And not his lawyers to challenge the 2020 election results. What does that mean for the special counsels case against him . Every time trump takes his television, or any other public form and begins to speak, my assumption is that someone at the Justice Department is taking notes. Because very often he says things that are contradictory or he undercuts his own defenses. Mostly importantly what is going on is trumps talking about his State Of Mind after the election. Hes undercutting a form of advice of counsel defense that might have been available to him. Essentially a lot of the special counsels case is on whether trump knew he lost the election or believed it. Or was reasonably blinded to the truth in a very unreasonable fashion. Here trump is saying look. I was fully in charge here. I was the one driving the truck on these challenges. And that may be quite helpful to prosecutors down the road. Also a scene the judge overseeing the Election Interference Trial to recuse herself. Talk to me how she raise that request and prosecutors motion for a gag order . Sure. So judge chutkan can need to evaluate whether this really comes down to. Whether the public will perceive her as being a fair and neutral arbiter as a judge. Or whether she is in some way become someone who whether she in fact could conduct affair trial, the public appearance would mean that her possesses a patient would be improper. And she is nowhere close to that bridge. All of the sorts of evidence that trumps lawyers have put forwards comments that she has made at sentencing and other cases that they have taken out of context. So i would look for her to in cage in a pretty quick denial of that notion in this case. There is one question that donald trump did not want to answer about january 6th. Take a listen. Tell me how you watch this all unfold. Where you in the dining room watching tv . Im not gonna tell you. Well tell people later at an appropriate time. Did you call a military or Law Enforcement at the capitol . Im not gonna tell you anything. Let me put it this way. I behaved so well. I did such a good job. Okay so i will pick it over to joyce in a minute to get a legal analysis of what that was meant to do. But politically speaking what is that answer intended to accomplish . I actually think that the answer is. We know that donald trump will say basically just about anything. Except on the verge of being held legally accountable i think his answers as so much about what he expects his legal accountability and what is legal accountability looks like. He wouldve said everything is great. This is what i did. This is what i did. If it was going to exonerate him but my guess is what he wouldve said is not going to exonerate him so i think all his answers today are completely related to his legal accountability. Thats its out there in the courts. I am going to look back to that question. First i want to get choices analysis on what the legal shadow of that answer is. I think matt stood on the money here. This is trump stopping short of making a full confession that he failed to add for a period of time while he watched the violence play out. That obviously was the point. He may be actually listening to his lawyers here when he doesnt go that far into the interview. I love that that is the hardest thing for us to believe, that he actually had that disappointed and wherewithal to be listening to his attorneys. To look back to this question because i do understand matts point that most of this was probably said with some legal mess in mind. I felt that answer about do you go to sleep at night. Do you think about this. Are you worried about this. It was so preposterous just for a human being that that answer at least had to be political. It had to be a signal to his supporters. I am not worried about this so you should be worried about this. Especially given that all of that republicans who are Running Against me are telling me that the biggest reason not to vote for me is because i cannot win in that general election because i got all of these legal troubles . Yeah look. Indictments have been good for trump with his base. They have liked them and they have rallied around him. They have shown their support to him so i think there is a big part of trump that is really worried that he is going to go to jail. And we know this from the reporting and we know that from people who know him. But i think there is also a part of trump that is like i am going to play this with my base. Im gonna play it in the court of Public Opinion and then that he will be able to outrun his legal problems and look. If he can get elected again, i think that is the game. Its just to stay alive another day. Ive gotten out of the business of asking for armchair psychological analysis of this former president. I do think the Strategy Piece of it is always interesting. Because i was on with Eugene Daniels last night and he said two things that i thought were very accurate. This is the person who is known for lying, so always watch through that lens. And secondarily, this is a person who is astute. Who is able to know where his bases and know what to say. I think you saw some of that on the rambling mumbo jumbo abortion answer. I think you saw some of that on this answer about i am not worried. I wonder what. Do you think he went into this with a political strategy mapped out . I dont think donald trump is strategic. He is more guttural. And actually to deal with his base he has a pretty good gut instinct about the base. He had a better gut instinct in 2015 and 2016 as someone who had never run for office before. More so jeff bush, and marco rubio, and chris christie. The other ten or 11 candidates