Though trumps decision to selectively address allegations against others did raise a barrage of questions about these new attacks as well as his past today. Is it also fair to investigate this president and the allegations of Sexual Misconduct made against him by more than a dozen women . Look, i think this was covered pretty extensively during the campaign. How is this different . I think in one case specifically senator franken has admitted wrongdoing and the president hasnt. I think thats a clear distinction. Some critics said it was hypocritical of the president to tweet about al franken and not weigh in on roy moore. He did it while he was on a foreign trip in asia. Is it still the White House Position that all the women who accused the president of Sexual Misconduct are lying . The president has spoken about this multiple times throughout the campaign and has denied all of those allegations. Several political leaders and commentors arguing throughout the day and night donald trump shouldnt be the one throwing stones in this particular debate. Theres a new report that quotes some of the 14 women who have accused donald trump of misconduct saying, quote, i feel we were forgotten about and there was no justice. The white house saying, well, donald trump never admitted wrongdoing while al franken does. But there are other political leaders tonight, independent analysts and some feminist advocates who say the issue is whether the allegations are true not only how accused politicians respond. Reporters Jennifer Bendry surveying several republicans why. What those writers summarized, they say they have no idea why. And they dont want to talk about it. Now thats the state of play in washington. What about alabama . This is that new polling i mentioned. It has some striking shifts. First the new fox poll suggesting allegations are hurting moore, hes down eight points to doug jones. Thats a big shift. On whom voters believe in alabama now theyre split, 38 say they believe the allegations against moore. 37 say they do not. Some republicans leaving moore. The largest gap in alabama is a gap seen across the nation, a gap between genders. We can report for you that moore holds a 12point lead among men in alabama right now, and he trails among women by 26 points. If those numbers were to hold, moore would probably lose this once republican safe seat because of a coalition of women across party lines. Im joined now by nancy giles, an emmy award commentator. Joan walsh, National Correspondent at the nation. Bill kristol, editor at large for the weekly standard. Joan, what do you think of those numbers . Theyre amazing, impressive, and encouraging, ari. They have to include some republican women, some independents, white women. A lot of us were very disappointed back last november that white women went for donald trump over Hillary Clinton despite those allegations of those 14 women. So to learn now that alabama women are taking these accusers seriously and its changing their votes presumably, thats great news. I agree. Its the coalition that we hoped had happened for the president ial election that didnt. Maybe its the giant wakeup call, maybe its the details and the amount of women that were witnesses to it and the detailed reporting of the Washington Post and every other News Organization about what happened. Maybe its a little detail like roy moore calling that other girl and saying what are you doing right now and her saying im in trig class. The idea of a person running for senator that could Say Something as absurd as, well, i have all the mothers permission before i did. Its messed up. Its wrong. I applaud alabama women right on. In politics we often use categories, and they are often overly determined. We turn to you sometimes as a conservative and sometimes as a republican. Ill turn to you having heard these two guests, i turn to you as a man. The big gap in alabama is male voters in what is obviously a more conservative state still sticking by roy moore, and women voters of various parties really turning on him and appearing to believe the women and believe this is disqualifying. Well, i salute the women of alabama. I would say the gap among men is only 12 points. I bet in a normal Republican Democratic race in alabama the gap is 25 points. I bet if you look at the fox poll theres erosion, some men who care about this issue. Someone mentioned alabama women. I think thats very important. These are charges made by women who live in alabama, who have lived in alabama. Its not some outer state. These are women on the record talking about what happened in their state. And that, i think, makes it credible and brings it home to the citizens of the state. I notice the moore campaign, and this is clever if you want to give me credit for cleverness on this, is trying to make it all about gloria allred, an outofstate lawyer who shows up with her client and not making it about the actual women in alabama who were the original focus of the Washington Post story and the most shocking claims have come and utterly unrebutted. The original really shocking claim about the 14yearold girl, theres no contesting, calling the high school and pulling her out of trig class. Thats not being contested. Look, moore has learned from trump, never admit anything. Deny everything. Find one weak point. Its just like trump with russia. Dont bother even talking about it. Attack Hillary Clinton and the uranium case. I totally agree with bill and the thing about it is is that trump just obfuscates. He throws other things in the way so people can be distracted. Moores attorney wanted to focus on whether the yearbook is legitimate, authentic, which doesnt say that he didnt do it, that he didnt sign it or anything like that. Its these weird offshoot things they can try to focus on and distract people from the main thing which is the guy likes teenaged girls and