Starting next month, judge aaron persky will no longer hear criminal cases at this courthouse. Its the same courthouse he sentenced former stanford swimmer brock turner to six months in jail back in june after turner was convicted for sexually assaulting an intoxicated woman. A ruling sparking a national firestorm. Instead it at judge perskys request he will be reassigned to civil cases at the old courthouse in san jose which we believe that judge persky does not understand the harm and the severity of sexual assault. That was clearly on display in his sentence for brock turner. Reporter law professor Michelle Dauber is spearheading efforts to remove persky from the bench. She says shes relieved but is moving forward with a recall election given the new assignment is not permanent and judges in Santa Clara County rotate every year. The presiding judge expressed support for him. And stated that he was not doing this under pressure and essentially that he would be welcome back in the Criminal Division at any time. Thats why we have to continue with the recall. Reporter that presiding judge supports persky and his ability to serve in his current role. In a statement he went on to say judge persky believes the change will aid the public and the court by reducing the distractions that threaten to interfere with his ability to effectively discharge the duties of his current criminal assignment. This comes as persky disqualified himself last week from making his first decision in a sex case since the brock turner matter citing he and his family were exposed to publicity surrounding the new case creating a personal family situation. His new assignment is effective september 6. Just four days after brock turner is set to be released from jail on september 2nd. The recall Campaign Already organizing a rally outside the hall of justice on that day september 2nd. At any time he could go back to doing criminal trials . Because this is not a permanent move . The man accused of kidnapping and killing 15year old sierra lamar will not have his murder trial moved out of Santa Clara County. Agent made that ruling today denying a change of venue motion from attorneys representing Antolin Garcia torres. The defense had argued widespread Media Attention made it unlikely that garciatorres could get a fair trial in Santa Clara County but the judge disagreed. Sierra lamars body has never been found. She disappeared from morgan hill back in 2012. Jury selection is set to begin next month. Police in Mountain View have arrested a man for recording a woman at and a toddler. 34yearold Jose Ballesteros was arrested by the Mountain ViewPolice Cyber Crimes unit. The victim called police after receiving threats online. Which included private photos of her and a toddler in the bathroom of a home on middlefield road. Detectives found a camera underneath the bathroom sink and a cable leading to an adjacent bathroom which was rented by the suspect. Reporter officer zachary holler is all smiles now but wednesday evening it was a different story. As soon as i left the department i could see the smoke billowing. Reporter around 7 30 wednesday night, they got a call of a house fire on west 11th in pittsburgh. Once on the scene officers were told there was a blind man in his 60s inside the home. At first officers tried kicking in the door. They cant get to the front door. They smashed the window out. So the officer sustained an injury. He didnt care. That he was bleeding. He just wanted to get inside. Reporter the injured officer didnt make it in but hallard it. Took turns trying to kick the door down. He battled flames and smoke to get the unconscious man on the ground. Palm up, fingers relaxed, and so i told everyone else to the hand was going in. Crawl underneath the smoke and grabbed him. Reporter a First Responders performed cpr before taking the man to the hospital. At the same time, the injured officer was also transported. He kept going. I told him you need to attend to yourself. Will get the job done. Reporter the injured officer has a significant cut to his arm. That may have caused artery and nerve damage. He underwent several hours of surgery for his injuries.