that have been served and officer are relationships. His gut instinct related to his base is incredibly into to it. So i dont think he has this grand, heres a sevenpoint strategy, and this is what my seven point strategy is. Its all Neanderthal Gut and it is in tune. Molly trump says that he did not pressure House Republicans to impeach President Biden. They were just quote being proactive. If that is typically believed and i know it again context is a entire thing. That is a big if. What is that ben signal to you about trumps relationship with the gop or rather the gops relationship to donald trump . Right, right well its well its not to be to not to be believed. And we be believed. And we heard him during heard him during many speeches say many speeches say things like things like, its its not fair not fair, and if theyre going to and its come after me, they should if they are going come after to come after me hit me too. Than they are going to come i mean, its clearly after him too. Been an obsession of his its clearly been an for a long time. Obsession of his for a long but time. But certainly, this house certainly this House Republican caucus, kevin Republican Caucus mccarthy remember,. Kevin 21 days mccarthy, remember after the 21 days after the armed armed insurrection, he insurrection he was was down at down at maralago maralago, fund front raise a. Raising. And so and taking pictures, and taking pictures. So i do think so i do think absolutely this absolutely, this caucus really belongs to donald trump, and he is the leader of it. And you know, there is reporting that says Kevin Mccarthy started this impeachment proceeding, to avoid a Government Shutdown. And that, now matt gaetz is saying that he wants a Government Shutdown anyway. I mean, i cant do this is like, really theres not enough room in the clown car for this. Caucus that car, is thats, large that car. Now congressman jim raskins today tied the biden impeachment back to january six, i want you take a listen to how hes talking about it. America needs to understand, we are just in the middle of this struggle. And we are not over it in the sense. Theres a temptation to look at it as a farce. And it is a farce that could bring the republic to its knees. Okay, as always Jamie Raskins setting the stakes there. In part of the reason i found this interesting no doubt, is that just last, that we had Eugene Scott On when he had just been in pennsylvania, talking to swing voters in pennsylvania. So, voters who voted for trump in 2016, voted for biden in 2020, not sure who didnt vote for in this upcoming election. And when i talk to them about the, quote unquote, biden won these all political motivation. You know as well as i do. 15 people, not as necessarily a sense of where all swing voters are. But you think you have both that truth, that there are americans who are looking at this, until exactly politically motivated on behalf of the republicans prevented hes the most white part of the caucus. And then, there is what jamie raskin said, which is dont just wave this away. Dont understand that the stakes of their shenanigans are incredibly high. And so to me, that is a message that is a little a complicated to deliver, which is there is no merit to this. And yet, what they are trying to do is incredibly, incredibly dangerous. Well, i think representative raskins was dead on this is another attack on our constitution in art to me, this is incredibly troublesome, that we are at that point in time, were basically a third of the country, a third of the country believes that any ends, any means justified any means that you got. So, getting rid of joe biden is the and, and anything you could do even roller the constitution is, and that is concerning when you face of a third of the country and a third country in a vast majority the Publican Party who dont longer believe we have to stand firm on our constitutional democracy, that is really just something, thats a tool to play with. If it works, right, if it doesnt, not. And that, birds are american public, to have a Major Political party, in a third of the country fundamentally no longer thinking that we are dependent on our constitutional democracy. Thats incredibly disturbing. Just again, multiple paths to accountability. And i, want to make sure we talk with the Fulton County case, the judge set a filing deadline of december 1st, with no trial date. Your sense of when we can expect a full schedule . So i think there are still some moving parts in the work. The 11th circuit will hear briefing, and will decide some additional removing issues, after those cases are heard. In front of the Federal District judge this week. I think there will be no removal in this case, thats the take away from the mark meadows situation. But that will need to be finalized, and then i think what we will see the trial judge in Fulton County do is set to, possibly three trenches of defendants will be tried together, the early to have asked for speedy trials, and then two more. And here i think is where theres been a little bit of part in setting these trial dates. It would be burdensome on the courts, burdensome on the prosecution, to have two trials overlap in any way or. And so, the judge will have to really figure out whether the prosecution is serious about the timeline it has given him for trying this first case, and then set the second case so that it doesnt begin until the first one is entirely complete. If theres a third trial, the same pattern. But in terms of the way the courts handled cases, conducting two trials at this level of seriousness, with all of the attendance issues that will come up, everything from television to security.
