Thanks for starting your day with us. A riveting new twist this morning, following the fbi search of former president Donald Trumps maralago home in florida. A federal judge has approved a request from trumps attorneys for a Special Master to review the material seized during last months search. Temporarily blocking parts of the justice departments investigation. U. S. District judge cannon, a trump appointee, stated in her ruling yesterday, that the Special Master should be able to review the seized documents to address questions of attorneyclient privilege, and to litigate claims of Executive Privilege. Judge cannon writing in part, in addition to being deprived of potentially significant personal documents, which alone creates a real harm, plaintiff faces an unquantifiable potential harm by way of improper disclosure of Sensitive Information to the public. Prior to the ruling, the d. O. J. Argued against a Special Master. Saying it would unnecessarily and significantly harm important governmental interests including National Security interests. Judge cannon rejected the justice departments arguments that trumps Special Master was file today late and it was frivolous and trump had no right to review, because he didnt own the documents in question that were seized. A d. O. J. Spokesman released this statement. The United States is examining the opinion and will consider appropriate next steps in the ongoing litigation. At the same time, judge cannon allowed a National Security review of the records to continue, but temporarily blocked the government from reviewing and using them for its quote investigative purposes. So the order essentially puts a pause on the d. O. J. s investigation until the Special Masters rv has finished. No word yet on who the Special Master will be but judge cannon will be the one to make that appointment. She ordered the d. O. J. And trumps lawyers to send her a list by friday of potential candidates for the Special Master position, and suggestions for what powers the position would hold. Also yesterday, judge cannon did not immediately grant trumps request to get back more of his property more quickly. The former president did not respond directly to the news that his request for a special mast her been granted. But did discuss the case in several posts on his fledgling social media platform yesterday. Writing in part, this, remember, it takes courage and guts to fight a totally corrupt department of justice, and the fbi. They are being pushed to do the wrong things by many sinister and evil outside sources. Trump followed up that post by another one suggesting that the fbi and the investigation has something to do with the last president ial election. Im quoting here one last time. Now that the fbi and the d. O. J. Have been caught in a massive and determinative election rigging scam, are they going to change the results of the 2020 president ial election . They should. Okay. Joining us now, is msnbc legal analyst danny cevallos. Were always pleased when you get up early to start your day with us this morning. Lets start with this ruling by the judge, there were some real howlings of outrage by many in the Legal Community about, this and she may have overstepped her purview by this appointment. What was your take . Im surprised for three reasons. I thought she would deny the request, first, because trumps team got off to a bad start with their filings shall and their requests, and in addition, i thought the Standing Argument by the d. O. J. Was strong, basically that hey, trump is not the president anymore, these arent his documents, so this isnt even any of his business anyway and the judge dispensed with that argument and the trump team cited prior cases involving searches of attorneys offices and that is a very unique place. Our offices are sort of a clearinghouse, a collect of different clients privileged documents so for those reasons i thought the judge would deny. It but im frustrated with the judges order for this reason. Her discussion of the concerns about the governments taking which is starved by other members of the government, other u. S. Attorneys is all well and good, but that is not the way it works for regular folks who youve never heard of. This is special treatment for trump. Nowhere else could a regular guy with a regular Criminal Defense Attorney go in to court and say, hey, you know, someone executed a Search Warrant on my home, i would like a Special Master to go through all of these documents, it just doesnt happen. And thats evidence by the fact that both sides struggled to find cases that stood for this proposition where this had happened before, because it just doesnt happen very often. It happens in high profile cases. Not in regular cases involving regular citizens. And what do you make of her decision on the Executive Privilege part of this, when hes no longer that was a weaker argument, because after all, it is the Executive Branch seeking documents from a former head of the Executive Branch. So if anyone has a stronger Executive Privilege argument, its the now existing Executive Branch headed by a new executive, which is joe biden, so i thought that argument was strong for the government, and judge rather dispensed with it pretty quickly. The d. O. J. Has an ability to appeal, is that correct . Do we suspect that they will . And just assume they do, what sort of time line are we now looking at here . This is all really going to slow down. Here is what is interesting. Had this gone the other way you know the trump team would appeal. That is their signature move. Appeal everything up to the supreme court. But im not so sure that d. O. J. Will automatically appeal this. Number one, they dont want delay, and thats something an appeal could do. And number two, im not so sure d. O. J. Cared that much to begin with. Yes, this will delay their investigation, but ultimately, a Special Master, they reviewed all of the documents, and their team has reviewed all of the documents, dont tell me that the government hasnt reviewed the team, because