Were closely tracking the sierra lamar murder trial. Antolin Garcia Torres is accused of kidnapping and killing the popular morgan hill 15year old. Lamars body has never been found so the prosecution is relying almost entirely on forensic evidence. Much of the testimony wednesday, in the trial of antolin Garcia Torres, charged in her murder, focused on the discovery and handling of that evidence. The defense has asserted the evidence is contaminated because deputies and Crime Lab Techs failed to follow proper protocols. Sierras bra, panties and other personal items were introduced as evidence aswell as her cell phone, said to be a critical piece of evidence in the case. Mateen died in the attack a federal grand jury recently indicted salman, claiming she helped matten and lied to investigators after the shooting last june which left 49 people dead. Happening now in the south bay. Police are investigating the shooting death of a man. It happened around nine last night on tully road in san jose. The unnamed victim was pronounced dead at the scene. Officers say the shooter has not been caught and they do not have a suspect description or a motive. The shooting happened in the parking lot of an optometry business. Officers are reviewing Surveillance Video at nearby offices and stores. Its the fourth homicide in san jose so far this year. Its been one year this february since little Arianna Fitts was last seen alive in oakland. And theres still no sign of the girl. Shes the daughter of a woman whose body was found last april in a shallow graveat san franciscos mcclaren park. Nicole fitts was murdered and her body covered with a piece of plywood. Police dont think her 3yearold daughter was with her when it happened but relativesthink someone might have wanted the child for their own. And arianna might be alive and in the bay area. San Francisco Police continue to work on the case. And theres a reward of10thousand dollars which they hope will bring in new clues. Investigators have executed search warrants in oakland, emeryville and daly city. Theyve also checked out leads in southern california. A new Computer Program installed in the Alameda County court system to track cases. Apparently isnt working right. And thats causing chaos for dozens of defendants. Since the 4 pointfive Million Dollar software was installed this summer, a number of people have reported being arrested on warrants that should have been cleared. Some also claim they were kept in jail longer than they were supposed to be. In addtion. Criminal misdemeanors have turned up as felonies on some peoples rap sheets. Yesterday the public defender went before a judge to argue a motion asking the courts to fix the problem or go back to the old system. That same judge also heard arguments from the district attorneys office, who in a rare instance is siding with the public defender. He says they know of more than 50 people whove reported problems, but he fears its a much more wide spread issue. I would guess we are talking hundreds and hundreds. Because we only bring forth what we catch so if a client gets held two days longer than hes supposed and doesnt notify anyone then that just goes away, a client gets held a week longer we might not know about it, its those who call up and say hey im here longer than a should be and we get those clients out. The executive officer of the court says the problem is that the old system is outdated and no longer supported. He believes they may need a different system altogether but isnt sure where they will get the money to replace it.
