Now i fully anticipate that the next few days i will be indicted by mueller. All right. Were going to get to that big flip in arizona in a moment but we must begin this morning with the wildfires. Thousands and thousands of firefighters now dug in as they battle two of the nastiest, deadliest most destructive fires in californias history. At least 44 have been killed but there are still scores of people missing. More than a dozen teams searching for the remains in the city of paradise which was burned to the ground. Officials promising once the fire is out, the town will rebuild. For those of us who did not lose our lives, we are considering ourselves survivors. And we will come back from the ashes. We are fully committed to building a new paradise. There are two major fires burning now. The socalled camp fire has burned 117,000 acres, an area roughly the size of new orleans. Firefighters are having some success at keeping that fire in check but its already destroyed more than 6,500 homes, leaving entire homes and neighborhoods in desperate ruins. As soon as i turned in this area, i saw a tidal wave of fire, like right over there. A tidal wave. Just like you see somebody surf and you see tidal wave but it was fire. In southern california, the situation could get worse before it gets better. The entire area from san diego to los angeles is under a red flag warning. Meaning dry weather could lead to a dramatic increase in wildfire activity. Already, the woolsey fire has burned more than 93,000 acres. 57,000 homes are in the path of the wildfire now, an estimated 400 have been destroyed and 200,000 people have been forced to evacuate. The big challenge today of course once again will be the santa ana winds. Red flag warnings will be in place through wednesday. When i came here friday morning to check on the house, i thought it would be fine. I drove up the street and every house is fine and then i came on and it looked like, you know, like a war of the worlds scene, yeah. And you were saying your family, theres several family members who are here, they evacuated quickly. I mean, they didnt have much time to escape. No, we didnt have time to grab anything. Shoutout to firefighters and policemen who came to everybodys door and woke everybody up. They evacuated it was my parents and my three grandparents still him here and i come and stay here on the weekends with my son. A parentally then the house caught fire around 2 00 a. M. On thursday. When i came in the morning, it was still smoldering. I appreciate the time. I know this is a difficult situation. But here in southern california, the contain minute is 30 . Once between, the big challenge will be the strong wind gusts that continue to potentially make this fire an even bigger problem. A bad situation even worse. One key race is now over. And id like to say its over with grace. Steve kornacki. We have got to talk about arizona. It was a brutal bali between n sinema and mcsally, brutal, but in the end gros, gracious. Very striking to see that from mcsally. Theres still votes to come. Mcsally conceding. One of the theories thats out there about why mcsally might have had extra incentive to do that is it looks like jon kyl in that other seat, appointed a couple months ago, has made it clear he wants to move early next year, it looks like that seat will be open soon. Mcsally may be in line for an appointme appointment. So keep an eye on that one. The other Big Development in the georgias governors race. Brian kemp, the republican. The key here is does that number, that 53 , does that fall below 50 . That would trigger the runoff in georgia. A ruling from a federal judge in georgia that opened the door to an unknown number of ballots, provisional ballots, being considered. So what was on the table before in terms ofo outstanding votes was not going to be enough. Now maybe, we dont know the exact number, there may be an outside possibility with these new votes. There could be there are also lawsuits from democrats trying to expand the number of absentee ballots that are considered, so keep an eye on that. But the map is very tight for democrats trying to get kemp below that number. In florida, the machine recount now under way. Apparently not yet. Theyre not actually recounting the ballots yet in broward county. Thats where all the real attention beginning to focus. Look, 2 Million People live here, 70 almost bill nelson, the democrat, gets out of this county. 