now at 9:00, three phoenix police officers run down, run over by a car. tonight, new information about the man behind the wheel. it began two years ago, a fight over flight paths in phoenix. we'll find has been made to change the direction of planes at sky harbor. uncovering the nation's deepest and darkest secrets. we talk to an arizona man who has spent decades digging for answers. tackling opioid abuse in america, the new effort to try and bring awareness to this growing epidemic. plus a valley company's sexy halloween show makes it all the first on fox tonight the latest on an apparent intentional attack on police officers. >> three phoenix police officers are mowed down by a car outside of a quiktrip convenience store by a man behind the wheel. thankfully those officers are still alive. they survived this. it's hard to believe when you see the surveillance video. it shows the crash. it is very difficult to watch this. take a look. amazing that any one of them is alive tonight, and you can see the officers standing outside the store, doing their job, when the car comes speeding toward them. two officers hit, a third officer is able to jump out of the way as the car smashes through the store windows. >> and this is the man that police say was behind the wheel. we were there as 44-year-old marc laquon payne was brought into jail tonight, payne keeping quiet as reporters tried to ask him questions. but tonight we are learning more about his past. from the fourth avenue jail in downtown phoenix with the latest. >> reporter: yeah, this is almost like d?j? vu for 44-year-old marc payne. he's at the fourth avenue county jail tonight facing three counts of attempted murder, the phoenix police chief calling his acts cowardly and unacceptable, and it turns out payne has history of attacking phoenix police officers. this is the man accused of intentionally running over three phoenix police officers, unprovoked. 44-year-old marc laquon payne did not respond to reporters asks as to why. >> and i'm outraged by this incident. this is a violent, cowardly act on our police officers, and it's simply unacceptable. our phoenix police officers were targeted. >> the surveillance video is difficult to stomach. it shows the three officers standing outside of their patrol car. without warning, payne's vehicle rams into them at high-speed. two officers are directly hit. the impact sends a rookie officer flying into the air. a sergeant is trapped under the vehicle. >> these officers could have easily been killed, and i thank god that we are not planning three funerals right now. >> the injured rookie helps his partner tackle payne and came into in custody. >> unbelievable. our officer that hits the front of the glass and smashes the glass gets back up and engages in a fight to take the suspect into custody. he runs over us, and then still fights with us while we are trying to take him into custody. >> reporter: while we don't know why payne plowed into the officers, we know he has a history of attacking police, arested in 1997 for assaulting three police officers. officers pulled him over for a traffic stop. he had had a warrant out for his arrest. but when officers tried to take him into custody, he fought, elbowing and kicking them. payne cut a plea deal in that case and was put on probation. officers again. only this time, he's facing attempted murder charges. and again, thankfully the officers who were hurt this morning are expected to make full recoveries. a sergeant is suffering from a broken leg and the rookie officer, it was his first day on the job. he's suffering from head injuries. investigators believe that payne was impaired during this incident. reporting live, i'm nicole garcia, fox 10 news. >> glad to hear those officers are expected to make full recoveries. skyfox over the scene of a crash involving a phoenix police suv today, this happening this evening near67th avenue and broadway. d.p.s. identified a suspect in a deadly crash on i-17, may be driving a gray chevy impala. he should be considered armed and dangerous. yesterday officers served a search warrant at a home near 16th avenue and peoria. troopers seized truck they say belongs to smith. the victim was identified as 19-year-old javier gonzalez. yesterday gonzalez was stranded on the side of the freeway because his truck had broken down, when he was hit and killed. hundreds of at steele indian school park tonight in phoenix in support of the standing rock sioux tribe and their fight against the dakota pipeline. they claim it would poison their water supply. last week, the feds asked crews to voluntarily stop their work, but protesters say that is not enough, and tonight a member of the sioux problem, who happens to also be an a.s.u. law government and president obama. >> you promised up, and we believe in promises and uphold promises and always have, so we don't believe this should be another broken promise. please listen to us and let us have clean water. >> the company says construction is almost 60% complete and concerns about the water are unfounded. it's been a nightmare for parents and now a change of plans for one of the two glendale schools that were forced to close over safety concerns this week, students from challenger middle school will soon take over the building formerly used by cordova primary school. that school was shut down because of low enrollment. the building near 39th avenue and glendale has more than two-dozen empty classes, and that should be enough for challenger's 650 students in grades four through eight. class is expected to start up again on friday. school will hold their classes at desert spirit elementary beginning on thursday. new at 9:00, it's been two years now since the f.a.a. changed the flight path of planes taking off from sky harbor airport. that move made residents living along the new route angry. and city officials say they were never told that this was going to happen, so they have been fighting with the feds ever since, and now here we are, two years later, and still no resolution. ty brennan joins us now live with the latest in this case. ty? >> yeah, every few minutes here at phoenix sky h plane is taking off, and those residents are still very mad about those flight path changes. now, let me show you exactly what's going on here. this is phoenix sky harbor right here on this map, and before those flight paths were changed, those planes would take off, gain altitude, before heading west. but now as you can see in this dark