had no problem showing it. And pretty much told sean hannity that last week. Thats what got him in the most trouble. That was the most bizarre. That set of conversations he had with sean hannity where he was like, i cant say i didnt generally date teenagers but if i did, i asked their mothers. Anybody i dated i asked their mothers. If you need to ask somebodys mother, you should not date them. Dont you think thats not a defense . That was a definite admission against interest is how it would go if you had someone on the stand and you got them that far. That would hurt their defense. The other part of this is what is sometimes called the counter offensive, joan, or the head fake, the idea if you intend to countersue and roy moore has talked about doing that and talked about going after these women that might make it seem im not saying this is true, but might make it seem like you had some winning arguments on your side. Here was how donald trump famously predicted he would do something he did not ultimately do. She said i made inappropriate advances. Look at her. Look at her words. You tell me what you think. I dont think so. I dont think so. Believe me, she would not be my first choice, that i can tell you. Man. You dont know. That would not be my first choice. Every woman lied when they came forward to hurt my campaign. Total fabrication. The events never happened. Never. All of these liars will be sued after the election is over. Joan, theres much to deal with there. I would only ask you to start with the threat he didnt make good on because we are seeing that replayed and i will stress it again in fairness. Not everything here is the same. But there are some of the same tactics of trying to get voters to think, well, if moore is going to sue, maybe he has a point. But donald trump never did that. Donald trump didnt do it. Roy moore isnt going to do it. Let me say, let me give roy moore credit here, ari, because hes not such a pig that he has yet said that these girls were too unattractive for him to harass them. And thats basically what donald trump was saying. And i was in greensboro where he said it. I was there in the crowd and the crowd loved it. Look at her. Would i ever. So roy moore, lets give him credit. He hasnt done that yet. When he made those remarks, i remember thinking i am now living in bizarro world. This is what hes using as an excuse for repeated accusation that is were eerily similar of Sexual Misconduct. Why would i pick her . And the crowd, not an allguy crowd, women were going to go, yeah, she wasnt cute enough. Its crazy. Its sickening. Youre right, at least roy moore didnt do that. Its a low bar. As they say, ive use this had line before but it keeps arising. Theres a Country Music line, bill kristol, from the gutter to you is not up. And in the case of those kinds of statements about trying to excuse that kind of conduct it might apply to people who say it there. The final thought on the republican politics of this. Washington is saying no. Alabama we reported is split. What happens to the gop with the roy moore situation . I see the governor of alabama support roy moore, the congressmen are supporting him. This was hinted at in a letter from the Senate Judiciary committee to kushners letter we reported on asking for emails that had not been disclosed about a, quote, dinner invite that kushner allegedly shared with a campaign official. All of this relates to a putin ally who is a banker and he has been alleged to have links to russian organized crime. Ken delaney and part of the Team Breaking the story. A current candidate, a mouthful of panelist introduction and a mouthful of the story, ken. I want to give you the chance to explain the other piece to this which is kushner may have known more about wikileaks contacts than he admitted under oath in his interviews with congress. As soon as the Senate Judiciary Committee Said there was a russian back door overture that Jared Kushner failed to disclose, we all set about trying to report on what exactly that was. And the answer finally emerged from sources today that it involved this character who is the deputy head of the russian bank and accused of having mob ties. He denies this. Why i think this matters according to our reporting kushner rejected the idea of a meeting with this guy. Then he shows up at a private dinner with donald trump jr. At a National Rifle Association Event in may of 2016, around the time all the emails were happening. Apparently he did succeed in infiltrating into the trump inner circle. He has these alleged criminal ties he denies. Whats also important kushner failed to disclose this according to the Senate Judiciary committee, failed to disclose he was on this email chain so another in the latest round of disclosure problems for Jared Kushner. And wikileaks on wikileaks Jared Kushner was asked in his testimony to the congressional committees whether he was aware of any contacts, any Campaign Contacts with wikileaks, and he said not that i know of. We know from the reporting in the atlantic confirmed to us by sources today that don junior forwarded an email to him about his contacts with wikileaks on twitter. This is where there is a big difference between testimonial forgetfulness and evidentiary forgetfulness. Im not just speaking that way because i want to be as annoying as possible. Im speaking that way because lawyers know it is possible, as Jared Kushner and others have said, i get so many emails i didnt remember it, i didnt remember it on the spot. If you want to be kind you can give benefit of the doubt to that testimonial forgetfulness. Walk us through from your view as a prosecutor and one who has handled these matters why it looks so much worse with email because youre not on the spot. You have a team of lawyers that can go through the emails and are supposed to fork them over. Thats right. In terms of answering