This morning a hearing is being held to determine the fate of a 13yearold girl from oakland who is on life support. Ktvu channel 2 reporter, janine de la vega, is at Childrens Hospital where supporters are planning to gather at the same time and hold a march in her honor. Janine . Reporter jana, the family of jahi mcmath has been Holding Onto Hope that somehow this little girl will recover. Shes been on a ventilator now for 11 days. In about three hours relatives as well as supporters will hold a march out here. They want to bring awareness to what happened to her. Now, right now, a restraining order is preventing Childrens Hospital from taking jahi off a ventilator. This 8th grader had a heart attack after surgery to remove her tonsles tonsils and doctors have said shes brain dead. Over the weekend, the attorneys for the hospital and her family were supposed to agree on an outside medical expert to provide their independent opinion on whether shes brain dead. This morning in koirt, both sides court, both sides will meet. The doctors think they know everything but if they knew everything my daughter wouldnt be brain dead. Thats why i lean on god and say whatever you want to do with her, i will let you do it. Reporter if both sides agree on a neurologist, she could be examined as soon as today. An Attorney Says after that they may not accept the doctors opinion and may want to move her. Theyve asked the d. A. To conduct an investigation and there is no response about that question. The march for jahi is scheduled to begin at 10 00 a. M. They will be gathering here at Childrens Hospital at 9 30. Everyone has been asked to wear purple, jahis favorite color. It will no doubt be a fun, emotional game for the team and fans lucky enough to be here. A lot of fans dropped by Candlestick Park hoping to pay tribute to this oneofakind stadium. People came to the stadium. They snapped pictures and they took time to remember their favorite moments from Candlestick Park. So many unforgettable memories here from the catch in 1982 to the earthquake in 1989. This place has certainly seen a lot of incredible moments. San franciscos recreation and Parks Department is in charge of upkeep for Candlestick Park. It has been since it opened back since it opened 53 years ago. This morning, the departments general manager talked about this emotional day for his team as they say goodbye. Quarterbacks and stadiums have a shelf lifl. This one life. This one has had this. There are growing concerns about crime. All year long Police Reported a growing number of homicides in santa cruz, watsonville and other cities across the country. Local Law Enforcement leaders have formed a Public Safety task force to find solutions to this years increase in crime. There are questions being raised at the state Public Utilities commission. 375,000 was returned to pg e. A man was trying to steal gasoline in portland. Now, he stole a partially filled gas can from a park he was parked next to. This storm could potentially have a Ripple Effect. Heres the thing so far, so good. No major delays here at sfo, oakland as well as mineta san jose. As you mentioned, the holiday rush is on. We spoke with officials here at sfo. Yesterday, they said it was their second busiest travel day with a little over 120,000 passengers coming through the airport. Today, they are anticipating another busy day. They are looking at 130,000 passengers today as many people have got the rest of the week off and are traveling to visit family and friends for the holidays. Officials say it will be hectic all week. There are minor delays. We did look at the website flightaware. Com. There were a few flights that were delayed. A jetblue that was scheduled to leave at 7 00 a. M. Its now scheduled to leave at 3 00 this afternoon. Its unclear if its weather related. We did speak with passengers this morning. Many plan to head while others are cutting it too close. My wife deserves the credit for that. Weve got about half the household here. She deserves all of the credit. She was up until about 2 00 in the morning and got up at 4 30 to get here. That family was headed to chicago, where their flight is on time. When they arrive, they expect it to be about 10 degrees or or or so. The weather is clear here. As of last night, 650 flights were cancel and 5,000 were delayed across the country. So far, so good at sfo. Weve seen longer lines at checkin and security. A kitten was stolen from the Animal Shelter control. Shes been found safe. A Hotel Manager found this 2 monthold kitten after seeing reports on the news. Surveillance footage showed two women at the shelter during the abduction. The kitten is expected to be reunited with her new owners this afternoon at the shelter. The data breach at target Stores Across the country is spurring lawsuits and high level investigations. The it involves customers credit and debit card information. Two class action lawsuits against the retailer have been filed here in california. Theres a third in oregon and attorneys attorneys general have launched their own investigation. Target is already feeling short term effects. The number of sales at target stores is down 3 compared with the final weekend before christmas last year. New this morning, 13 people are being treated for injuries after a tour bus crashed near los angeles. Now, it happened here in baldwin park on the 10 freeway