Im cheap and thats not worth it. We have a busy newscast. Last week on the 9 we brought you the verdict in the murder trial of garciatorres. After ten years of deliberation over a couple of days, the jury found Garcia Torres guilty of kidnapping and first degree murder in the death of sierra lamar. Right now the same jury is hearing arguments in the first day of the penalty phase of the trial. They will decide whether to sentence him to death or life in prison without parole. Allie rasmus is live with more on what both sides will present. Reporter the testimony is expected to be emotional with the jurors hearing directly from some of sierra lamars friends and family members. Prosecutors have asked to show the jury a Video Montage of sierra lamar in her childhood, teenage years set to music. The same men and women on the jury that convicted Garcia Torres of kidnapping and murdering sierra lamar will now decide his fate in the penalty phase of the trial. One of sierra lamars friends will take the stand to make the case that garciatorres should be given death. I support the fact that if he gets pushed to that point, it will make him talk. Reporter sierra lamars body has never been found. According to court filings, they would like to conduct a psychological profile of Garcia Torres and use that in the penalty phase. It is expected to be an emotional week of testimony with as many as 12 people testifying on behalf of the prosecution. In his defense, garciatorres attorneys are expected to argue that he should receive life in prison. They would also like to show a Video Montage of garciatorres family life and submit their own psychological evaluation. He suffered a troubled childhood with abuse and incest in the home. Garciatorres suffered the negative psychological effects of pesticide exposure. The judge has not ruled which of these doctors or experts or psychologists will be allowed to testify in this case. But the whole process is supposed to last about two weeks in this penalty phase of the trial. In san jose, allie rasmus, ktvu fox 2 news. And allie right now is inside of the courtroom as the penalty phase of the trial begins. She will have a live report in the noon broadcast. If garciatorres is sentenced to death, he will join more than 700 prisoners on death pro. The first execution in california was in january of 2006. Just last year californians voted on proposition 62 which would have replaced the Death Penalty with a strict life sentence. It failed with only 46 of people supporting it. Our question of the day is, do you support the Death Penalty, yes or no . Lets take a look at the results. 59 say yes you do. 4 1 say no. The Death Penalty is an easy way out. They should spend the rest of their life thinking about what they did. Michael says it is a waste of time as with the multiple appeals. Most death row inmates die from other inmates or Natural Causes before they are executed. If he or she has viciously taken someones life, then of course i do. Why should they be allowed to live . Were going to see a lot of imagery and testimony in the days to come. Can the defense argue about the length of this, about how much imagery there can be or do they not have a say here. Because a life is at stake, the judge is liberal with letting the defense do what they want. I dont want to cut them back or curtail them from putting some evidence on. Then they will appeal and then it might get reversed and were coming back. So theyre going to err on the side of caution and pretty much let the defense have their day in court. Because california does not execute people for all intents and purposes, is that going to hurt the familys chance of finding out where sierra is . Because he might say, fine, give me the Death Penalty. Ill just diane old man. Well, youre probably right. Scott peterson is a classic example. Still on death row. Were looking at 20, 25 years out. But the state is looking to speed it up. So do you want to take that clans and be cavalier about it and say give me the Death Penalty and then we and and then you say, whoa, wait a minute a minute. Youre seriously. Im sure that garciatorres is taking it seriously. Here in oakland about ten years ago, he said he was not guilty killing his wife. When it came to the penalty phase, he offered to show where the body was buried in exchange for a lighter sentence. Do you expect trading to happen in this case like that. They may do that in this case. Wait to see if the jury brings back the Death Penalty. I have to tell you, number one, it will be up to the family. It will be up to sierra lamars family to decide. Thats what the d. A. Will say. What do you want . I have to tell you. I have thought about this. God forbid it happens to any of our children, but if you come to me after youre convicted and say to me as a father, all right, i admit i did it. Ill tell you where your son or daughter is. Im thinking, wait a minute, now youre going to admit it to me . I know you did it because the jury brought back that verdict. Do i really want to know where you buried my child and how you killed them . Im not sure i want that information. So i would probably err on the other side. If i were in favor of the Death Penalty. Dont need to know. Keep it to yourself. Let him be given death. This is not about guilty or not guilty. There is a ton of emotion from here on out. In the guilt phase, michael. Im asking. No. In the guilt phase, the judge instructs the jury, you cannot consider emotion. You cannot consider sympathy. You cannot consider passion. You have to look at the facts and decide guilty or not guilty in this case. In the penalty phase, its all about emotion. Do we hear from Garcia Torres himself . Thats going to be interesting. I doubt it. Because if they put him on and the District Attorney gets at him, it will be did you kill her . Where is the body . And how did you do it . So why would you put him up . Mcmaster addressed the issue at a White House Briefing that wrapped up minutes ago. The premise of that article is false. In any way the president had a conversation that was inappropriate or resulted in any kind of lapse in National Security. And so i think the real issue and i think what i would like to see debated more is our National Security has been put at risk for those violating confidentiality. Mcmaster says the discussion between President Trump and the Russian Foreign minister was wholly appropriate and it was based on open source reporting. However a senior european official tells the press that his con free may stop sharing information with the United States if they learn that