questions in front of congress one of the questions i get from folks on twitter all the time is how do they keep saying i forget this, i dont recall that, how do they get away with that . The truth is in order while its a crime to testify falsely before congress or to lie even to an fbi agent, you have to prove that the person knowingly and willfully did so. So, for example, if he says i didnt if he told congress i did not communicate with wikileaks or i dont believe anyone in the campaign did and now you can see he was forwarded the dms, he can say i forgot. I get a million emails. I totally forgot. And the government would have to prove beyond a reasonable doubt. So you talked about doubt a minute ago. Beyond a reasonable doubt they would have to prove he knowingly and willfully was lying when he made that statement. Whereas, on the other side you are talking about, ari, if youre disclosing if you fail to disclose emails you do have, thats going to raise a lot more questions. As you point out, you have a team of lawyers, Jared Kushner is able to afford and has hired some really highpowered lawyers to look through this stuff. And so its going to be very hard for them to explain why they did not produce documents that were requested by congress. Let me bring howard in. Howard, the other guy has big questions. You get the simplest one, no offense. Well, thank you. Theres a thing called control f and you can control f for wikileaks and make sure if youre looking for it, it exists and hand them over to congress if they ask for them. Why dont you walk us through how Chuck Grassley got mad enough about this to be involved because hes a republican. I dont think hes going to be just willynilly about this. No. And when congressional committees, especially ones with subpoena power and investigative duties on the hill, ask for documents, they want the documents. And you either produce them or you dont produce them. Its not as fuzzy as you were saying about recollection. There are subpoenas that you can issue for documents, and thats really whats at stake here. But the larger picture we see increasingly numbers of areas where the investigators both on the hill and bob mueller are looking at areas of possible collusion. Youve got that meeting at the trump tower. Youve got the relations with wikileaks which is presumed to be a russian front and has been called so by the american intelligence agencies. Youve got Jared Kushner increasingly looking as a center of traffic, if you will, of possible russian connections. And youve got the campaign meetings. You remember pthis is like a disease spreading in different areas. You look for hot spots and miller and others have more of them now than we knew about a month or two ago. So speaking on that, then, ken, what is the plan moving forward on the congressional investigation side with this issue . Well, they want Jared Kushner to come back up and testify. Youre saying they want Jared Kushner in a way they didnt before to come back. Thats how big this is . Oh, yeah, absolutely. No, this is a big discrepancy on the wikileaks thing and the disclosure issue. Ive heard from a lot of people who really want him to explain in particular his testimony on wikileaks, how he can say he was not aware of any contacts between wikileaks and the campaign. And, howard, sometimes you have an extra meeting with someone because you miss them. You want to see them again. This is a little different than that. Yes. And, again, its about how come you didnt produce the stuff you were supposed to produce . And thats crucial. As you know as a lawyer when you ask for documents, you either turn the documents over or you dont. If later people find documents that you didnt turn over, that is a much more clear cut case of lack of cooperation with investigators than a lack of memory. Ronato, final thought . Sure. I suspect kushner will be able to get off the hook with congress in terms of criminal or more serious liability, but they should be asking questions. Reporting he push back on key players including personally lobbying sean hannity allegedly telling him, quote, to shut it down over allegations of, yes, lets remember, pedophilia. The report comes amidst hannitys back tracking because he had talked tough about moore and set that 24hour deadline and then backed down. Bannon leaning on conservatives and telling them allegedly to, quote, back off. Arguing, though, that did not hurt trump. Its a litmus test. They knew he was doing locker room talk and they dismissed it. Howard fineman in washington, at the top of the show we covered a lot of this on the ethics and hypocrisy. I want to talk to you about the narrative. He is saying something there ma may be upsetting to people is it true or did it hurt donald trump that he got fewer votes than the first woman nominee running, that he has the lowest approval rating, that we are living through weird times, yes, but maybe the bad stuff and he became president . I appreciate talking about the narrative here, ari. This guy is a puppet master. Steve bannon . Steve bannon. All he has done over the last several years was create false narratives, and so, yeah, i think that to your original question it absolutely hurt donald trump. It didnt hurt him enough to keep him from becoming president and the fact he would sit there and try to spin this as well, these conversations about assault and pedophilia and just harassment of women generally dont actually matter and people dont care is really problematic, and he is absolutely the guy focused on the narrative and that is what is so problematic about this. And, howard, id love to get your thoughts on that as well as listen to this exchange in the white house briefing. Steve bannon is sending a strong message to the establishment to back off roy more. Is it affecting his response . The president doesnt have an ali johns to steve bannon. He