56,000 fewer votes were cast in this race than the race for governor. Thats a discrepancy. You do not see anything close to it in any other county in florida. The Nelson Campaign is claiming this is a machine error. If they have this manual recount, it will be caught. The other issue is the ball lt they chose to use in broward county. The governors race that got all the extra votes. Your eye is drawn right to it. Heres the senate race below a lengthy list of instructions. Did it about 3 of the voters in broward miss this . Here is the irony to this. After the fiasco of the 2000 election in florida which consisted over a dispute over the ballot. One of the pieces from that commission was never put races under instruction columns because voters will miss them. Lets go to florida. Kerry sanders is in florida. Whats going on there . What is not happening is the votes are not being recounted. Those are the machines over my shoulder. They werent actually counting the ballots yet. Theyve been separating out the pages because they only need the first page of the fivepage ballot. Of course you have the mailin ballots so theres 189,000 mailin ballots. Five pages. So they have to separate all of those. We can report that 8 of floridas 67 counties have completed their recount. The deadline of course is thursday, 3 00 p. M. Which initially had wondered whether they would make that deadline. Now saying indeed will make that deadline. Our math, according to the board, suggest these machines, once they finally get loaded with the ballots, will do about 170 votes a minute. The big question, we just heard steve say, is that the nelson complain believes there may have been some sort of calibration problem with one of the vote counting machines and thats why the 24,000 or plus votes may not have been counted. In manatee county, they had a machine with a problem just like that and they caught it. So they had to start all over again and they had 43,000 votes they had to run through the machine, realized the error, lost about five hours and started it again. There is always the human error part of all this. Fortunately, they caught it there and of course the big question is was there a human error or a mechanical error with the machines when they did the first count that caused that anomaly of almost 25,000 votes where people voted in the governor race but seemingly not in the u. S. Senate race. Hopefully well get those answers. I want to bring in senator bob torricelli, from my home state of energy. And Steve Kornacki still here. Senator, i want to start with arizona. Jeff flake has won 70 elections there. President trump made it impossible for him to run this year. He walked jeff flake out and took pride in doing so. Now republicans lost this seat. What do you think theyre saying about that now . No, donald trump cost them a seat in the United States senate. That seat looms very large now. It is very different with 53 seats versus 51 or 52. Where every man or woman is a king. In many ways, trump tossed that seat overboard by his conduct. A state that should be able to reliably win with a good candidate. He was not a bad candidate. It was a brutal race between mcsally and sinema. We didnt see these rampant claims of voter fraud. In the end it was like sinema won fair and square. First of all, health is a reward for class in american life. The people realizing you can have grace. You can handle yourself appropriately. The reward is greater than feeling good about yourself, that the public responds. I watched her confession. You just love the dog. She won me over with the dog. The dog aside, i thought to myself, good for you, good for you. I hope somebody else is watching. They count ballots different, dont they . Arizona, so much of it is mailin. Theres the stuff that was mailed days before the election and takes them days after the election to count and then theres the stuff that people fill out at home and bring in on election day. There are still quite a few votes to come in arizona. What was happening, there was this pile of votes there that the mcsally camp had been saying once they start counting these, youll watch her close the lead. Instead that gap was only widening. It became clear that type of vote wasnt going to materialize. We said this over the last few weeks, lets get as Many Americans as possible to vote. Let the winners win fair and square. How rick scott who is most likely going to win who doesnt need to do this, how hes handling it. The usa today has this editorial. Scotts unwarranted accusations echoed and amplified by trump only undermine faith in democracy. The day that citizens see elections as something other than impartial exercises and vote counting is the day that the despots gain a foothold. Were going to the foundations of american democracy. The problem with american participation in elections isnt that its hard to vote, we need longer hours, different ballots. People have to feel theres something at stake. Theres something in it for them. 110 Million People showed up to vote. The highest in some states in 50 years. Why is the president doing this . The point is if people believe in the process, they show up. When people like rick scott saying the process is rigged or the president says it doesnt work, youre chasing people out of american democracy. It is bad for the process. Why do it when youre winning . I have a better idea, dont do it at all. Thats the best idea. I dont understand why rick scott would be doing all this and tarnishing his name. A guy who was not well known outside of florida. Will show up