the team is the government, it is just a walled off area of the government, so theyve gotten most of what they asked for, they did oppose this motion, but i dont believe in the end it really hurts the d. O. J. That much, except with this caveat that we are approaching an election, and this is a very unique situation and the d. O. J. Obviously has to be aware of their informal 60 day rule not to mess up an election with an indictment. And lastly, very briefly, how much of a delay now could we see . What is the time line for this investigation Going Forward . Its so hard to say. In federal court, things generally move pretty quickly but the parties still have to submit a proposed Special Master, and the judge has to look at those, appoint them, and remember, a special mast ser just one person, its not like the governments k team of a dozen different people. Toward the end of trumps tenure, looking for a potential library in home and some said put the library in greenland and the president talked about buying. The president ial advise es say it is usually a little more than an afterthought for trump and it would signal his career in politics is dead. And those who spoke about a Library Earlier today saying he didnt seem to be terribly interested. He is more interested in being president again. Another confidante added this, president ial libraries are for expresident s. He is our next president. And also, saying trump should have given the records back and then asked for a loan of documents he wanted to exhibit as all past president s have done. Republican senator marco rubio is downplaying the fbi search. Listen to what he said in an interview with nbcs affiliate in miami on sunday. This is really at its core a Storage Argument that theyre making, right . Theyre arguing there are documents there, they dont deny they have access to the documents, they deny they were not properly stored. I dont think the fight over storage of documents is worthy of what theyve done. Compare that to what rubio said concerning Hillary Clintons handling of classified information, in july of 2016, he released a Statement Saying in part there is simply no excuse for Hillary Clintons decision to set up a homecooked email system which left sensitive and classified National Security information vulnerable to theft and exploitation by americas enemies. He added that Hillary Clintons actions have sent the worst message to the millions of hardworking federal employees who hold Security Clearances rand expected to go to Great Lengths to secure sensitive Government Information and abide by the rules. President biden campaigned in two battleground states on labor day. Pennsylvania and wisconsin. His first stop, a Holiday Festival in milwaukee. An energized President Biden took the stage to highlight his recent legislative wins. He also continued to call out socalled maga republicans in congress, specifically one of the lawmakers he was there to campaign against, gop senator ron johnson. These maga republicans in congress are coming for your Social Security as well. And along comes ron johnson of wisconsin. Hes arguing that five years is too long to wait to salvage these programs people depend on and put medicare on the Chopping Block every year and treat it like every other appropriation. You cant be a democracy when you support violence, when due like the outcome of the election. And they seem to think its working. What do other democrats think . I think time will tell, right . I think there will be an an effort and a real frustration on some democrats that it is taking the president this long to go on the offensive, to attack trump and maga republicans, and you can see much more forceful President Joe Biden in the last several days. I think is probably going to continue. Were nine weeks from the election. This is going to be, the fact that democrats are trying to campaign for what theyve been able to do but also strike that contrast for independents, and the democrats who are not motivated to come out to vote in the midterms, whether its on abortion, whether its on a lot of other issues, the social safety net, as you heard in that clip, it is about trying to force republicans into this Extremist Box to give other voters a place for them in the broader democratic party. What do you make of the mixed results i guess you should say about other democrats trying to embrace the president . We know that john fetterman, who is making his return to the Campaign Trail after his stroke stood with President Biden yesterday and Mandela Barnes of wisconsin did not. How complicated is this dance for individual democrats to figure out just how close to keep biden . Weve done a bunch of reporting on, this talking to members of the key senate races, in particular, and i think it is a race by race decision, right . And basically, you can see the Democratic Campaign add saying in the senate, it will be based on whether they will be there or not or even other surrogates and obviously the president s popularity has been in the tank, and so some people and some of the swing districts, wisconsin, republican states, probably getting up alongside them is going to be helpful, is not going to be helpful but in pennsylvania a state where biden knows really well, where he is from, you can see fetterman wanting to em brace him. I think it is a state by state race. And in the midterm, this is something you see every two years in the first term of a president ial election. It is not just biden, it is a complicated Decision Matrix about whether or not it is helpful to have him come and be part of the race. I think it is probably fewer races than maybe the Biden Administration might want. And lastly, and briefly, the senate is back, return can from its summer recess today, what is on its to do list, or is this all just going to be shifting in Campaign Mode . Well, it is going to be a very busy september. On amazon what was a hotly contested takeover battle. What is the significance of this . The big story in the health sector, right . Signify, which is