blue, they are cutting a path right over neighborhoods, and that has neighbors very upset. >> two years ago we woke up to neighborhood than we had experienced. >> reporter: for two years now, steve says he has had to live with the constant sounds of planes taking off and heading right over his historic home. >> we can't enjoy barbecues and family time. there's a plane flying over right now. it's been a big change. >> flight paths changed any warning from the federal aviation administration. d the flight paths were changed when the f.a.a. unveiled new technology which were supposed to be more efficient and safety, called next gen the city is all for the fabulous new technology. the problem is the city changed flight paths over the city of phoenix without giving any >> lawsuits were filed to change the flight path back, but a year after the lawsuit, still no resolution. residents are still hopeful that they will get some peace. >> we only filed this basically a year ago, july 2015, so that's pretty quick action. in the meantime we are seeking quick solutions, seeking opportunities with the f.a.a. to solve this problem. it didn't need to happen the way it did. >> reporter: so what happens next? 10 news. hi, everybody. take a look here. 89 degrees. the winds dying down, west southwest now at about eight miles an hour. and as we look at some of these numbers, 86 degrees at deer valley, 86 in surprise, 88 in still some moisture out there. you can kind of see that stuff working the east side more than anything. as we go down to the city here and get you a look at phoenix, little something out here off to the east of us as we go down and take a look at the tuscon area, and that was really, well, you can see really full of moisture earlier. but that stuff is drying up, leaving the state. we continue to move up that east side, because that's where everything is, and that's where it's headed out of here from. in fact, we'll show you here. up north, this stuff was really heavy earlier. not much going on now. but as we back off and take a look at the entire state, not much happening on the west. a little something in the south. everything has found its way over into the eastern portion of the state. still pretty windy in a few different places, but the wind has died down considerably compared to what it was. 98 degrees on the high today. other numbers would be 81 degrees at winslow, 77 at prescott, 86 at kingman, 88 degrees up at page and 100 degrees at gila bend. this is your day, 98 on the high, 78 on the low, 101 and 78 would be your normal high and low. this is what we are forecasting for tomorrow. lots of mid-90s, a few low 90s thrown into that mix as ll some temperatures coming down nicely here over the next 24 hours. we are looking at 83 at winslow, 67 at flagstaff, 80 in sedona, 96 at gila bend, and 93 down at tuscon. look at these nightly lows. once again we see these temperatures, some 60s starting to show up in the mix now, mid-70s, low 70s, nice looking overnight lows to get things cooling off just a little bit. once again, we did see some freezing temperatures up in the northwestern portion of the big storms across iowa cause a little bit of flooding, at least flood warnings for those areas. and then heavy showers down in florida, there's a reason for that. we have got a, well, we have got a low pressure system that is working to be -- well, it is a tropical storm right now that has just made that level because we checked that before the news, and it was still about 35 miles an hour, but now they have given it tropical storm status, and it's right next to so pumping a lot of moisture into that area, and as you can see, keeping the temperatures down a little bit as well. but you can see there's still some warm temperatures out there, a little bit of cooling from the north. 73 overnight here, 94 degrees for tomorrow, and we are seeing some nice looking 90s all through that ten-day forecast. some of them get a little close to small towns and large cities, and everything in between. >> broadcasters are rallying again behind this effort. i thank you for it. >> we don't want to lose people. we want to cure people. >> the for law enforcement, efforts to fight the epidemic are getting harder as well. border agents continue to try to stop the flow of illegal drugs coming into the u.s., especially the new powerful narcotic than heroin, blamed for drug overdoses all across the u.s. for cartels, there has never been an illicit drug more lucrative than this. >> coming from china and cross the border, it comes across in powder, mixed in liquids, in heroin. >> it makes it harder for agents to detect the drug. >> and in hawaii, a local church handing out overdose prevention kits, inside the kit two doses of naloxone. families of heroin users are urging them to pick up a kit, but warning that it is not a reason not to see a doctor a bar mitzvah and letting teenage boys touch her breasts. during seven weeks of testimony, witnesses often gave x-rated accounts of the incident happened that allegedly happened on march 17th. she drank heavily, allegedly flashed her breasts, and allowed the boys to the contempt of court case against sheriff joe arpaio, judge has now scheduled an october 11th hearing at the request of federal prosecutors. the u.s. justice department is deciding whether to bring criminal charges against the sheriff for ignoring a judge's order in a separate racial profiling case to stop his immigration patrols. that judge has already found arpaio in civil contempt for violating his orders. some sad news from the mesa police department, retired canine named rico has passed away. he came to the department in 2004 and then served six-year as patrol dog. police say he lived to a grand old age of 17. a peoria high school student makes an incredible recovery brain injury in a dirt bike crash. his life really did change last summer when he flipped his dirt bike. and this is him in the hospital shortly after a. doctors and his parents, they feared he would not come out of his coma. but after two weeks he woke up, and ever since he has been working slowly to regain the skills he lost. relearning how to speak, how to eat and how to move all over again. >> when i was here first, i'm like bike because there' nothing else that's as fun to live for. >> two brain available to individuals earning more than $250,000 or couples earning more than $500,000 a year. trump's proposal also includes a guarantee of six weeks paid maternity leave for new mothers.
