Will be anymore victims. They have to go back in, this evening the crane is in place and they said that they have secured the one potential area that had visuals. This is the wall portion over at 31st avenue. That was cracking and leaning. They have seen shored that up so they will be going back in there again this evening. Earlier this morning though they did find three additional victims that bring the death toll to 36 victims of this fire. About 16 families have been given the identifications. Three of those victims are also international. We are told that one victim came from finland and another korea and guatemala and reaching out to the various embassies to give identifications. And 22 autopsies have been completed. The original list that the emergency crews were going off of in the hundreds but the sheriff says many of the people on the original list have been found. The list of potential missing victims was in excess of 220 but a lot were duplicate because they called a person by a similar name. So we reduced that list down to well under 100. We have now notified people that are alive and were suspected of being in the area and they are safe. We still now have a list of 50 people that still have not been accounted for. And the District Attorney has also announced the criminal investigation portion. She has her criminal Investigation Team out here and working with in conjunction with atf and other firefighters and emergency crews out there. They have their own hazmet suits going in there and working alongside doing their portion of the investigation. She says this is a potential crime scene. Now leading that investigation from the d. A. s office is one of investigators that worked in the Real Estate Division and says she specializes in property use and leading that investigation. In terms of what we could potentially see in charges and who might be involved, the District Attorney did not want to speculate at this time or provide anymore detail. But she says there is a possibility that we could be seeing charges that range anywhere from manslaughter to murder. As we have been reporting the sheriff has said that he does not expect to find anymore bodies inside that building. The 3 00 news conference, the fire chief says 75 of that area had been gone over and 75 of the debris had been removed. There is still 25 left. So i guess the assumption is that last 25 have been looked at and officials now have determined that there are no more bodies inside the building. Reporter they didnt elaborate on that. They just said that they still have two main areas of concern that they have to go into. The Sheriffs Office is saying that they do not think that there are more victims inside but this is just it is confusing honestly because they still have 50 people on a list that are missing and they said that they have gotten a lot of calls from families saying i know, my son or my daughter goes to parties there or lives near the area and i havent been able to get in touch with them. So there is no actual confirmation that anyone has seen the people at the party or any special activity that they were going to the party but they are still on this list so that is what the Sheriffs Office and emergency crews are dealing with right now. The hope is that there is not anyone else in there. And lee, have you gotten anymore information . We have heard the fire started possibly in the back of this building but they still hadnt figured out a cause. Have you heard anything new about that . Yes, they have confirmed that they believe the origin of the fire was in the first floor towards the back which we had talked to a survivor, a woman that lived at that building yesterday. And she told me that she lives in the first floor, towards the back and she is certain that the fire had started in the back room and believes it was electrical and ties into what the tenant is saying that the fire started from the back. We heard from another fire chief that dance floor was above, directly above where the origin of the fire was. When i asked the question again at 3 00, the other deputy chief white says he could not confirm where the dance floor was and locations to where they believe the fire was at this time. And lee, quickly before we let you go, pg e had to cut fire to the building this afternoon saying it would affect possibly 50 to 500 customers in the area and they wanted to make it safe for crews to go in and use the crane. Any word on when pg e will put the power back on for surrounding customers . Good news there. They originally thought it was going to be out for 50 to maybe 500 people. Well pg e was able to do their work and they were able to come up with something that would only put power out for just ten people. Less ten potentially. President obama issued a statement saying his prayers went out to the people of oakland saying the American Community are devastated including young men and women have tragically lost their lives. Oakland is a creative city and as family and residents pull together in the wake of this awful tragedy they will have the unwavering support of the american people. We are learning more about the victims from posts on social media. Ktvus Paul Chambers has a look at some of those posts. There have been many social media pages to honor the victims and the city has identified 33 of the 36. All of the names have not been