east of l. A. The bus from palm springs went off the road and into a small drainage canal before hitting a fence. We dont know what caused the crash. Authorities say 38 people were on the bus at the time. Two people were seriously hurt. The others suffered only minor injuries. Police in petaluma are still searching for a driver suspected of fracturing a pedestrians skull with a pipe. Police say the incident started at a verbal fight on saturday night when the driver who was allegedly speeding nearly hit a 47yearold man who was crossing the street. Witnesses say when the pedestrian told the driver to slow down. The driver took a pipe out of his trunk and knocked the man unconscious. He came after him and jumped up in the air and whacked him in the head. I saw him. He used force. He used force with that pipe. Im surprised bud is not dead. The driver and the passenger are being described as white men in their mid20s. Their car was a mid90s blue pontiac. Oakland police are investigating a driveby shooting that may have started at a nightclub. Police say this red escalade was heading westbound on 580 when another car pulled up alongside it and opened fire. No one inside the car was hit. They did drive to an emeryville gas station to call for help. No description of the suspect or the car. Police say the driver of the escalade was at the lounge earlier this night. Its possible a conflict there could have led to the shooting. A rush of samesex marriage is expected this morning in utah. On friday, a federal judge ruled that utahs ban on same sex marriage is unconstitutional based on the Supreme Court decision that struck down prop 8. On friday, more than 100 samesex exaums were married in couples were mare rirred in Salt Lake City married in Salt Lake City after that ruling. Legal experts say the ruling will probably stand. Because this decision is based on a United States Supreme Court precedent, i think its very likely to be upheld by the 10th circuit and then by the United States Supreme Court. If the judges ruling does stand, utah becomes the 18th state where samesex marriage is legal. The local International Long shore and Warehouse Union is sharing holiday spirit by restocking toys for the San Francisco firefighters toy program. In the month of december, volunteers with the union have been collecting toys and other things for family in theed. They will be in need. They will be passing out things to children who to yet to receive anything. There are about 6,000 children signed for this years sacred heart distribution. Investigators say they think their home was targeted but that she was not the intended victim. Police are saying a phone scammer is a big threat to people who live in vallejo. They say a resident was recently contacted by someone claiming to be a Vallejo Police officer who then told the person there is a pending warrant for her arrest and if she didnt pay 2,000, she would be arrested and her children would be put into child protective services. Now, that scammer used a Computer Program to make it appear that call was coming from an Actual Police department. This is a big week for two of the bay areas biggest Transit Agency the workers in b. A. R. T. s two largest unions are set to vote on a revised contract. The tentative agreement announced saturday could finally end the long and bittered labor dispute that resulted in the strike. I just spoke with jahi mcmaths uncle who says he spends every night here at the hospital. Theyve been keeping vigil over jahi. He is organizing a marching thats supposed to begin in a a march thats supposed to begin in a couple of hours. Right now, a temporary restraining order is forcing Childrens Hospital to keep her on life support. Doctors declared her brain dead. Shes been on a ventilator for 11 days. She suffered a heart attack after having her tonsils removed. Over the weekend, the attorneys for the hospital and her family were supposed to agree on an outside medical exart to provide their expert to provide their independent opinion. This morning in court, the judge will see if both have agreed on which doctor will examine jahi. Im joined by jahis uncle. You are the one who is organizing the march. Its unclear depending upon what will happen in court. Do you believe your sister will want to move jahi or will she accept the doctors opinion . I dont think she would accept the doctors opinion if it was anything in a negative light especially considering how were not getting the opportunity to select our own doctor. Every time there is a doctor appointed, its always been from Childrens Hospital that they have hand picked. We still feel like theres bias there. With this march, however, this morning were looking to bring more awareness. Ive put out the number to dr. I just got off the phone with the airport duty manager here at sfo. He says they are looking at possible weather at newark, new jersey as well as philly but its not enough to cause any major delays this morning. And so far there are no major weather related delays at the airports. The Holiday Travel rush is on. Airport officials are anticipating another busy day. Somewhere in the ballpark of 130,000 passengers to pass through sfo today. Of course, as many people have the rest of the week off and are traveling to visit family and friends for the holidays. Officials say it will be hectic all week. We spoke with some passengers