Were following breaking results out of ferguson. This is the scene there now where you can still see smoke billowing from the charred remains of a Public Storage unit. Near the police headquarters. The street is lined with charred remains of buildings after a night of anger and unrest. Two police cars were set on fire. Police officers fired smoke bombs and then tear gas. A dozen businesses were damaged, destroyed or looted. A total of 82 arrests were made overnight. 61 of them in ferguson. Many for burglary or trespassing. What ive seen tonight is probably much worse than any night we had in august. I said several months ago during an interview, what could be the worst possible thing that could happen . I said to tear the fabric of this community apart. Frankly, that has happened here tonight. We should point out that last nights violence was limited to a small area and there were many peaceful protests. This was the scene this morning in nearby clayton, missouri, where some of those peaceful demonstrations took place. Churches have also opened their door to service safe places where people can go for medical services and receive counseling. Lets go to zach roth, live in ferguson. Have things coupled down overnight and whats the scene there this morning or this afternoon . Reporter joy, its been a morning of kind of picking up the pieces, literally, after what we saw last night. I just drove down south florissant next to the Ferguson Police department. Theres a whole row of restaurants and stores, that have had their windows smashed in. Its a line of people putting up plywood boards. I spoke to a beauty operator saying she didnt put up boards. They thought it would provoke peek. Unfortunately, her front store is smashed in and people looted a lot of the products in there. The other feeling is theres a sense of frustration with the process as it played out last night. I just spoke to a woman in starbucks saying, it appeared like the prosecutor mccullough was acting as Darren Wilsons defense attorney rather than looking out for the interest of Michael Brown and his family. Its kind of those two themes running through it this morning. What about the decision to have the announcement so late at night, 8 00 central time 9 00 eastern time . Business owners that youre talking about, whether or not they decided to board up, did they have any comments or have people in the community had any comments just about the way the announcement was done, the timing of it . Reporter in the days leading up to the announcement, they wanted it done in the right way so people wouldnt be out on the streets, so they had advanced warning. I think that may have been what prompted them to do ist in the evening, to avoid rush hour when people were out. What ended up happening was, it was already dark, it was night. There was a feeling that kind of provoked some of the anger and violence, and some people saying, this is their theory, of course, saying we think mccullough did that on purpose in order to provoke a reaction of violence, thereby, discredit protesters. That decision definitely adding to the sort of sense of suspicion and frustration about this process. You talked about some of the businesses, people who were making decisions about what to do, whether to board up. On ronan farrows show earlier, one person said police spent more time protecting businesses in clayton and not enough actually Police Officers that were protecting the businesses actually in florissant. Did you get any sense of whether people felt that the Police Presence was actually sufficient to protect their property and interests . Reporter it certainly was not on the south florissant strip i was on last night. There was a heavy Police Presence outside the Police Department and at other times a few different intersections. A whole strip of stores and restaurants left entirely unguarded and all had their windows smashed in. I think people are people have a lot of questions about how those officers were deployed. All the individuals i saw, reacted calmly facing protesters, protesters yelling slurs and offensive things. Most of the protesters were not doing that but a few were. The officers handled themselves professionally. There did seem to be issues with how they were deployed and where they were deployed. A short time ago attorneys for Michael Browns family held a News Conference in st. Louis where they blasted prosecutor mcculloughs decision to call a grand jury and not appoint a special prosecutor. They were joined by Michael Browns father, who did not speak and the reverend al sharpton, president of the National Action network and a host on msnbc. Let the record be clear, you have broken our hearts, but you have not broken our backs. We we are going to to continue to pursue justice. The National Action organization has organized rallies at federal buildings in cities including chicago, atlanta, and brooklyn, new york. The protests last not were not just confined to ferguson. Demonstrations took place in major cities nationwide and even more are scheduled to take place at federal buildings today. In new york about 1,000 demonstrators flooded times square while others tried to shut down the three major bridges. One man was arrested for tlo throwing what appeared to be red paint at Police Officers, including Police Commissioner will yan bratton. Hundreds of protesters blocked both east and westbound lanes. Police were eventually able to clear the freeway and several arrests were made. In the nations capital, protesters marched to the Supreme Court building. In a crowd of about 500 people gathered outside the white house to protest the grand jurys decision and to hold a moment of silence for mike brown. While inside the white house, president obama called for calm. I join michaels parents in anyone who protests this decision to do so peacefully. For more on the president s reaction, lets go to nbc senior White House Correspondent chris jansing. We know the president will be in chicago today. Fergusons only about 300 miles away. Any chance he will go to ferguson . Reporter not today. Theres a very practical reason why. Obviously, any time the president makes a visit, it requires the cooperation of local Law Enforcement and they obviously have their hands full in ferguson right now. The president also doesnt want to focus a lot of attention on the things that went wrong. The question s is there a reason he could go at at a time to focus on things that have gone right. Heres what he said last night about