classified information was shared with moscow. Brian sobel joins us right now. Right off of the bat, your reaction to the president tweeting this morning and mcmaster responding. Well, i think the information that was disseminated is of interest. But i think theres there is a bigger story here. And the story is why and how this information is getting out of out of meetings like this. Because at the end of the day, the president , whoever the president is, can share data that he thinks is important for in this case world security. So theres Something Else afoot here that is troubling. Do you think that someone inside of his administration is trying to, i guess sabotage what is going on here . It has to be somebody inside. Only a certain number of people in the meeting. Who could know what was said in there unless its an insider. Thats right. The only other people in the room were russians. So you just dont know who said what to whom. But its this is troubling. Because if information of whatever strike is working its way out into the media and and into where our enemies can pick up on it, that is really, really troubling, sal. Is there it is not illegal. But there are concerns this may be a breach espionage etiquette and jeopardize the information that the United States gets or doesnt get. Well, thats an open question, gasia. And that is whether a source provided by a third party, another country, was somehow not revealed directly but by they say connecting the dots could be gleaned or discerned, that would be troubling. But mcmaster said that wasnt the case. Now to question who do you believe. And it further erodes trust in the government and you kind of wonder who keeps doing this. What do you think, brian, that the Senate Majority leader, paul ryan, are in this . Are they talking with the president . Are they concerned about, you know, what has taken place here over the last 24 hours or is he not listening to them. No. No. Im sure there are conversations between the speaker and leading members of congress, the senate in particular. I saw mccains statement as well. He was concerned about it. But there is also concern that just generally were not being tough enough on the russians right now. That is an undercurrent here. In past years, whether we talked to the russians or not may not have been such a big concern. Now we know the russians are actively involved in many, many campaigns, literally and figuratively. One of the first people on the scene was a 14yearold Police Explorer, jose. I sat down with him to hear him tell the story of that tragic story and heard how it inspired him to follow in his footsteps. There is a fight in the business. Saturday, january 7th, 2006, east palo alto. How many people are fighting. The call, a fight at a taco dria. How many people are fight. Just two. Albert alvarez is one of them. A nearby surveillance cam are catches him walking away. Turned left out of the restaurant. East Palo Alto Police officer richard may responds and in the patrol vehicle with may, Police ExplorerMarco Marques. He running from me down weeks. Are you in pursuit. Im following in the car. K9 officer dave carson heard the chatter on the radio and also responded. In the patrol vehicle with carson, another Police Explorer, jose larasco. I remember were driving down do not going towards university. I remember looking at jose. He was quiet. And i looked at him and i said, man, something is not right. Something wasnt right. Radio silence. 12 seconds of radio silence. And then are you there . When did you know something was wrong . When marco got on the radio. Jose was 14 years old. Now he is 26. And telling his story for the first time. When he got on the radio and said man down. Man down. Man down. Man down on weeks. Whats the cross . We arrived. And then we saw officer mays car in the middle of the street. Did you see officer may. Yeah. I i ran up to him. Officer has been shot. Officer has been shot. Hot. 104. Officer has been shot. I saw the head the bullet wound to the head. Yeah. What were you feeling at that at that moment . I was scared. Sad. I had to get marco out of there. And i had to get jose out of there. I didnt want them to see what we were looking at. Dave carson is now a sergeant with the police department. Department. I had to lean on them to help that day. In what way . I was tasking them with things that we would normally do. Drop some tape for me. You know, look for some selfed and make sure that the scene is secure. Carson was telling me to do this and that. So i was just, okay. I did what he asked. Jose was eventually led away from the scene. The gunman tried to escape but was captured nearby. Four years convicted of the killing. Officer may was shot multiple times that day. He was 38 years old. Prior to his watch in east walnut creek, may served the country. He was a ma rehabilitate. I followed his footsteps. I joined the marine corps. Because he was a marine. Then jose became a Police Officer just like richard may in east palo alto. What is the hardest part of the job . What is the hardest . I would say, you know, trying to convince the people that dont want us around, you know, trying to convince them that were not bad people. During one stop, we found ourselves at the corner of university and weeks. Just yards away from where officer may was killed in 2006. There are times that i come through here and just drive by the house. Its a job that i have to do. So i just have to keep moving forward. [bagpipes] two weeks ago on this warm spring day in redwood city, a service to honor officers killed in the line of duty in san mateo county. Richard a may. East Palo Alto Police department. It was jose who placed a flower and saluted a man in blue. A man who inspired him to reach high, to live the dream that he is living today. I just think he would be really proud of how far he has come. Officer mays widow diana may and her daughters drove hours to be here. He is missing. He has missed so much. But even so, she knows he has inspired. And that his hard work and dedication to others lives on in another. It gives me chills hearing that rich inspired him and was that much of an experience on him that he wanted to follow in his footsteps like that. And i didnt realize the impact that he had on jose until just the last few years, i think. He was always kind to people. You know, always talked to them with respect. So thats something that that i do. The moment that you walk over to officer may when he is there on the ground, you know, they talk about moments in lives where you can go this direction or that direction.
