Angry protests over a Deadly Police shooting led to looting and rioting in ferguson missouri. 18yearold Michael Brown died saturday after a struggle with an officer. Brown was shot several times. Police say he was unarmed. The brown family believes officers should be fired and arrested. Reports say the browns have hired the same lawyer who represented the family of Trayvon Martin. Reporter the problem here is that the local community and the local police are at odds over exactly what happened on saturday and tensions remain high. On sunday, a peaceful vigil and demonstration turned into a night of rioting and looting, including this store behind me. People have broken in. Theyre looting the whole business. Reporter a scene of chaos and destruction overnight. Looters smashed store front windows and loaded up their cars with anything they could get their hands on. Tires were taken from this auto shop. Across the street more looters cleared out a Beauty Supply store. Five to six shots just now. Walmart has barricaded themselves. All of the employees inside the store and looters are breaking in. We need justice now reporter the night of violence was in stark contrast to the Peaceful Demonstrations earlier in the day sparked by the death of 18yearold Michael Brown on saturday. He was nothing but a gentle giant. He wouldnt have harmed anyone. He put his hands in the air. Reporter Dorian Johnson said he was walking in the middle of the street with brown when a Ferguson Police officer drove up and told the men to get on the sidewalk. There was apparently a struggle between brown and the officer. Johnson says the officer started choking brown and tried pulling him into the police vehicle. His weapon was drawn and he said ill shoot you or im going to shoot and in the same moment, the first shot went off. Reporter witnesses claim the officer then got out of his patrol car and opened fire while the unarmed teen ran away with his hands up. The victims mother couldnt contain her emotion. You took my son away from me. You know how hard it was for me to get him to stay in school and graduate . Reporter the local naacp has called a meeting here tonight to try to cool things off. In the meantime the police told us they made 32 arrests overnight and at least a dozen stores here were looted in the process. All right dean thank you. In Northern Iraq this morning kurdish troops are regaining territory after u. S. Air strikes targeted isis forces over the weekend. But the Islamic Terror Group also recaptured one town this morning. Reports say the kurds are getting arms directly from the u. S. Holly williams is in erbil, iraq, the kurdish capital threatened by isis. Holly, good morning. Reporter good morning. Two towns have been recaptured from islamic extremists in Northern Iraq, but the militants are still just 30 miles from here and there are reports this morning that after fierce fighting, they have seized another town jalawla. These are the men the world is relying on to defeat iraqs islamic extremists. Theyre kurdish soldiers from the countries northeast, famous for their courage on the battlefield. The kurdish fighters are the only ones on the ground in Northern Iraq still taking on the islamic militants. After iraqis government soldiers ran away two months ago. Two miles from the front line we met 22yearold kadar sayeed who just graduated from college. Theyre killing people. We kill them. Reporter isis swept into Northern Iraq in june capturing a swath of territory and calling it a new islamic state. Now theyre targeting Iraqs Christians and another religious minority known as the yezidis. Thousands who fled for their lives are now stranded on a barren mountaintop facing starvation. More than 50 children have already died. And the Iraqi Government claims isis killed hundreds of yezidis, including some who were buried alive. U. S. Air strikes are helping the kurdish fighters but so far theyre not enough to force the extremists out. The men here told us what they urgently need is weapons. Theyre fighting with outdated guns, while the islamic militants are using artillery and tanks, which they captured from the Iraqi Government soldiers. In baghdad, there is mounting pressure on iraqs Prime MinisterNouri Al Maliki to quit. The goal in the short term is to keep the isis fighters from taking over erbil, the capital of kurdistan in the north, and to free the religious group that has been trapped in the mountains there. That seems to be working. But what is going to take a lot more work, charlie, is to actually degrade the group and destroy the group. What were doing right now is not going to do that. And what will it require to do that . I think two things. One is its going to require us with our capabilities to take out the leadership of the group while the iraqi army and the kurdish army the peshmerga, fights on the ground against these guys. That ladder of peace is going to take a political agreement in baghdad, which we see this morning is getting even more difficult to get. Mike the president himself admitted over the weekend that this islamist state militants advance is more rapid than intelligence estimates. Was this an intelligence failure or a policy failure . So i dont think this was an intelligence failure. This is a classic problem in the intelligence world. Theres a difference between strategic warning and