who say they plan on having a long day today. My wife deserves all of the credit. Shes been packing for the last two days. We have about half our household. She was up until about 2 00 a. M. And got up around 4 to get here. Things are going well. We anticipate things with the east Coast Weather but so far not anything impacting our flights today. Everything is on time. Its been a busy Holiday Weekend and busy holiday monday. Welfare officials are trying to figure out what truck the puppy was placed on and they are trying to track down the city the pickup pay came from. The data breach at target involved customers credit and debit card informs. Two classaction lawsuits against target have been filed in california. Theres a third in oregon. Attorneys general in new york, connecticut, massachusetts, and south dakota have launched their own investigation to find out when target knew there was a problem. The secret service is investigating. Target is feeling short term effects from the problem. Retail analysts say the number of sales at target stores is down more than 3 compared with the final weekend before christmas last year. Jahi was declared legally brain dead by oakland Childrens Hospital following a routine surgery to take out the tonsils. Her family wants a judge to allow them to bring in yet another doctor to examine her. Janine de la vega is at oaklands Childrens Hospital now, you just talked to family members who say theres been a new development. So what happened . Reporter dave, jahis uncle says the doctors at Childrens Hospital have chosen to do an unbias opinion are from ucsf and as you can see, from the sign hanging behind me, he says that the two hospitals are affiliated. The family wants more time to get an independent expert. Right now, a temporary restraining order is forcing Childrens Hospital to keep jahi on life support. Doctors declared her brain dead. Shes been on a ventilator for 11 days. She suffered a heart attack after having her tonsils removed. Over the weekend, attorneys force the hospital and her family were supposed to agree on an outside medical expert to provide their independent opinion on whether shes brain dead but her family says they received word late last night that the handful of positions that Childrens Hospital have selected have withdrawn because theres a conflict of interest since they practice at ucsf. The hearing takes place regarding what will happen next. Im hoping in court today that the judge sees whats going on and is gonna allow a longer restraining order and allow us to investigate and get more search on our our own research that has nothing to do Childrens Hospital. Reporter jahis uncle says they want to spend christmas with her and want more time and are considering moving her to another facility. The family has also asked the Alameda County Attorneys Office to conduct a grand jurys investigate. No response about that request yet. While jalys mother will be jahis mother will be in court, supporters will be here at Childrens Hospital. They will be marching at 10 00 a. M. Happening now San Francisco police and public work crews have just cleared out a homeless camp. This happened just a short time ago at market and drum near the Ferry Building in downtown San Francisco. Ktvu photographer shot some video. This is the new video who just came in a little while ago. New this morning, 13 people have been taken to the hospital after a tour bus crashed in southern california. It hammed on the offramp to the 10 freeway in the Baldwin Park Area which is east of los angeles. The bus which you see there, it was from palm precipitation. It went off the road and into a small drainage canal before hitting a fence. No word on what caused the driver to lose control. Authorities say 38 people were on the bus when it crashed, two people were seriously hurt. The others only had minor injuries. Police in petaluma are sill sitching for a driver suspected of crashing a pedestrians skull with a pipe. It started as a verbal fight when the driver nearly hit a 47 yearold man crossing the street. The driver and passenger are being described as white men in their mid20s. The car was a mid 90s a faded blue pontiac. On friday, a federal judge ruled that utahs ban on same sex marriage is unconstitutional. Based on the Supreme Court ruling that struck down californias proposition 8. More than 100 samesex couples were married on friday in Salt Lake City after that ruling. The state of utah is appealing the judges ruling but legal experts say that ruling will probably stand. Because the decision is based on a United States Supreme Court precedent, i think its very likely that it will be upheld by the 10th circuit and then by the United States Supreme Court. Workers in barts two largest unions are set to vote on a contract. The tentative agreement announced saturday could finally end the lock and bitter labor dispute that ended in two trucks. The deal tropes a controversial clause of granting Union Members up to six weeks of family leave. In return, they agreed for bereavement leave to be extended. Union leaders for a. C. Transit are expected to vote. They reached a tentative agreement after agreeing to a new bay and pen fit new pay and benefit package. The two brief ones were voted down. The city of San Francisco will officially submit a letter to team oracle offering to host the americas cup yacht case.
