Well bring you the latest from london, but first, lets turn to legal news in the United States. Right now were awaiting to see what doj is going to do next now that a federal judge has denied his request for access to classified documents to continue its investigation. Legal experts are scratching their heads at the decision. Also in the denial, judge cannon appointed a Special Master. Who he is and the deadline the judge set for him. Joining me now is nbc news justice and intelligence correspondent ken dilanian, also lisa ruben and carol lamb. Walk us through the decision from the judge here. Why did she say no to doj about being able to access those classified documents when they said it was a matter of National Security. This judge who was appointed by former President Trump really adopted the trump view of the case almost in its entirety and basically told the Justice Department that they cant be trusted to in their assertions that something is classified. They cant be trusted to decide which material is relevant for a criminal investigation and which material is privileged. It was a remarkable ruling in that respect. Its one thing to be sceptical about the government. This is the National Security division of the Justice Department and fbi. The experts and Classified Information, telling this judge that National Security is implicated and she said, i dont believe you. In fact, she said, you havent shown me any evidence that these documents fell into the wrong hands while they were at maralago. The doj said thats exactly what we want to investigate. Thats why we need access to these documents. Shes continued to block them from having being able to use these documents in their criminal investigation. She did throw them a slight bone in the sense that she said that they may use these documents, which she already said before, in a National Security damage assessment. The Intelligence Community can look at the contents. She added that the fbi can participate in that. She said theres no reason that cant continue and she said the fbi can ask questions about were the documents moved, who had access to them without speaking to the contents of the documents. But, look, she is steadfast in her view that a Special Master must review all of these documents, all 11,000 seized at maralago in august, and the doj just disagrees and thats why were expecting an appeal to be filed any minute now, katy. Carol, can you think of a parallel circumstance where the judge says to the Justice Department, i dont believe you and im going to let somebody else, a third party, come in and make this decision . Certainly not in this context and these kinds of circumstances. I was thinking about it this morning, i was thinking the only kind of analogy i can come up with is if you were trying to prepare breakfast and you found that you were missing a loaf of bread, so you send a Family Member out to get the loaf of bread and they come back without the loaf of bread, and you say, wheres the loaf of bread and they say, well, there were all of these ingredients listed on the package and how do i know that those are really the ingredients in the loaf of bread . So i sent it out for a lab for a thirdparty analysis. And you say, what about breakfast . What are we going to do . And you say, well, well have to wait 2 1 2 months for the lab results to come back. Thats what disturbs me most about this judges order and ill give her the benefit of the doubt that she thinks shes doing the right think. The problem is, its so impractical. She has laid out a course of investigating the investigators here that is going to take such a long time because there are so many steps that she wants this Special Master to go through in order to establish that the fbi was saying the truth here with respect to things that are not very nuanced. You know, lets say there are 100 documents that are marked classified. This judge could have sat down with 100 documents and taken a look at them herself. It would have taken her less time to do that than it took her to draft that order. The impracticality here is what i think is difficult and troubling and i think thats why the doj is faced with a very pressing decision here whether to go ahead and appeal the judges order. So what might be the reason for them not to appeal this . Is there a drawback for them to do so . I think one consideration they have to you know, they have to look at is, what is the 11th circuit, the Appellate Court here really going to do, what are the parameters of the relief theyre going to ask for. Are they going to say, look, we only asked to be able to use these 100 or 130 documents that were not even asking for a determination that they are actually at this point in time classified. We went in and took what the Search Warrant asked us or allowed us to take which was documents that were marked classified. That was clearly legitimate. We took them. Now let us do your investigation. Thats the limited relief that they can ask for and theyre probably thinking right now, well, the Special Master is a very wellrespected judge and perhaps since judge cannon did say prioritize those documents marked classified, maybe we can just get that done quicker instead of going to the 11th circuit because once they go to the 11th circuit, once they appeal, they are out of the District Court level and so everything will stop with respect to the District Courts order. I think theyre looking at time right now which aspect will go faster. Judge deary is a former he worked in brooklyn. Lets put it that way. Patrick cotter