Necessary. That as Michael Cohen prepares for a marathon three days on capitol hill. He is set to testify. And ill talk to the attorney of someone else who talked to the mueller team. But we want to begin at the start of a huge week on capitol hill and what could be the final stretch for the Mueller Report. At the center of it all, potentially explosive public testimony from the man who has seen it all, the president s former attorney and fixer Michael Cohen. I have a great team to help me break it all down for you. But first let me tell you where things stand right now. Now despite all the predictions, the Justice Department now says that special Counsel Robert Mueller will nothanding over his russia report this week, but it didnt mean there is nothing happening. Over the past 48 hours, democrats have been ramping up the pressure on attorney general william barr to release the whole thing. If that doesnt happen, House Intelligence Committee chairman adam schiff said sunday that he will bring mueller into testify and subpoena his findings. I think that there will be immense pressure not only on the department but on the attorney general to be forthcoming. Are you prepared to take the administration to court . Absolutely. We are going to get to the bottom of this. We are going to share this information with the public. And if the president is serious about all of his claims of exoneration, then he should welcome the publication of this report. So barr has said that he wants to release as much information as possible. But according to federal regulations, congress will only see his summary of muellers findings. It is not clear what the public might actually get to see in all of this. But even some republicans have now suggested that they would err on the side of more disclosure not less. Ive always been of the view that anything that slows down the investigation is not a good thing, that we need to get the facts out there, get this behind us, and in a way that people thought that should have been talked to was talked to and any question that should have been asked was asked. And in the meantime Michael Cohen will take center stage on capitol hill. He will be testifying in front of three separate committees over the next several days. The highlight will be wednesday, that 1 when cohen testifies publicly in front of the House Oversight committee. Among the issues, he has apparently agreed to discuss the president s comply answdemocra president s compliance on everything. To discuss the president s conflicts of interest, his business practices, and potential fraud stemming from his charitable foundation. Cohen will also be asked about his own false statements during his prior testimony on the hill. One important note, he will not publicly discuss any issue related to russia. Cohen is saying or rather saving that for discussions behind closed doors both to the house and Senate Intelligence committees. I want to bring in ken dilanian and garrett hague. Ken, let me begin with you. I just laid out some of the issues that cohen has agreed to discuss in open session. What are you anticipating that we are going to hear and more importantly what we could learn in some of the closed sessions as well . Well, in closed session, he will of course cover the lies that he has told previously to these congressional committees about the timing of that trump tower moscow deal. Remember that he said that negotiations had stopped much earlier than they actually did and they went on through the election. And in the plea documents, he exposed essentially that donald trump had not been telling the truth about that deal when he said he had no dealings, no investment in the russia because in fact there was a meeting according to the plea documents in which cohen and trump discussed company mean outreach to Vladimir Putins government. So that will come up behind closed doors and of course the whole issue, it has long been alleged that Michael Cohen had meetings with russians during the campaign about election interference, he has always denied that, so you can bet ghatities will get to the bottom of that. But in open session, this prime ministers to be a very dramatic hearing. Im told Michael Cohen has been prepping for this for a long time. He knows he has credibility problems, so he will come with documents and talk about the hush money payments to women. And lets not for get hes already implicated the president in a Campaign Finance felony and he will talk a lot about how the president does business behind closed doors in very graphic, very sordid details. So i know that you have been able to get a sense, garrett, about how some of the lawmakers are actually preparing to see the Mueller Report. Is it the final word or just the first stage of a much larger fight when this report makes its way to the attorney general and then he ultimately decides what happens with it . Yeah, i think the muellers report delivery to the attorney general is just the start of this for congress. What will happen next up here on the hill will unfold in two stages. First will be the battle to see and learn what exactly is in muellers report, not the summary that the attorney general will deliver. You hearded adam schiff says hes willing to subpoena for this. There is precedent for this. Democrats in the house in particular are going to want to get into the nitty grit here of what did Robert Mueller find out, what did he choose to not prosecute, what does he know about the president. So there will be a battle to get the details. And then there is a separate question about what do they do with the information. The question about impeachment has been in the air for a very long time. House Democratic Leaders specifically the Speaker Nancy Pelosi has held off thus far saying we want to see what is in the Mueller Report first. Thats been the line for most democrats, what did mueller come up with first, and then they will decide how they want to move forward on that issue. So you will see fighting over exactly what is in these documents, how do we find out the specifics and then what did we did with them, do Congressional Democrats decide to murder s to pursue the i word. Can he legally do that and is this more or is this political posturing on his part to put pressure on william barr to release as much of in report as possible . Yes, he can do that and im sure hes doing what members of congress often do which makes it clear if you dont turn these documents over, you can expect a court file. And the history here, garrett referred to some of it, is very much on congress side. Over the past couple years, one thing the Justice Department has made clear, it is not the arbiter of president ial miscon gunkts. They cant indict a sitting president , that it is congress job to police a president. So the only way congress can do that is if they have access to not just muellers report, but access to documents. And the precedent is all on congress side. There arent really actually any rules governing what is turned over to congress. There is case law, but nothing written down in statute any anywhere. And the Republican Congress repeatedly demanded