I mentioned the concert because rumor willis is playing in San Francisco. She is also going to be in studio with us. I see attorney michael car doze a. He is going to joining us to talk about the California Police officer bill of rights. A lot of debate over that. First, in the south bay this morning. The District Attorney in Santa Clara County is holding a news conference. He is announcing new proposed legislation regarding victims of Sexual Assault. He says the legislation was inspired by the woman who was Sexual Assaulted at Stanford University by brock turner. Ktvus janine de la vega has the story from palo alto. Reporter the brock turner case was prosecuted here in palo alto, and now the District Attorney and the prosecutor who tried the case, they are returning back here to the county courthouse this morning. They want justice for the victims. D. A. Jeff rosen is going to be talking about new legislation he is cosponsoring that was inspired by the woman who was specially assaulted by turner. We dont have the details on what type of change he is asking for, but its clear he heard the outcry from the public on this case. It attracted National Attention when the judge sentenced turner to six months in jail for Sexual Assaulting an unconscious intoxicated woman on the Stanford University campus. Prosecutors had asked for a much longer sentence. Since the judges ruling, petitions have circulated to recall the judge. Last week the d. A. Removed the judge from an unrelated Sexual Assault case in light of all the controversy he was facing. Right now in sacramento there is already a push for change. Lawmakers listened to emotional testimony in support of a bill that would remove the statute of limitations on rape and Sexual Assault cases. Currently, the limit is ten years. That bill comes in the wake of allegations against bill cosby. Now, we know that d. A. Jeff rosen is disappointed with the sentence that turner got. He has said that the punishment does not fit the crime. So it really should be interesting to see what this new legislation is all about. That announcement is going to be happening at 10 this morning. Reporting from palo alto, janine de la vega, ktvu fox 2 news. Also today the San FranciscoPolice Commission is expected to vote on the use of force rules for the Police Department. Its a response to public calls for reform after several deadly Police Officer involved shootings. The new rules focus on requiring officers to deescalate situations and make lethal force a last resort. Todays vote does not address the issue of whether to equip San Francisco officers with tasers. That will come in a separate vote. People are protesting the Police Department. Activists are calling for reforming that Police Officers bill of rights. The bill of rights was designed to limit criminals from accessing Police Officers personal information. Under state law, Police Officers personnel records are confidential and that includes their discipline records. The antipolice terror group says if allegations against the officers are true, this law could allow them to escape punishment and move on to other cities. It prevention us, a, from knowing who the predators are on our streets. Also they can leave the Police Department and go into another Vulnerable Community and that community would not know of the horrors they have left behind them. The activists say they want oakland city officials to have an outside agency investigate allegations officers sex trafficked a teenage girl. They also want the city council to establish a Community Review board with the power to oversee and discipline Police Officers. The oakland mayor says it is the reason she cannot release any more information into the corruption or sex scandals that are going on. So right now a judge is the only one who can order the release of police files. In february of this year state senator mark leno authored a bill that would allow greater access to Police Officers records. He says failing to disclose such Important Information can fuel mistrust within our communities and threaten public safety. In may, that bill died when it did not make it out of the Senate Appropriations community. They say it failed because is did not include input from Police Officers. The Peace Officers Association says Greater Transparency would endanger officers making them targets for people seeking revenge and would generate mistrust of officers. Joining us is legal analyst Michael Cardoza to talk more about this. Does the tax paying public deserve to know these files . We do to a certain degree. We should know. But what the Police Department talks about is exactly right. We cant put an all out there. There is enough of a segment in the public that would go after these Police Officers. A bill should be passed to tweak their bill of rights, that we get more rights about the information it seems like we dont need to know where they live and reside and all those things. But discipline records and things like that, it seems to make since, we should know the history of these officers if they have gotten in trouble before, right . The violent type history or the smaller things. Thats where they get into fights. How much information do we give out . Keep in mind that information is given out. If there is a criminal case, they can do the defense does it by way of motion. They have listes in some departments where the Police Departments have to give information up in criminal cases. But what were really talking about here is civil. You know, how do we get it out there so the public knows . So these officers dont go from one department to another. Lets talk about the chief. For example, in oakland. Okay. Why wouldnt the mayor ask the Police Officer thats applying for the job or being asked to take the job, let me see your personnel file. You have control over it. You can sign it off. Let me see it. And if you refuse to give it to me, i say then i dont want you because there is opposition from police groups, as you mentioned. Yes. Most Police Officers, i like to think, are decent law abiding citizens. Why wouldnt they want this to be out about officers that are perhaps bad apples . The bad apples arent going to sign off on this. We should know certain things. The laws that they are bringing to the legislature, very political. And the Police Officers association have a lot of pull. If you vote for that, mike, we are not going to support you next time. So you have that political issue. Then you have to write a bill that both sides are happy with. You saw in the introduction that the police are saying, we dont have enough say in this. Give us some say. Give us our voice in this. Lets talk about it. The Governor Brown signed this in 1978ish and he was saying this protects Police Officers and certainly we want to give them a level of protection. Where is the protection they need . Where is the danger in the terms of the type of information getting out . You have to protect Police Officers safety. They say we are no different than anybody in the public. You dont get to get into our files. Somebody could walk in off the street and take a look at my file. No. That shouldnt happen any more than somebody walking into ktvu and say let me peek at mikes file. What the legislatures have to do is wordsmith a law that is acceptable both to the police and to the public. But one thing that i know, San Francisco has a Police Commission. Oakland doesnt. I think its time oakland gets a Police Commission and they can get involved with this type of situation so they can handle getting rid of the bad apple Police Officers. You have seen a lot of this over the years. What do you think about the situation in oakland in general . How can this be fixed . I think we need a Police Commission in oakland. Thats number one. Then you have to vet the people that are applying to be chief, and that means let me see your personnel file. Let me get into your background. The mayor of oakland had a problem because she had to move somebody in rather quickly. Once you move them in quickly, then speed up the search for a real chief, this revolving interim chief doesnt make her look good. Doesnt give the Police Officers a sense of security in the department. So get somebody there. If they are not quite the proper fit, you cant once you crack open that door, the concern is, okay, you get some of my personnel files, but then whats next . And then what follows after that . Isnt the same thing as an nra argument . If you take my automatic weapon, you are gonna take the next one. No. I think we have to be bold about it. We have to have legislation that is acceptable to both, or, as i say, strong Police Commissions. How that have access, that give them access and say, youre a bad apple. Youre gone. How far away are we. I imagine the one that with will go through will be one that the police says doesnt give them enough protection and the public doesnt think gives them enough information. How far are we away from getting something that is maybe more workable a middle ground . Yeah. That will be up to the legislators. When i walk out of mediations, mediators often tell us this side is not happy. That side is not happy. I must have done a great job. You have to get something middle of the road that protects the Police Officers. Keep in mind they are held to higher moral standard than the rest of us because they represent us in the street. They should be held to a higher standard. And therefore honesty they do. They protect us. We do have a protect them. An officer shows you where there is ad crowd and people, oh, thats officer smith. Here we go. Thats why we have to protect them and be judicious in how we write this law. But do things need to be changed . Absolutely they need to be change the. We have to leave it there.