who served as a federal prosecutor in brooklyn said he was surprised by the trump teams decision to include him in their two choices for Special Master. He spoke to the Washington Post and he said the judge wasnt much of a personality and i mean that as a compliment. He wasnt a good, old brooklyn boy trying to impress you. He was a very matter of fact judge. He will do a credible job and will do it quickly. I guess there are a lot of people out there scratching their heads and thinking, why did donald trump choose somebody like this . What do you know about judge deary. He has a long history in brooklyn. He was the u. S. Attorney in the Eastern District of new york between 1982 and 1986 when he was appointed to the bench by ronald reagan. He does get high marks from people on multiple sides on the political aisle. What i will say about judge dearie, he recently took inactive status. Hes currently a senior judge which means he has a reduced caseload. In late august, he said he was going to be inactive. That indicates to me he was looking forward to some sort of retirement, just slowing down. This is not the job you would want to take if you were trying to slow down. At least if youre going to do the job on the expedited time schedule that the department of justice wants you. So judge dearie does get high marks but i too am scratching my head. His reputation is impeccable. He has Security Clearances, but the trump folks wanted him and there must be a reason why. Lets get reaction from donald trump, what he said. I think if it happens, i think you have problems in this country, the likes of have perhaps which weve never seen before. I dont think the people of the United States would stand for it. What kind of problems, mr. President . I think they would have big problems. I just dont think they will stand for it. They will not stand for this ultimate of hoaxes. Big problems. A lot of investigations going on into trump. And betsy, you have new reporting involving the former president. Explain that. A recent batch of subpoenas that the Justice Department sent out asks witnesses for a broad variety of information related to the save america pac. Trump stood up this pac just days after the election in 2020 and its become perhaps his single most important fundraising vehicle during his post presidency. The Justice Department is looking at this pac and asking questions about it. We would expect that doj is interested in the way that this pac used lies about the elections outcome to try to raise money from trump supporters. What we now know is that save america has paid 3 million to cover the legal bills for trumps newest the newest member of trumps legal team. Hes one of the top lawyers handling both the maralago mess and the January 6th Investigation that the Justice Department is concurrently conducting. We know that save america is using funds that it has raised to pay for him to do this work for trump. 3 million is a lot of money. Bring on trump as a client. It just shows the extent to which so many of the different pieces of this story about trumps money, trumps Postelection Actions and his current daunting legal problems are mixed up and interwoven in some complex ways. Theyre looking into a lot of different avenues. Back to Special Master. Ken, when is judge dearie going to get to work and how long do you think it will take . Hes been told to prioritize those 100 or so classified documents. And thats actually crucial, katy. Thats what the Justice Department cares about most is the classified documents. Presumably he could get through those rather quickly. He has a support staff. They may have to get Security Clearances. He does not as a sitting federal judge. He has until november to conduct this, according to the judges timetable, conduct this review of all 11,000 documents. But it really looks like what the doj most cares about is getting access to the classified documents and that can be done rather quickly. And theres this question of what happens with any potential appeal and whether the Appeals Court grants a stay and gives them the classified documents right away. We need to wait and see on that, katy. You just answered a question thats been lingering in my head, ken, which is do all federal judges have total Security Clearance . Can they review anything from the federal government . They dont technically have a clearance. But like lawmakers, its inherent in their responsibility. When they have Classified Information that comes up in a trial, they are deemed clear to see that information and then they make arrangements to make sure that its stored correctly and goes to the right places. They put those lines on hold and then it sounds as if folks are actually lining up in order to stand in line which had one kind of witty correspondent saying the british have outbritished themselves. Theyre queueing to be able to queue. Weve seen some famous faces, David Beckham standing in line. He says that he was queueing as we call it since the early hours of this morning and that he had to stand in line for around 14 hours. And she was this amazing combination of somebody who provided spectacle and represented something bigger than herself. She was warm and reassuring. She knew how to walk the line i think between accessible and remote. So on one level, she would never give interviews, but she produces a sandwich to talk to paddington. Was she the grandmother or was she something sort of on this throne above them . They cant quite say. What she was was a sort of secular constant figure who everybody admired.