that the doj turnover documents related to the russia and clinton investigation and they ended up getting them, sometimes because President Trump insisted on them. So there is a bit of an aspect of them being hoisted on their own pi tar here. And that raises an interesting question about what this means for the general public. Former acting solicitor general helped write the special counsel regulations way back in 1999. In fact i want to play you what he told chuck todd on meet the press yesterday about his intent writing those regulations. The idea was there was going to be Law Enforcement sensitive material in there and in general you wanted that report to be confidential. However, when youre dealing with potential wrongdoing by the president of the United States, if mueller finds information out that says this, absolutely the attorney general barr has the discretion to return that report over to congress and indeed he has to. The overall intent of the regulations is Public Confidence in the administration of justice. And any sort of suppressed report about president ial wrongdoing will flunk that test. So i guess the question becomes how do you reconcile those two words that he used there, the ddiscretion william will have and ultimately this is whether or not it is in the public interests. There is no doubt that broad Public Disclosure of muellers findings is in the public interests. I think that the more subtle question that youre asking here is what 1k35k9exactly is muelle likely to disclose. There is one version of the memo where it is simply a recounting of his Decision Making. Who did i decide to indict, who did i not to decide to indict. 7 it could be a simplist. What we dont know is whether mueller will have a broader analysis that says i had no option of dindicting the order, but if i had, here are the charges that i might have considered. No matter what form this document takes, it needs to be disclosed and i think matt is wise when he talks about the fact that congress coming out early and saying that they will seek this report, it not only gives doj sort of a little push to release, it also gives them cover for doing so if it is ultimately going to be disclosed. So that is a great teeing off point for the question for you, danny, which is adam schiff making these comments over the weekend about possibly even suing the administration to ensure this document gets released. What do you make of those comments in relation to what skrois just sa joyce just said, that it gives push to the department of justice but also some cover . Since the early days of the republic, congress has had the pourer to investigate the executive branch through subpoenas both for documents and testimony. But it is less clear that the legislative branch can sue the executive branch in court. Congress may or may not have standing to file a lawsuit in a case like this. And the idea is traditionally under a policy called help me out. Im forgetting it. But it says that certain issues are left exclusively to the determination within the executive branch. And the idea is that if congress simply doesnt like the way that the executive branch is enforcing its own law, it cant just rush to court every time and sue the executive branch. The executive branch like all branches mass to be abhas to ru policy internally without interference every time. So while congress can issue subpoenas for testimony and documents, it is not as certain that they can sue the executive branch for its enforcement of the law. Matt, let me get your thoughts on a word that garrett also talked about, the i word, impeachment. If as some have suggested that the president can only be impeached not indicted while in office, although the law is still ill defined on that, doesnt congress have to see all of muellers findings in order to determine what they should and can do next . I think that is exactly right. Look, if the theory behind dojs opinion, and weve heard a lot about the opinion, that the president cant be indicted and the only way to Police President ial misconduct is for congress to do that, then congress has to have access to august the information they need to make an informed decision. That didnt mean that they need to rush into impeachment or start hearings the moment this report is delivered. What it means is 234e need to be able to conduct their own full investigation to look at all the facts that bob mueller has gathered, be able to interview all the witnesses that he has talked to, that means people like michael flynn, like Michael Cohen who well see this week, people like rick gates who is still cooperating. Need to be able to come up to congress and testify and Congress Needs to have access to material. And i think that even includes grand jury material. It means that they probably need go to a federal judge and see what the grand jury has seen so they can make a full decision whether they believe that the president s conduct rises to the standard of high crimes and misdemeanors or not. Joyce, complete get your thoughts on the big testimony this week, Michael Cohen has three both to the senate and house intel committees plus the Oversight Committee which is the only one that will be public. He already lied to congress once. Does that mean that the testimony this week is automatically tainted . That is cohens biggest challenge, convincing people that he is now telling the truth. This is a fight i alwaways relished because cooperating witnesses are always picked by the defendant or in this case by President Trump who chose Michael Cohen to be his lawyer. So cohen has access to a great deal of information. The question, is he now willing to tell the truth about it. And the only good outcome here for Michael Cohen is if he does tell the truth. There are people who can hold him accountable if he lie. That means that he could go to prison if a longer period of time. But cohens only path forward is telling the truth. If he does that, prosecutors in the Southern District of new york could even choose to ask for an additional reduction in his sentence. So if he goes in with documents and evidence to back up the testimony that he now gives, the circumstantial guarantees of his honesty and truthfulness here will be very compelling. Certainly be a performance to watch. Danny, final question to you. What are you watching for in Michael Cohens testimony this week . We already got a sense of some of the topic he is supposed to discuss, what jumps on you at you . Last summer Michael Cohen stood in federal court and essentially accused the president of conspiring with cohen to make illegal Campaign Finance law payments. So my answer is not exciting. It didnt go to russia collusion or the potential pandoras box of things that Michael Cohen knows twhae donhat we dont tho. But it is the safe money. Because last summer Michael Cohen implicated the president in a crime. Michael cohen pleaded guilty to it, so the government cares about Campaign Finance law as a crime. So that, the safe money, easy bet is the most compelling evidence, may be that. Safe to sure that will definitely come up. Danny, joyce, matt, thank you all very much.
