Reporter pancholy is offering compassion to the perpetrator, as she went back hiking today, not letting fear set in. It can happen to anyone. There is ignorance out there, and i think its very important to be vigilant. More vigilant now, especially in the heated climate. Reporter police do not have many leads, mainly because this parking lot does not have cameras. Anyone with information is asked to contact the east bay Regional Park district. Do police say this type of crime is unusual. Reporter it is highly unusual. In fact, to give you some perspective, they tell me of all the parks in the East Bay Park district, there has only been one reported hate crime, and that was last year. More than i can ever express, but as i said last week, our campaign was never about one person, or even one election. They tell me they dont have much leverage, but theyre hoping for public support. The workers job is to move vehicles around on the lot. Had theyre called had shuttlers. One man told me he has driven for hertz for 20 years. Scared, suddenly, you lose 1 3 of your income. Reporter he also drives taxi on the weekends, and his wife has a seasonal job. I get angry, we dont do anything, nothing wrong. Reporter teresa asked us not to show had her face, for fear of losing her other job. The workers tell me most of the 156 people laid off have limited english skills. Earlier this month, the workers walked off their job and held a rally at San Franciscos city hall to protest the layoffs. They received support from the chinese progressive association, which helps immigrant workers, the nonprofit, the board of supervisors, and teamsters. They have not gotten Company Officials to talk. We have called for a boycott of hertz at this time. Reporter in the layoff notice, hertz did not give reason for the layoff. Only to say that its due to a change in business operations. The layoffs are permanent, and that future hiring decisions will be made exclusively by a vender. Sad, and then i just want to let hertz know, the management on the table. But they dont. Reporter the workers and the supporters plan to hold a protest and rally at sfo november 29 as part of the national day of action. Up next, homeowners who say they were ripped off. A 2 investigates follow up. We found out why it took a year for people to get the windows they paid thousands of dollars for. Im trying to make things right and make the public aware of whats going on. Months after 2 investigates broke this window story, customer after customer didnt get the special Energy Saving windows they had paid thousands of dollars for. Tonight, 2 investigates investigates again. The problems didnt stop there. In fact, they didnt stop for months. What do you say to these people had that you bounced checks on. Bounced checks and broken glass. Some of the problems the homeowners have dealt with. They didnt get the windows they paid for. Ross polumbo first uncovered the problem. Reporter these people paid for Energy Efficient glass, and did not get it, now we discovered even after the company said they would fix this, that wasnt the end of it, but only the beginning of another problem. Are you trying to rip these people off . Reporter 6 months since the slamming doors. These customers spent a lot of money. They did. Reporter stunning allegations, and surprised homeowners. Now there are new dodges. I dont, you know. No hes not here. Reporter new dramatic delays. I cant even tell you how exhausted i am. Reporter and new disappointments. Its going to be a year. Reporter for more than a dozen people, it began with a bid it to replace their home windows, with something more Energy Efficient. It was a priority. A lot of sunshine. I wanted to be able to filter out the heat. Reporter and all of them knew exactly what they wanted. Did you ask for it . You asked for e3. So you specifically asked for e3 windows. So you knew you wanted e3 windows. Correct. Reporter making it more Energy Efficient, and more expensive. A lot of customers would request e3. Reporter they made those requests to this man, mark torrez, who charged thousands of dollars, and who signed on the bottom line as company representative. He was so great, and told me, yeah, you want the e3s, this is definitely what you want. I said good, ive got to make sure im getting the right thing. She asked for e3, did she get it no. No. Reporter this now fired employee claims neither his company animar, nor the contractor, clear vision delivered or installed the correct windows. We also tested 13 homes with this glass reading device, and found discrepancies in 12 of them. From san mateo, to fremont, to redwood city, to here in livermore. On both of these houses, every single window is not what they paid for. Thats right. I think its a violation of the owners, you know, trust. Reporter after our initial investigation, customers took those allegations to the company itself. The company then agreed to take action. Did they tell you that you had the wrong windows . Yes, yeah. What did they say they would do . They would replace them. Reporter for many, getting them replaced was another problem all together. I dont really feel comfortable. Reporter this customer says installers came out three times, sometimes with short, or mismeasured windows. They put this one in. Well, this ones short. Reporter they finally got it right at the end of october. Almost exactly a year from the original order from november of 2014. This customer is just now getting the work on kitchen windows that she said had to be replaced twice. That again were ordered nearly a year ago. And this customer says it took installers eight times times to get it it right. Bringing the wrong windows, over and over again. All also on an order from last year. I feel like this saga just continues and continues, and theres never going to be an end in sight. Reporter 2 investigates tried to get an answer from the owner, and only found a few answers from his employees. The wrong windows, the wrong measurements. Reporter afterwards though, bautista first agreed to, and then canceled an on camera interview. But did finally speak with us by phone. How is it possible that these homeowners got the wrong windows and didnt get the windows they paid for . Reporter after first blaming whistleblower mark torrez, bautista did take responsibility. At the end of the day, were responsible, because we hired mark. And for that, we went to go change everything, and made everything right. Reporter and responsible for delay after delay. Its been almost exactly a year to get these problems corrected. Yes. Does that seem outrageous to you . Yes, it does. And thats the reason why we reimbursed those people. Reporter in five cases, they tried to send customers rebates, ranging from 75, to 800. But customers claimed three of those checks bounced. This Police Report said its checkbook had been stolen, even though no checkbook is listed here. What do you have to say to these people that you bounced checks on . It was out of my control. Im sorry. Wow. Reporter even those who got paid, could have another problem. Why is that . Because theyve installed windows that do not meet the building code. Reporter in at least three cases, what customers got does not meet local building requirements. So getting money back doesnt matter, still illegal. Wow. And the homeowners are now at risk. Right. Isnt it your job to check . Yes. Then why didnt you check . I need to check and see if thats accurate. Reporter after checking, he insists the windows in those cases are legal, and do meet building requirements. 2 investigates also rechecked several of the replaced windows, and the glass is now correct. So the right glass. And this is what you should have gotten in the first place. So Job Well Done . Job done. I dont know about well done. Reporter after all the cloudy details and controversy. No, i completely understand about that too. Were trying. Reporter the glass may finally now be correct. It is incomprehensible. Reporter but the view from these windows has forever changed. If everybody did business this way, nothing would had happen and the economy would collapse. Reporter well finally tonight the company says all of these cases have now been resolved. They say those bounced checks have been rewritten. Some people got money, some people got new windows, and some people got both. And now because of our investigation, the company says its put new safeguards in place. They are inspecting every new window before it goes out, or are only using low e windows in the bay area, and are putting every salesperson they hire through an extreme background check. They say they are trying to make things right at this point going forward. We will keep an eye on them, and make sure they do. Still so many people thinking theyre getting one thing, and getting another. If you have an idea for 2 selects, wed sure like to hear from you. You can email 2 investigates ktvu.