whether or not he would go to ferguson. Lets take a look at see how things have been going. Eric holder has been there. Weve had a whole team from the Justice Department there. I think they have done some very good work. About building relationships between police and the communities they served. According to your reporting, is the Administration Planning to do anything to push that along and help that happen . Reporter this has been a priority of eric holder and the Justice Department. You heard the president just allude to it, which is the day after the shooting happened, they sent a team from the Justice Department and theyve been on the ground since then, working with the local community, trying to help to bridge, in particular, the relationship between the community and police. Its something that they think is important throughout the country, that the president talked about last night. He talked about something called best practices. They know a lot about the programs that work and they want to enlist local Law Enforcement, local Community Groups to work on that. I know there has been some frustration within the Justice Department that some of the help that they have offered and some of the expertise they have they felt was not used by the folks in ferguson. Thats something the president would like to expand. I dont know if you can hear whats going on in the background. The president marine one is just lifting off and hes heading to chicago. We continue to follow the protests going on in ferguson, missouri, and the reaction arent the country. Right now we want to look at the evidence the grand jury actually saw. In particular, the newly released testimony of officer wilson. To evaluate the critiques from those who say there was enough there to diet. Lisa bloom is an attorney as well as a today show legal analyst. Lets get into this Darren Wilson testimony. Ill ask you, what stood out to you most about Darren Wilsons testimony to the grand jury . As you know, i stayed up most of the night reading it. I read it a couple times. I also read it against his police statement, which has also been released. Theres a number of inconsistencies. The biggest thing that simprumpz out is prosecutors who arent prosecuting. Who let the target of the investigation come in in a very friendly, relaxed way and simply tell the story. Theres absolutely zero crossexamination. Crossexamination is the hall mark of our society. Its the crucible of truth. I dont say that to use flowery language. Thats how we get at the truth. Darren wilson, as you see in these pictures, for example, doesnt have any obvious injuries. Maybe if you look closely, a tiny bit of pinkness on his face. Thats completely inconsistent with his story that mike brown, with full force, he says, punched him twice solidly in the face. Big, strong, mike brown. Inconsistent with his injuries. Hes not crossexamined about that or anything else. At one point we were having a side bar, you were saying i know this is hard for you, something the prosecutor asked. Doesnt sound so adversarial. These claims about the hard punches and the attack inside the car, he called mike brown hulk hogan. He said he felt like a 5yearold going up against hulk hogan and another point he described him as a demon. He says, this is my car door, i stepped back, and the only way i can describe it is it looked like a demon. The description of mike brown as almost a wild beast. Yes. Then does he explain how that led to the six or so shots that actually killed mike brown . Yes. He clearly paints a picture of mike brown as this super human, demonic monster. Keep in mind that officer wilson did not have to give any statements to anyone until he first spoke to a lawyer and got to review all the evidence. You have to wonder if its information he came up with his lawyer. I also would tell you, joy, one thing that really, really deeply disturbed me was his testimony before the grand jury we are says, theres a lot of gangs that reside or associate with that area. Theres a lot of violence in that area. Theres a lot of gun activity, drug activity. It is just not a very wellliked community. First of all, this is completely objectionable legally. You cant paint somebody with a negative brush because of the community they reside in. But it really gets you into the heart of Darren Wilson. Hes pretty much saying straight out, i dont like the people that i am serving. I dont like the people in this community. They are not well liked is a passive way of saying, i dont like them. This is very Fertile Ground for xr crossexamination. Any trial lawyer would say, what do you mean about that . Do have you any hostility against the community . These prosecutors dont go there. Another part of the testimony where wilson claims that mike brown charged at him. Now, keeping in mind that Michael Brown was wearing flipflops and socks but he depicts him as charging at him very fast. Were you able to glean from that and other testimony, another witness said he, too, saw Michael Brown running toward him, the distance between the two when the fatal shots were fired . No. I handle excessive case forces, i know how to do it and its not all that complicated. What you do is you get the person whos accused of Excessive Force to break this down nano second by nano second so you can test if the story is true or not. This issue about charging, which i find to be a racially tinged offensive word in and of itself, but i would have asked him, what exactly does that mean . At one point he says mike brown took a step forward. Another point he says, he took a hop, as he was going to run and then he began running. Which is it, mr. Wilson . I mean, you really have to get to the bottom of it. You cant let an ambiguous word like charged get out there to the grand jury without analyzing, it without crossexamining it. Having gone through all this evidence, staying up all night, would there have been enough to bind it over for trial . If this were any other case and you have a couple eyewitnesss who say this young man was shot with his hands up, that is more than sufficient for probable cause. You bind him over for trial. The one question that this prosecutor was never asked is why was this case treated differently than all the other defendants in the st. Louis area who are mostly black and brown. They did not get the breaks Darren Wilson got. If i were accused of a crime, i would like to get the Darren Wilson treatment. I think a lot of people concur with you. Lisa bloom, thank you very much.