now with this reputation. Let me show you how that works. It is a club of people who have strong views about each other. Show up with the reputation of a guy who has a chip on his shoulder and an attitude and not good about the process, lets see how that works out for your career. What are the races to watch . Florida, its a big question of what happened with those ballots. The margin right now is 12,562 votes. Thats what nelson is behind by. If youre talking about a county where theres 25,000 plus ballots that probably went for nelson in Something Like a 70 rate you could erase most, if not all, of that gap. Theyre insisting the ballots were run through admissioned. So this is the biggest single variable in the vote count. Just very quickly before we go, there is no evidence of voter fraud, despite what the president and rick scott are saying. Is that true . The Biggest Issue to emerge from broward to me is what will happen with these undervotes. If its ballot, shame on the democratic party. Ill tell you, the mechanics of this, in eight elections, the person i trust to look at ballot position was me. I trusted it to no one. You look at that ballot and make sure youre at the right placement. Somebody dropped the ball if that was the difference, ballot placement. All right, thank you. We have to talk now about d. C. Where President Trumps decision to appoint Matthew Whitaker as ting attorney general following the resignation of Jeff Sessions is facinggal chal. I want to go to msnbcs justice correspondent pete williams. Any time i say resignation, i have a hard time. Tell us whats going on today. Asking a federal judge to declare the acting attorney general is rosenstein, not whitaker. The president put whitaker in under a federal law that allowed a president to choose a range of people, including somebody whos at the Relevant Agency for 90 days and makes a certain amount on the pay scale. Maryland argues that law is trumped by a law that more specifically says whenever theres a vacancy in the office of the attorney general, the Deputy Attorney general takes over. The second argument is a constitutional one. They say anyone who serves in a senior position like attorney general has to be confirmed by the senate. Deputy attorney general was confirmed by the senate. A number of other Justice Department officials were as well. This lawsuit says, in fact, if you look through history, everyone who has ever served as acting attorney general has been confirmed by the senate for some position in the government. The president could have chosen someone like that. The Deputy Attorney general. The secretary of trans. Any of those people confirmed by the senate. But he didnt. And maryland says, therefore, that choice of whitaker is illegal. Theyre asking the judge for an order right away declaring that rosenstein is the stronger. He also said he didnt know Matt Whitaker and alas, he does. Up next, a close associate of roger stones says he thinks hes going to be indicted for perjury. He told you hes afraid hes going to be indicted for perjury. Some people are saying maybe this is a fake, perjury for what. He explained he sat for 40 hours. There were nine fbi agents, six prosecutors. He felt like he was being grilled. They gave him a binder, 6 to 8 inches thick. They knew everything about him. Everything hed said to roger stone, about Julian Assange and wikileaks. We reported last month he actually communicated with the Trump Campaign after the october surprise, the wikileak dumps of john Podesta Emails. In a sense taking credit for it. He explained he actually figured out on his own the Podesta Emails were coming. He saw, hey, not so many john Podesta Emails. Is he clairvoyant . That is his defense, that he did not have advance knowledge. Thats the heart of it, is did he have advance knowledge from assange or another source, pass it to roger stone, or pass it to the Trump Campaign and that would be collusion but were far from that. Far from collusion but he told you this about the special counsel, quote, they have all your emails. Theyre very good at the perjury trap. Hes suggesting he got tripped up. His mind was mush after 40 hours of what he called interrogation, that he must have slipped up did he have a lawyer with him . He did. So he thinks he slipped up, it was 40 hours of high pressure. Why does he think hes being indicted in the next day . He says he doesnt believe he ever met Julianne Assange or had advance knowledge, but perhaps some of those communications or texts or emails he handed over to investigators might indicate otherwise. But how does this link back to the campaign . He was not a central player. There are lots of fringe rightwing conspiracy theories who are always trolling for stuff. Does this link him to the Trump Campaign . Not necessarily but this all goes to the roger stone circle of the sort of characters who are coming out of the woodwork and theyre going through stones communications, and they probably found corsi and Stone Communications in august,
