Prosecutors say they plan to retry Comedian Bill Cosby, that is after a judge declared a mistrial yesterday. The jury told the judge they were hopelessly dead locked after deliberating for more than 52 hours. Eyewitness News Reporter cleve bryan hosecution and the reporter for sixth morning 79 yearold actor and Comedian Bill Cosby enteredouhouse waiting for a jury to decide his fate. The questions and code locked deliberations up until now things happened fast. By 10 30 they announced they could not reach a unanimous verdict so judge Stephen Oneill declared a mistrial. Cheers for cosby as his legal team declared a outcome. Justice is live and lives in Montgomery County. Im proud to be able to represent mr. Cosby. We came here looking for an acquittal but like that Rolling Stones says, you dont always get what you want, sometimes you get what you need. Reporter cosbys spokesmen raised his fist in victory. Mr. Cosbys back. Reporter for his part cosby kept quiet. Leaving court, he only pause todd wave to his supporters. Prosecutors said that the legal bolt is far from over, and immediately declaring their intentions for a retrial well val wait, and review our case, and we will take a hard look at everything involved and then we will re try it. Reporter District Attorney kevin steel says his team will be ready to meet judges direction of retrial Sexual Assault case within four months and he has little doubt alleged victim Andrea Constand will testify against cosby again. Shes entitled to a verdict in this case. The citizens of Montgomery County where this crime occurred are entitled, to a verdict in this case and we will push forward to try and get that done. Reporter we dont know break down how many jurors thought cosby was guilty or not. District attorney steel says this is his first mistrial in more than 25 years but he said last time he won the retrial. In norristown im cleve bryan, cbs3 Eyewitness News. And speaking of those jurors. The jury of seven men, five women left the Double Tree Hotel in plymouth meet being soon after the mistrial was declared. They had been sequestered since beginning of the trial, jurors are from Allegheny County that is almost five hours away from Montgomery County. Bill cosbys wife, camille spoke out after the ruling, she praised her husbands legal team, she also had tough word for Montgomery County District Attorney and judge Stephen Oneill. She accused them of quote arrogantly collaborating, familys Statement Read in part quote im grateful to any of the jurors who tenaciously for the to review evidence which is rightful way to make a sound decision, ultimately, that is a manifestation of justice based on facts, not lies. Representatives for Andrea Constand, bill cosbys accuser has also release aid statement with the trial. They thanked the District Attorneys office and members of the prosecutions team, their statement says in part that we are confident that these proceedings gave a voice to the many victims who felt power less and silenced. We also wish to thank the jury for their tireless efforts and acknowledged their sacrifice. Since the District Attorney says he plans to re try the case, there is now speculation about whether or not we can expect a different outcome next time around. Linda dale hoffa an attorney with the Philadelphia Law Firm Dilworth Paxson gives us her insight. I think the fact that the jury deliberated probably more hours then it took to try the case, it is a good indication that there were problems here. The jury was deliberating not just, you know, seven or eight hours a day but they were putting in very long days and nights because it was a sequestered jury. Usually prosecutors know what the break down in the vote was , from the jurors. With the judges permission they can get talk to the jurors and they would find out what the vote is and that is something that is usually taken into consideration. I dont know whether or not the prosecutor in this case does know what the break down is. Certainly that is not a Public Record to us. We dont know it. The decision was made immediately that there was going to be a retrial. As i understand it under pennsylvania law that means trial has to take place in the next 120 days. Stay with Eyewitness News for continuing coverage, of the aftermath, of the mistrial , and next steps in the bill cosby case. When were not on air find our coverage on line at cbs philly. And back here at home now, and turning to weather we have our eyes on some Severe Weather just not today, right, matt. That will be coming as we get into monday, a cold front will come through giving us a chance to strong to severe thunderstorms, for today, fathers day we are celebrating dad across the country, hot and humid here, in the Delaware Valley. Temperature averages, for this time of the year we are looking at a High Temperature of 90. We should be right around 84 degrees. We are above average today, we could be feeling, like we are in the mid 90s with that humidity. July and august we should be around 87, 85 so we are closer to what we should be expecting through middle of july then what we should be having in june and august. Look, again we are looking at that mid 80s range. Above average across the board but it is closer to climate, if we get, move into july. And storm scan three, shows an area of low pressure spiraling across the great lakes, cold front draped down to the south and thinks our system. That is slowly tracking east, and drag up gulf moisture and then it is feeding these showers and thunderstorms as we move across the ohio river valley back through the appalachian an and in the philly region. They are spawning a severe thunderstorm watch. This cold front is potent even here at this time we will get a little bit on the weaker side because is there not a ton of moisture in the nation s midsection, obviously but it is still pulling in that moisture from the gulf of mexico and it will be moving in the region as we get into monday. Future weather not a whole lot , maybe some breaks of sunshine actually which would be nice for our sunday, and a few spotty showers thrown in the mix. Kind of like last couple of days, not a wash out of an afternoon but spotty showers, isolated rumble of thunder, not too much, of a factor for us today, we cannot rule out a rumble of thunder but generally it will be a stray shower, for us with maybe, some sunshine, thrown into the mix. As we get into monday, on the morning time frame here were looking clear through 95 corridor on monday morning. That does mean we will probably be looking at a quiet commute to work tomorrow. That is good news for us, later in the afternoon by one or 2 00 we are starting to see that front entering in the poconos and Lehigh Valley getting in on that shower and thunderstorm activity at one or 2 00 in the afternoon. Once we get three or four or 5 00 oclock that is where we will see, and here it in in philadelphia. Our drive home could be on the messy side if we take i95, schuylkill, do be prepared for showers and thunderstorms on your drive home. Good news about this front, very quick moving. Moves in the philadelphia area , by about three or 4 00 oclock it is out of the philadelphia region. Probably by six or 7 00 oclock in the absolute latest, a few residual showers and thunderstorms in south jersey as we get into tomorrow night but by the time we reach tuesday, a few showers in the morning, starting to clear things out, for om have us on tuesday afternoon. Severe threat is enhanced risk for that dark are shaded area including philadelphia, trenton, wilmington, that is where we could see some strong , gusty wind, a small, chance, for maybe hail to develop as well. Our high risk tomorrow though is heavy downpours, some strong wind and of course lightening that hail risk is low but it is still out there and tornadoes not a factor for us at all, that is good news, Flash Flood Watch in effect starting at noon until midnight on tuesday, low lying areas, areas of poor drainage could see some flooding, so be careful, especially never drive through flooded roadways ninety for the high today. We will stay warm before the front comes through 89 on monday, with a thunderstorm around 86, 84, and 86 again, tuesday, wednesday, thursday and another chance fo a jan on thursday as well.