has an allegiance to the people of the country. Has he spoken to him . Not that im aware of. Howard . Steve bannon doesnt feel threatened by donald trump. He ran roy moore and won the primary. I would expect bannon to be down in alabama walki ining with hise as he plays Winston Churchill of the deep south in his own mind. I dont get the reference but it is evocative. He wants to take on the he wants to take on the establishment. Roy moore is his way of doing it. He would rather lose with roy more than go begging to the white house on this. Donald trump is going to help up to a point, but hes certainly not going to take on steve bannon directly, i dont think. President trump has already lost that ball game. He committed lots of time and effort and money to try and support luther strange, and bannon rolled him in alabama. Donald trump, i think, is going to stay away and hope that roy moore wins the race. Howard makes a point about the shrinking role of donald trump who is the president of the United States. But there is a mall cop at a distance thing here where from far away is that a big cop and if hes yelling at you and then you get up close, no, its a mall cop and its different than being a police officer. And donald trump went around the country yelling at everybody what a great, powerful businessman and how he would reform the republican party. He was telling people were going to join the swamp. Were good at this. Actually its the Steve Bannons and local alabama republican officials that are running this game and donald trump has had his larynx removed for eight days because he has nothing to say. I think were realizing donald trump didnt win an election. He was the guy in the right place at the right time and there are a whole lot of other puppet masters including Vladimir Putin and steve bannon is rubbing that in his face. One thing i want to highlight we are still playing politics and letting all these guys poke out their chest and dance with one another or not and the truth is nobody is really acknowledging these women who are coming out and speaking out. The fact there was a rally of these women who didnt even acknowledge the fact there are several women who are in pain, right, who have allegations that are true, who experienced something hurtful is really important and it matters and people are watching that. And so i think that part of the narrative does matter, the part thats not there, women all over this country are seeing that and hearing that and hearing whats not being said. I think its going to hurt the republicans in the 2018 election, the fact they have no empathy, they dont care about women. Its going to come to bite them at the end of the day. Its a point that requires more meditation but is a fitting one to stop and reflect on. Thank you both. I saw the playbook about how this was going to be sold as a tax cut because they know they fundamentally know, all of you do, the public knows when republicans are in power, the first thing they want to do is give tax cuts to the rich. Its in their dna. Its what theyre going to do. We know that. They fundamentally the chairman laughs but he knows over 40 yearss always true, the public fundamentally just intuitively, viscerally understands thats what theyre going to do so the tax cuts are not going to be for the middle class no matter how many times they sing the song. How many times do we do this before we learn this . Listen, ive honored you by allowing you to spout off here. And what you said was not right. Thats all im saying. I come from the lower middle class originally. We didnt have anything. So dont spew that stuff on me. I get a little tired of that crap. Here are the numbers. The bill would raise taxes on most americans making less than 75,000 by the time all the changes run their course through 2027. Now if you are a member of Donald Trumps family and watching right now, just a few people, you would get a break of ultimately over 1 billion. Claire mccaskill gave senator hatch the business about real cuts to medicaid and his fake news. So, in order to save these poor people 43 billion, youre cutting 364 billion if you would just yield for a second. There are no cuts to medicaid in this bill. I beg your pardon, this is the cbo, mr. Chairman. Im reading right off the cbo. 179 billion in reduced medicaid subsidies. Well, there are no cuts. Beg your pardon. Thats where the money is coming from. Where do you think the 300 billion is coming from . Is there a fairy dropping it on the senate . The money youre spending is coming out of medicaid and subsidies to people who make less than 50,000. So youre trying to shop this baby like youre giving a 43 billion savings to people who make 50,000 a year. You can see why this matters. Now the committee that was meeting there passed this bill. No democrats supported it. And here is one of the most important and under reported developments in this whole week weve had. As i mentioned at the top this same bill would destroy a key part of obamacare, the individual mandate. Some estimates say that would ultimately result in the loss of health care for 13 million americans. To put that in Claire Mccaskills words, a lot of people would suffer unless a fairy dropped some new plan on the senate. And this tax bill could end up as an Obamacare Repeal bill. And when you get to the issue of who else knew about this beyond the individuals who were charged, you have sort of an institutional wide scandal, the equivalent of roger ailes and bill oreilly at fox news. I think at that point you have a big issue in 2018, which is that whole place, this has been for years, is a kind of club where theyre protecting each other, and its our money and our representatives. We saw this with Police Accountability issues where you find out taxpayers are funding the compensation, which is not typically the purpose of giving someone a cost or a fine.
