Crews this morning are getting control of the wildfire east of los angeles. But not before it burned more than ten square miles. Flames destroyed at least five homes. Three men accused of starting that fire in the mountains near glendora glendora, california, could be charged with federal crimes. Carter is in california. Good morning. Reporter good morning, norah and charlie. And good morning to our viewers in the west. This is one of the five homes destroyed in the fire. Were in the mountains outside of l. A. , about 40 miles east of downtown los angeles. At this hour the fire is still only 30 contained, and authorities believe it was started by an outofcontrol campfire. Crews battled the flames through the night hoping to prevent the fire from spreading. An army of more than 600 firefighters attacked fastmoving flames on the ground, and earlier thursday from the air, with more than a dozen waterdropping aircraft, including two super scoopers that can drop 1,600 gallons of water. Im going to have to back up a little bit now, because the wind is just in my way. Reporter a cameraman from our station kcbs in los angeles, was one of the first on the scene, and captured this dramatic footage. My concern is to try to save save my house. Reporter one of the buildings destroyed was part of a famous mansion built in 1924 by the Singer Sewing machine family. Scott wilhite barely escaped with his life. What did you lose . Everything i have except what i have on. I dont have my wallet drivers license, no money. Reporter three men are in custody for starting the fire. Glendora Police Corporal Nancy Miranda spotted them running from the flames. They reeked of smoke and i asked them if they were coming from the fire. And they said they were camping and woke up and a the fire got scared and ran. Reporter did you believe them . No, they were both very nervous. Reporter police say the fire likely started when the men threw paper into an illegal campfire. Embers carried by the wind sparked the blaze. Its amazing that three guys would set a fire during breezy conditions in the driest year of record that we have here in southern california. Reporter so these three guys could be in a lot of trouble . They are going to go to state prison, not counting jail. These are felonies and a lot of property was damaged today, people were injured. Theyre going to go to prison. Reporter now los angeles normally gets about 15 inches of rain every year but in 2013 the l. A. Area only got 3. 5 inches of rain. And right now, norah and charlie, there is absolutely no rain in the forecast. Carter, thank you. And a new blow to the security of shopper this is morning. The massive cyber attack involving up to 110 million customers at target appears to be part of a much larger scam. Homeland security is warning several retailers about a sophisticated Computer Program stealing personal information. Jan crawford is in washington with new details. Jan, good morning. So hackers are using a type of Malicious Software or malware is what they call it to teal credit card information, and federal officials are concerned some retailers, they worry, could be under attack right now, and not even know it. The malware called kaptoxa captures credit card information as customers swipe a card. A new report on kaptoxa from i opinion site doesnt mention target, but Law Enforcement sources say the massive data theft helped investigators identify the Malicious Software code. A source close to the investigation confirms to cbs news that at least a portion of the code was written in russian, although that is not necessarily mean it originated in russia. Kaptoxa is sophisticated, designed to cover its tracks. To help companies combat hacker, the department of Homeland Security has release add set of highly technical instructions telling the nations retailers how to find the code and stop it. In light of the data hacks at target, as well as upscale retailer Neiman Marcus Cyber Security exhibits were among the most popular at this weeks National Retail federations annual expo. This morning, a former aide to Chris Christie is offering to talk to prosecutors but David Wildstein will only break his silence if he is granted immunity. State lawmakers put out a string of subpoenas yesterday. They want to know why christies political appointees restricted access to the george baug bridge, creating turmoil for drivers. Reporter good morning to you, charlie. 17 individuals and three organizations are being subpoenaed but their identities will not officially be made public until they have been served with legal papers. At least five inquiries or investigations have now been launched. Among those expected to receive subpoenas are current or former members of governor christies inner circle. Former Port Authority official bill baroni david sampson, fired deputy chief of staff bridge edt anne kelly, and bill stepien. We started with the finances and operations of the Port Authority, and piece by piece, we followed the trail and unexpectedly we wound up in the governors office. Reporter the assembly hired reid schar to help its investigation. The former federal prosecutor helped put illinois governor Rod Blagojevich shined bars on corruption charges. With legislators turning up the heat, governor christie made a point of showing he was focused on running the state. Visiting a town devastated by superstorm sandy. Republican leader Mitch Mcconnell comes coburn among the most intelligent, principled and decent men in modern senate history. United airlines is investigating a case of severe turbulence on its jet. Five flight attendants were hurt. Yeah were westbound, we hit severe turbulence and the person got knocked around quite severely. The flight to beijing returned safely to new jerseys Newark Liberty airport yesterday, about 45 minutes after taking off. The injured crew member suffered bumps and bruises. None of the 189 passengers was hurt. Two federal agents are recovering from gunshot wounds. They were shot thursday by a teenager wanted in a string of shootings in ardmore, oklahoma. Police killed the gunman during a shootout late last night after a massive manhunt. They say the 19yearold is responsible for two other shootings. A grenade attack this morning during an antigovernment protest in the capital of thailand. At least 36 people were hurt. Witnesses say the explosive was thrown at a truck driver by demonstrators. No word yet on whos responsible. The protesters are calling for thailands Prime Minister to resign. This morning, in the capital of china, the air is so bad, people are being told to stay inside. Pollution in beijing reached hazardous levels earlier this week and as they report, its becoming a worldwide concern. Reporter beijing is no stranger to smog but this week the city of more than 20 million has suffered through conditions not seen in more than a year. Major highways were shut down as visibility dropped to less than half a mile. The sun barely in sight. Residents were warned to stay indoors. Many who did venture out wore face masks to protect themselves. The pollution is really bad, one commuter said. Im planning to live beijing, i dont want to stay here. Thursday, toxic particles in the air were over 20 times whats considered safe. To compare, in los angeles, the air quality index hit a high of 93. In beijing, that number rose to over 600. The state jumped 14 spots in the ranking of states with millionaires. Its new number is 29 north dakotas energy boom is credited with driving up wealth. Usa today says veterans of the wars in iraq and afghanistan are falling on hard times. Last year nearly 50,000 were either homeless or at risk of homelessness. That is triple the number in 2011. Cleveland plain dealer says a convicted killer was executed thursday. He was the first man put to death using new combination of drugs. Witnesses say he gasped several times during his 20minute execution. Mcguires family plans to sue over what it considers cruel and unusual punishment. The boston globe looks at former new England Patriots aaron hernandez. Police believe he pulled the trigger in the 2012 double murder. Hernandez pleaded not guilty to another killing last year.
