In berkeley and emeryville not too bad as you get to the bay bridge toll plaza. We can see the toll plaza better after the sun went up. Its backed up for a 20 to 205 minute delay. This is the peak time for the morning commute at the bay bridge toll plaza, and you will see traffic that is going to be slow. We can also look at 880 southbound driving from hayward to freemont. Its beginning to fill in. 580 is not an issue in livermore. When we go to san jose we can push in 101, 280 and 58 are beginning to get a little bit more slow traffic as you get through. 280 in san jose, ill show it to you now here. Northbound 280 getting up to highway 17 is very slow right through downtown. You see how that is . So its already beginning to fill in here on the way of the west valley. 7 02. Back to the desk. That was relatively calm compared to what happened overnight. At one point it looked like some on the house floor might come to blows. Democrats staged a sitin trying to block the work in the house to force votes on new gun control laws. We are calling on the leadership of the house to bring common sense gun control legislation to the house floor. Give us a vote let us vote we came here to do our job. We came here to work. This time democrats relied on mobile phones and social media stream to go keep going. Republicans would not budge, arguing that democratic proposal to deny gun sales to those on the federal nofly list would violate the constitution. We are not taking away citizens due process rights, their Constitutional Rights. That was defeated in the senate. This is not a way to try to bridge up legislation. Its back in the news because a ned judge will hear arguments about whether evidence should be thrown out. The lawyer for the suspect, matthew muller, says muller was arrested just because he left his cell phone behind after breaking into a home last year in dublin. The lawyer says police illegally searched that phone to find out who owned it. Prosecutors object. They say a burglar cant expect privacy for an item left behind. Investigators say after unlocking that phone they were able to connect muller with the kidnapping of Denise Huskins a few months earlier. Vallejo police mistakenly labeled that case a hoax. Investigators later admitted the kidnapping occurred. We are following developing news from San Francisco where two bicycleises were killed in separate hitandrun crashes. The first happened 6 00 last night in Golden Gate Park. The second incident occurred about 8 30 in the south of market area. In the first crash, witnesses told police the driver in a white honda fit was speeding and driving erratically. Now, they say he slammed into a woman on a bike coming from the opposite direction and then the car took off and the driver abandoned the carlos than a mile a carlos than a car less than a mile away. Bikers are on high alert. I live in the area. Yesterday they had blocked off the area. It was yellow taped because i think it was a homicide. A hitandrun. Reporter when you hear about that as a cyclist, you hear that this person hit this woman and took off, its got to be scary. Whats it like sharing the roads here in San Francisco . Its pretty scary. It makes me sad to hear that, that she potentially died. And it is scary. Now, while investigators were at the Golden Gate Park hitandrun scene, the call went out about another car hitting a cyclist. It happened near 7th street and howard. In that incident, witnesses told police the driver ran a red light and hit a man on his bike. That cyclist was also killed. The driver took off, but was later arrested. Also happening today a meeting is set in las vegas to finetune a publicprivate financing plan for a new stadium where the raiders could potentially play. Raiders owner mark davis met with the Southern NevadaTourism Committee a couple of months ago and pledged 500 million towards the construction of a new stadium. Its estimated to cost 1. 4 billion. Under the plan to be considered by the Smith Committee today, the financing would come from hotel taxes and redirecting sales and payroll tax revenue. The family is calling on Governor Brown to step in to make sure that someone is held accountable for this senseless killing. The deadly shooting happened just last week here at this spot where we are this morning. This is franklin right at 13th street in downtown oakland. Can you see there is a huge memorial that has been set up here for 16yearold regginae jefferies. A short time ago one of her cousins stopped by and talked about the pain the family is still going through as they prepare to bury this young woman who had such a promising future. Its really sad. I just cant believe it. She will be missed a lot. She will. Reporter regginae was hit by gunfire while attending a vigil for two of her friends who drowned last month. No arrests have been made in connection with this shooting. To make sure her killing doesnt go unsolved, her great aunt wrote a moving letter to governor jerry brown. She asked the governor to push current mayor libby schaaf to address ongoing gun violence here in the city of oakland. Regginae had a bright future. She is cheerleading coach of the crusaders in san leandro. She is associated with girls, inc. Bright girl on her way to college gunned down in the street. Reporter regginaes great aunt also suggested in that letter that cases like this one may fall by the wayside as the Oakland Police department is dealing with an ongoing sex scandal involving officers. Now, the Department Denies that would be the case. They say their attention remains public safety. Their focus remains public safety. The Mayors Office said the city and the department are focused on identifying and arresting whoever killed regginae. By the way, regginaes great aunt says she did get a response after emailing that letter to the governor. She says, however, it was a form letter that referred her to the police department. She was quite upset with that response. The funeral for regginae jefferies gets underway at 11 00 this morning, dave, at ax Gospel Church in oakland. 7 15. Meantime, east bay congressman barbara lee taking part in the sitin at the u. S. Capitol, says, as you see here, she has a photo of regginae jefferies with her. The congresswoman tweeted out, she is staying on the house of representatives floor on behalf of that 16yearold shooting victim this morning bart directors will hear how their bike program is doing. Bart says more people are using bikes to get to Transit Service and it says bike rider use is growing much faster than the goals it set just four years ago. The manager of the program is expected to discuss details at this mornings bart Board Meeting. He is likely to suggest new goals for the Program Based on the current success. Also at the Board Meeting talks are scheduled today on how to keep passengers from hogging seats on the train. The new policy applies during busy commute hours from 6 to 10 00 a. M. And then 3 to 7 30 p. M. On weekdays. People who take up more than one seat during those hours will first get a warning. After that its a 100 ticket. Then it goes up to 200 for a second offense. We do have an interesting phenomenon, the directors, we noticed that traffic slows to the lafayette bart station. That is because, especially in the summer months, there are people to look at on the platform. People like to look at other people. After that it clears up a little bit until the next bart station in lorinda. Correlation . Maybe not causation, but there is a strong correlation there. Lets take a look at the bay bridge toll plaza now. You can see traffic is backed up all the way out to about the 20minute delay at the macarthur maze. No problems on the upper deck of the bay bridge. The prosecutor is now making a proposal he says could prevent another controversial sentence in the future. Santa clara County District attorney jeff rosen is pushing for tougher mandatory sentences in Sexual Assault cases. He says one of the things the judge had to consider in the turner case was whether the victim was conscious or not. Rosen wants to change state law to make the penalty for sexually assaulting a woman the same no matter what the victims condition is. Convicted rapists, whether they committed their crimes on campus or off campus, whatever racial or ethnic background, rich or poor must be sentenced to prison. Rape is rape. If lawmakers approve his plan, it would require the attacker to spend time in prison, not just probation. Now, turner was sentenced to six months in jail and is likely to be released after just three months. Rosen supports a minimum sentence of three years in prison. Time now 7 24.