tactical warning. There was strategic warning here in the sense that the Intelligence Community was saying for over a year year and a half, two years that this group was getting stronger and stronger and stronger. Whats much more difficult is that tactical warning that says theyre going to move tomorrow or theyre going to move in the next week. Thats much more difficult. Thats what we didnt have. You were there at the cia. You say this was not an intelligence failure. Over the weekend we heard the former secretary of state, Hillary Clinton, suggesting it was a policy failure. I mean she said that obamas failure to assist the moderate rebels in syria, quote unquote, left a big vacuum. Is this an outgrowth of our inaction in syria . There is no doubt that what isis was able to do in syria was probably the key factor in strengthening them in terms of what theyre doing in iraq today. It is difficult for me to see how arming the moderate rebels would have made that much difference in syria. We would have had to have done it on a very very large scale that i think would have frightened our partners in the region because it would have put a very very large footprint, u. S. He pulled out of that race 12 hours after he fatally struck driver kevin ward jr. That has cast a shadow on stewarts storied career as well as the sport he loves. It was lap 14 in the super sprint race when kevin ward jr. , number 13 and tony stewart, number 14 were seen battling for position. Amateur video captured wards car as it spun out slamming into the wall. The 20yearold then walks onto the track midrace, appearing to try to confront stewart. Seconds later, hes run over. Tony hit him medics rushed to the scene but ward was pronounced dead an hour later. Jeff gluck saw the video. Ive never seen anything like what happened the other night. Thats just insane. Reporter investigators say stewart, who was involved in an accident on the same track last year, was visibly shaken. At this very moment there are no facts in hand that would substantiate or support a criminal charge or indicate criminal intent on the part of any individual. Reporter in a statement sunday, stewart said there arent words to describe the sadness i feel about the accident that took the life of kevin ward jr. Stewart is no stranger to confrontation. Last year he got into a fistfight with driver joey logano and in 2012 the threetime nascar champion hurled his helmet at another racer. I learned my lesson there. Im going to run over him from now every chance i get. Does this it in with his reputation of an aggressive driver. I think hes an aggressive driver, but not like that. Maybe hes battling for position or blocking a guy, but to take a guy out like that you know i think thats a whole different level of classification. Reporter initially stewarts camp said he would compete in sundays nascar race but hours later, his team reversed its position. You know he feels strongly this is the right thing to do. We support it and agree with it. Like i said its a difficult time for both parties. Reporter the ward family released a statement saying they appreciate the prayers and support and they need time to grieve. As for the investigation, Officials Say theyre looking at everything from the clothing the drivers wear to the condition of the track. Norah. All right, don, thank you. Cbs news legal analyst jack ford is with us. Jack, good morning. What a disturbing story. You hear investigators say no criminal intent but does that mean stewart is out of the woods . It doesnt. Theyre going to look at all the possibilities here. And you could have were not saying there will be but you could have criminal charges that dont focus on intent. Criminal intent would be somebody was concluding that he wanted to harm him, he wanted to even kill him and so he targeted him and drove at him. Theres the possibility, im sure theyll look at this and see where the facts take him but there is the possibility of a criminally negligent homicide. That means i didnt intend to kill anybody, i didnt intend to hurt anybody but what i did was i ignored an obvious risk. As a consequence of my conduct, ignoring that risk somebody gets hurt. And that my conduct basically was a gross deviation from the reasonable standard of care. So you could just say im going to try and scare this guy and take my car near him, im not saying thats what happened you swerve and hit him. You didnt mean to hit anybody, but that could, could put you in that category. Theres much talk about him being a lot of aggressive drivers. There are a lot of aggressive drivers in nascar. There is an thats part of the reaction. The fans love it when they swap paint. Does their longterm rivalry have any well it could. If im the prosecutor and taking a look at this im going to want to know about his conduct in the past. We saw the shot of him firing the helmet at the guy, saying im going to take him on every chance i get. Does that mean he would be charged or found guilty of this because of his past conduct, no. Is it a factor in intent . It would be a factor certainly in intent, if they were looking at intent here but it could also be a factor because im not sure anybody is saying he intended. It could also be a factor in the notion of negligence. Are you the angry guy whos going to come close to the guy to scare him, macho up with him a little bit.