officially released. For now we are taking some of the victims that are listed as missing but many identified dying on social media p. According to his Facebook Page, Barrett Clark is an oakland resident that went to santa rosa high school. Clark worked as sound engineer. Friends held a wake in San Francisco at his honor. A close friend of clark is quoted as saying we are confident barrett was there and did die in the fire. Another friend named dan owens said goodbye to a dear friend that lost his life in the oakland warehouse fire. We are all going to miss you Barrett Clark. We were all so blessed to have known you. Rest in peace my dear friend. You were one of a kind. Oakland residence jonathan birdbomb worked for the bus tour according to a Facebook Page there will be a laser vigil for the us c alummist. He graduated in cinematic art and worked there that night. Michael dan meyer was from massachusetts and a performer at the event. A friend that set up a memorial page in his honor says there will be a vigil held thursday night. Time and place is not being said. On his Facebook Page it said danmeyers parents were able to identify his body last night. Elanna cane is listed as the girlfriend of danmeyer. A post on facebook stated my heart is truly broken and i cant stop crying please pray for my close friend. Investigators say three of the the victims from outside of united states. We know they are from finland, guatemala and korea. We will go to ktvus ann reuben. Friends described travis huff as a bright light and cash askew. They were musicians. Cash may have been 22 but loved ones called her an old soul. She had found comfort in her own skin and true love with her girlfriend anya taylor. Amazing and gorgeous. She is also like a person that was so strong as she fought for her friends and she loved so hard. Ask, ew a transgender woman connected with women and formed a group. She says askew was the only person she felt comfortable making music with. She is my best friend in the entire world. Like creative collaborator. She had such a unique thoughtfulness. I have never met anyone so thoughtful. Her friends said askew moved through the world with place and hope people will remember her for how long she will beloved. I cant express how lucky we are to have known her. Travis hough made his music at ghost of lightning. His music manager says he was a bright light, someone that never met a stranger. He was always really positive about everything and like super optimistic when he would come in a room like brighten it up and get everybody happy and stuff like that. Hough spent time as a glass blower and his manager says he was always interested in inspiration and interviewing other artists about their creativity and he helped elementary kids. He thinks he would have wanted that to be his legacy. I would think he would want people to be their self and keep expressing theirselves. No matter the difficulties. Now we want to turn our attention to the potential legal liabilities following this deadly fire. Michael cardoza joins us from the newsroom. As we get closer to wrapping up the recovery of the victims inside will attention then shift gears in a more vigorous way to try to look at potential criminal charges in this case . Most certainly. I know the District Attorney of Alameda County have sent out to the scene one of their District Attorneys and an investigator to see what is going on. I would imagine that they look hard at the owner of the building to see the condition of the building prior to this and also to the one who was the music director of all of this or the promoter. I would think that they are going to look very hard at a Second Degree murder charge. If that building was in bad condition as a lot of people are saying, where they had wooden stairs, make shift stairs to the second floor. This they had electrical problems in the place where they had a lot of electrical cords, i will tell you what, that could create a condition that was inherently dangerous to human life. A condition that foreseably could cause death and that walks into a seconddegree murder. Barring seconddegree murder they would look to an Involuntary Manslaughter where negligence caused the deaths of these people. Michael certainly there are Different Levels of liability, you said the owner could face charges and the operator could face charges. What about the city. Could the city potentially face any part of blame for this. There have been complaints of Code Violations and illegal construction. Safety warnings. Right. And the city didnt do anything to really follow through and check this building. You know what is interesting about this, a lot of people think that why didnt the police do something . The police are the sheriffs have no power because this is private property. They cant go in and inspect. It is up to the department of inspectors to go in, building inspectors and Code Enforcement to go in and take a look at buildings like this. I talked to a retired Police Officer in San Francisco earlier today and he said you know there are a lot of buildings like this in San Francisco where they are set up as warehouses. But yet they allow people to live in those warehouses or have musical raves like this. He said a lot of times fires could easily start there. You have buildings out there that need to be more protected. Will the government be held liable . No. Because we have government immunity. That means whatever decisions people in government make unless it is so off the chart, we cannot go after them as attorneys. So will the government be held responsible . No. What about the you just mentioned a couple of different people, the operator, potentially the Building Owner but in this case, it looks like a lot of people are focused on this derrick ion that lived upstairs. This is the video from his youtube. This guy was pretty much running the show there from what we understand. Our authorities keeping an eye on him . We have legal ramifications that could include murder charges. If i would be looking at a murder charge i would be wondering what i would do with myself. Are people in authority, Police Investigators watching him to see what he does and where he goes . I would doubt it seriously. They are going to do the investigation. He certainly has to wake up that it could happen and you know about that was it a blog or something . He put out in an email that talked about well thank god my children are safe and my family is safe. A lot of people raised up to that. He would be best served by keeping his mouth closed and not saying anything like that. He probably didnt mean it quite like that and im sure he is empathetic to the people that died but it just didnt pass the test of sincere mourning for what happened and sincere responsibility. Should he be worried . He should be very worried about what is coming at him next. This has been described by some people as a death trap and there have been allegations that he was warned that there are many things, this was a dangerous place and he being the operator and someone running the parties. It seems like he could potentially face a wide range of charges. No question. And when you talk about that, julie, he has been warned. You knew about these conditions. Yet you did nothing about it. You were making money and a lot of money with the rent. You let people live there when it wasnt inhabitable. You had extension cords running off over the place and you didnt have the proper outlets to plug into. Those are the things that will be put in front of a jury when and if charges are brought against him and they will even bring in that email and i will tell you what, a lot of the injuries run on emotion and they will hear that. You think they are going to like him when he says things like that . That are so self serving. Guarantees dams guarantees d. A. S will put before juries he doesnt care then or now and so he should be worried about what is coming at him. Michael cardoza thanks so much. When i heard someone say fire, i immediately went to my kitchen and i grabbed my fire extinguisher. I had two or three small personal ones and a larger one. I grabbed that and i opened my gate and i looked down the hall and i saw 15foot flames and i realized that my fire extinguisher was going to do nothing for that. The more we are hearing from those that escaped. We are getting a clearer picture of how terrifying those final minutes must have been. Ted rowland has more. Ted. Reporter well, ken and julie, the process continues about 80 of the building now has been processed but they will work throughout the night and they will use the crane to lower people in the areas that are difficult to get to because of structural problems. Joining me is Sergeant Ray Kelly and your agency was tasked with the grim task of going in there and removing bodies and recovering material. You have talked to and informed family members that they have lost loved ones. How has this weighed upon you and the other sheriff deputies. We have lost one of our deputies lost a child, that has affected us closely and in dealing with the families and what they are going through, that is affected us very personally. We have had a lot of conversations with family members. Very intimate conversations about the last moments that they may have talked to their child. Or their loved one in here. Those are things that we will take with us probably for the rest of our live as we go forward and try to heal from this. Someone talked about their loved one texting them saying they were going to die. Kids were texting their parents that they loved them and they were going to die. We have heard reports that some of the trapped individuals inside try to break free through glass windows. But they were unable to because of i guess there was is there a metal grating. Metal security screens and that would have prevented anyone from jumping out and they got trapped in there and so at this point, can only speculate but there was no way to get out and so those screens prevented that. Update us on the work left ahead. We have about 25 still to search and we are holding 36 victims and i am hoping that it stays at that number. But there are some still unknowns so the potential to find more victims is there. But not on a mass casualty status. We did hear the sheriff says he doesnt believe there was anymore victims and reported out that some may have misconstrued that to being finished and there are no more victims. We are happy that we are holding at 36 victims and thats it. And we are optimistic that is it. The potential that there could be some more is there but like i said, lets hold out that we dont have that case. And your work continues and will continue throughout the night. Sergeant ray kelley.
