This evening we drove up a narrow winding road near he home. The devastation is haunting. The sheriff tells ktvu there may be two more casualties some where in the path of the fire. We have a team of human remain detection dogs on the ground. Where officers and deputies and Fire Fighting personnel are seeing things indicative of people who may not have made it. Reporter the danger of hot spots is far from over. All its going to take is higher temperatures which were expecting over the weekend to spark those trees up and were going to be back into the races like we were before. Reporter everyone we spoke with had emotionals, grief for that they lost but gratitude that they survived. The fire has burned through more than 73,000 acres and destroyed at least 585 homes. Calfire says hundreds of other structures were also lost. Police county Sheriff Department says three more suspected burglars have been arrested there in the fire zone. 23yearold deami canal and Michael Jimenez and david cesar is from San Francisco. Deputies said they three had trouble explaining where they were going. The deputies found burglary tools and a loaded pistol. California is now offering relief for those impacted by the two wildfires. People in amador, calaveras and lake county are now eligible for a tax break. Now to new evidence in the beating death of an inmate at the main jail. Three Correctional Officers are now facing murder charges. Prosecutors say Text Messages sent by the guards suggests a pattern of violence. Court papers filed at the Santa Clara County courthouse and obtained by ktvu revealed disturbing evidence in the three deputies accused of killing Michael Tyree last night. In it, they include other assaults on other inmates. An inmate stating, all three defendants physically abused him striking his head and twisting his arms. A month prior, a series of texts between jail guards Matthew Ferris and rafael rodriguez. Ferris writes, dont trust those peeps up there. Another text, i love 6a. No camera, no groups. I hope i keep it. 6a is referring to the jail pod. Rodriguez responds, no way i slap p ed a guy yesterday. He said he was cursing at a nurse. He went on to write, i told him i bet your parents never spanked you but i will, haha. When you read the text, you see this is ongoing and methodical. The best thing for this community is to keep them away until the trial is over. Locked up, and under key and under watch so they can do no more harm. Reporter attorneys reporter attorneys for the three deputies are submitting letters. They have an 11 monthold with Health Issues who he needs to take care of. Also in these papers, one of the guards roughed up two inmates and failed to report either of them. One mans fight with city hall and why he says his Small Business has been shut down despite doing everything that was asked of him. A boy with autism and his family in the center of a lawsuit. The legal case that is calling him a public nuisance. Controversy tonight in the south bay where former neighbors of an autistic boy and his family are filing a lawsuit calling the child a public nuisance. As ann ruben reports, the case could set precedent for other families. Reporter neighbors will tell you this sunny vale culde sac has been anything but quiet for the last few years. At the center of it all, this house and the family and their autistic child. At first i thought it was a joke. I thought nobody could possibly sue an autistic child. Reporter it alleges the parents fail to prevent harm to others. Jill esher who runs the Autism Society of the San Francisco bay area is in shock. This could be us. This could happen to any family with an autistic child. Reporter the family at the heart of the suit has moved. Speaking to ktvu by phone they say this lawsuit has taken a heavy toll on them and theyre doing the best they can within the legal system. They say their focus is on their son and that they hope this case building awareness about this issue. The fact that this case has made it this far and this much in legal fees have been expended in all likelihood i think sets a dangerous precedent. Reporter meanwhile on arlington court, neighbors say the lawsuit has been hard on everyone. Its a difficult thing. But the bottom line is Everyone Needs to be safe. Reporter the lawsuit alleges the autistic child was not only a public nuisance but had a negative impact on property values. The Autism Society is trying to make other families aware of whats going on in hopes they will show their outrage at the courthouse. This could be any one of thousands of autistic children in our community. And all those parents have a right to know what could affect them. Now to southern Santa Clara County where police in gilroy are looking for a person who vandalized books at the library. They say the man in this surveillance pictures tore up around 20 books. The damage is estimated at 1,300. Anyone who knows this man should give police a call. Hundreds of small explosions at 10 35, tonights key vote on a plan to impload part of the bay bridge. And one mans attempt to open a gun shop misfires. A Small Business owner is considering filing a lawsuit against daly city saying he and his business are being singled out. Christina rendon tells us the former Police Officer was shot down if you will when he tried to open a store that will repair and sell guns. Reporter for months, sutter has been repairing this shop.