a massive part of the story, which does provide technology and analytics to help with inhome patient care, will be bought out by cvs health. It signifies a big change and a big move for cvs. And they will have to do this move, particularly out of necessity, because you have competitors, amazon and walgreens who have moved into the sector and provided heavy competition. Yes, today is like Inauguration Day effectively, it is not called that here, the ceremony here is called kissing the hens. Just to be clear there is no actual kissing of the hens. There will be curtsying and bowing. And it started today, as you showed, with the clip of bois johnson, he gave a Farewell Switch as the outgoing Prime Minister and then the incoming Prime Minister, liz truss, both fly to scotland. And i think in just under two hours time, liz truss will become Prime Minister. They both meet with Queen Elizabeth ii, in a ceremony called kissing the hens. And Boris Johnson will bow, he will officially tender his resignation, he will have a little chitchat with the queen, and then he leaves, and then liz truss enters, she curtsies, and she is invited to form a new government, she also has a chitchat or an audience with the queen for about 30 minutes and its during that audience that she officially becomes Prime Minister. And what is also super interesting about today is that this is an historic first, that it is happening in scotland. Liz truss will be the queens 15th Prime Minister, and all previous Prime Ministers, all of the other 14 had all this Special Ceremony Take place at Buckingham Palace in london. So this is the first time that it is happening in scotland. So liz truss, conservative, comes to office, facing an extraordinary list of challenges. Yeah, i think the white house is hoping to have President Biden out on the Campaign Trail, selling that aggressive message, and really driving hard at this contrast you just laid out between democrats and republicans. I think democrats are feeling confident as they head into the midterms for two main reasons. One, they have a numerous legislative successes to run on that they passed over the summer. Two, they feel they can drive this contrast with republicans and hone in on what President Biden was saying there, dubbing a lot of rank and file republicans as these maga republicans, extreme republicans, out of touch with the american people. Ranging from january 6th to the overturning of roe v. Wade. I think the question is how many candidates want President Biden to campaign with him. His Approval Rating is still quite low, so i think itll be a case by case basis. We saw that split screen this weekend, as he was both in wisconsin and pennsylvania. In wisconsin, he campaigned with Governor Tony Evers but not with mandel barnes. In pennsylvania, we saw him campaign with john fetterman, who is running for the senate, but josh wasnt with him, who was running for governor. Officials have to figure out what candidates want biden to come and what the message will be when he appears with him or doesnt. President bidens Approval Rating has gone up, but it seems like itll be a case by case, state by state decision, whether the candidates want to embrace him fully or not. Although, obviously, theyre running on a very similar agenda. Tyler, white house aides telling me over the weekend that every single day, the conversation is about donald trump and its a good day for democrats. The maralago search is, again, a reminder to americans of the tumult, the fatigue that came with his time in office. We certainly heard from the president on thursday in his significant speech in philadelphia, Painting Trump as, frankly, an antidemocratic threat for the country. How much do we think the white house is going to lean in on this Going Forward . There was a stretch the president , biden, didnt like talking about his predecessor. That seems like it changed. Yeah, for much of his almost two years in office to this point, we rarely heard President Biden utter the words donald trump, more often referring to him as his predecessor or the former guy. Weve really seen that change, obviously, in recent weeks. And in conversations with white house officials and people close to biden, it has become clear they have determined that biden cant dance around the issue anymore. He has to be explicit, particularly as we move into this full swing midterm season after labor day. Its sort of the official kickoff of the sprint to election day. I think well continue to hear the president and other democrats really put trump on the ballot. This is something democrats have had success running on before. The 2018 midterms were successful for democrats. Also in 2020, biden won his campaign largely by saying, if you dont want the chaos that defined his four years in office, vote for me. As trump is in the News Campaigning for other republicans, also everything going on with the justice departments search of maralago, those are issues democrats are willing to run on, to paint the contrast and tie candidates to trump. Specifically on january 6th, on abortion, where democrats see room to win, polls show theyre much more likely to do so as we head into the midterms. It was supposed to be a tough Midterm Election season for democrats. Their fortunes have changed in recent weeks, and democrats hope to capitalize on that. Lastly and briefly, tyler, we know nothing is more of an obsession for this white house than gas prices. Every day, they check it. Opec plus yesterday, a surprising announcement there, fewer barrels going to the market than expected. What is the quick white house sense as to, are there any nerves here that gas prices could go up again into the stretch run of the midterms . Theres always nerves about the gas prices given the external prices that factor into whether or not it goes up and down. Ron klain has been eager to talk gas prices going down. Itll be interesting whether he can do it every morning as he has been so far. Thats the single greatest issue for the white house. They hope prices trend downward.
