Good morning and happy new year to everybody and id like to thank any fellow commissioner walker for chairing for me last year, i of the out but all good here Going Forward welcome to the wednesday, january 18, 2017, bic so a few announcements so start off the meeting wish everyone to a happy new year and welcome to the department of building inspection my announcements will be belief the commission wanted to acknowledge the staff over the last month, a big thank you to ed screening who helped to get a Construction Permit approved he said he was glad to know that San Francisco as a dedicated public to the citizens so thank you on that and thanks to joe duffy of Inspection Services that got a letter for taking the time with a complaint and that was actually forwarded to dpw regarding a wood playthings becoming dangerous during an upcoming storm the customer said that is an example of a apply employee going above and beyond and madam secretary thats the biggest set of compromises. The statement of work is the highest priority thats basically the update im here to take your questions as well. Commissioner walker please. So when will we have our path forward at the next meeting the next meeting that will tell us how much it will be and how long that will take. Assuming the state negotiation are for the pro transacted well have them by next month. Okay. And the funding process; right . The work once we have a real dollar figure well know what paths to take to secure the funding well definitely assuming no bids to pickup in the negotiations well have this plan by next month. Still trying to keep the dollars figures low to have fewer hoops to jump through. Commissioner. My name is jerry i on the materials for this discussion item were very good i have two questions the first question is of the 70 requirements that currently out of scope are any of those requirements critical to the operation of the be would you mind if mr. Gregory comes it would be good conversation that would be two points thank you. People in having the discussions throughout the week again, we walk in with eyes wide open i dont think their critical but lets have that discussion throughout the week and let the business weigh in. In our words 70 out of 2000 you said is that a big number. No. No; right . Totally within the realm of give and take and open communication with the vendor. Okay. And the next question was the next question could we go out of 80 you know bringing a timeline throughout the course of negotiation trying to bring the timeline and looking to see if theres any possibility one of the key driving factors we need businesses to resume after the cut officers what did we leave out the Complaint Processing or certain types of permits; right . At first, it didnt look like there is look like we can move from the scope but looking at them closely and trying to have the discussions as we have the negotiations over the next few weeks thank you. Thank you commissioner president mccarthy this is an issue that has come before the public our department i think is got some really forwardlooking programs that are assisting especially with the tenant displacement so we want to make sure that all the department revolved in the process come and talk about the process and see what we can do to support making advances here and understanding resolutions to some of the buildings in securing housing thank you very much for coming in good morning Deputy Director Inspection Services im here to present today a Code Enforcement process dbis mandate to insure the safety of residents and buildings throughout the city safety remains the number one priority recent intersections with the result of public complaint and city referrals by dbi and City Attorney inspections since december 2nd dbi has 9 complaints referrals for possible safety harasses conditions and what is your were attended an educational workshop for the Fire Department on january a meeting to the Bravo Theatre xhaushg was in attention and the Fire Department the Fire Department were doing outreach out there trying to talk with the people to make things safe and given out fire extinguishers and give out smoke detectors there was a preview outreach moepg and had chief to answer questions for the safe conditions and wanted to let them know we have an open door policy you can b talk about any issues their unanimous we to investigate the complaint. So work with the tenants and owners and asking owners to visit us on mission and if you have questions we consult the Third Party Contractors for life safety issues and the outreach partners to sites before code compliant are clear to help the tenants weve been working with the Housing Division and were encouraging the outreach groups go up prior to our investigation and outreach. When we have a complaint we have to follow the Code Enforcement process we have a chart of Code Enforcement process and im sure your familiar if you have any questions i have to do the inspection if this is a violation we have to look at that and theres a director hearings whether an order of abatement or return to staff during the notice of violation we can work with the owner as long as their showing us a path forward we can work on the issues working closely is City Partners working closely with other citywide coordinator efforts to work with customers that are in need of abatement and enabling the funding to focus on fire safety weve increased that funding about 100,000 we also provided 2. 2 million in the creation of a proactive Safety Research program with the Fire Department over a two year period they can speak on their behalf for this outreach. Morning commissioners dan Fire Department fire marshall thank you for the opportunity to speak before you today id like to provide give you a little bit of background hopefully not too borrowing our scope in the Fire Department how that aligns with intifshgs warehouses to begin with our Authority Comes from the health and safety and the occupancy fire marshall that are adopted f and regulated by the state Fire Marshall Office we enforce the life safety codes those occupancies are a eir c and educational and schools and institutions to be hospital jails and certain types of boarding houses and misrepresent singlefamily dwellings and l labors a lashes not Public School the list is s f is m and b it is Storage Facilities m mercantile and b is business as in factories 3 didnt fall under our injured unless part of that actually then we get involved keep in mind what types of inspections we conduct inspections for any permits associated with those occupant so Construction Permit well be involved operation their regulate operations about 40 of them public assembled with one of them San Francisco youre required to pull a permit for one of the regulated activities also, we conduct annual inspectors their owl rh1 and rh2 misrepresent residential unit we have 5 thousand units 9 units or greater condo and apartment buildings e, etc. The buildings that are 3 to 8 under the housing section realm we inspect every highrise 6 hundred highrises in San Francisco we inspect schools three hundred plus in San Francisco and jails we inspect every two years thats our mandate what we are required to inspect so oh, part of inspection is whenever we receive a complaint from an agency or public or the Health Department we respond to any of those referrals that are forwarded to us so how does that all align with chairs warehouses well see if it is brand new facility well only plan site plan for Fire Department assess and Fire Department water supply thats it the rest is on the actively if youre Storage Facility your 12 feet or hire you need a highrise permit well inspect so this date 15 in San Francisco we inspect annually and warehouses are warehouses safe they absolutely are safe when used and designed and permitted when theyre not safe when you change the use with with the going though the process the design plans comply with the code of the building and Fire Department with respect to the warehouses weve received 15 complaints we received 3 internal complaints and 12 referrals the referrals are from the Fire Department weve issued 3 orders to vacate order to vacate if you look at the fire keyed code the fire code states let me state this we cant be less restrictive we cant be less reflective fire code states in any illegal change of use with equipment the building shall be deemed unsafe period any adequate exiting the building shall be deemed unsafe in the fire wed coding another question an unsafe building we know the facility is unbeknownst safe does that end there in our opinion no if it is illegal change of use to a more hazard use from a Storage Facility to a Public Assembly or to a residential thats a more hazardous safety of the people in the building so if you have an illegal change of use and a compromised egress with a number of exiting is the inadequate if there were an event in our opinion youre likely not able to get out thats where we order to vacate to date all 3 are abated weve been working with the City Attorney with newcomers phone calls and were still working on that to refine that process we want to be fair and consistent with the understanding that our first mandate is so keep people safe the other thing id like to say we have questions how much time a week or two months i hear 60 days, we in San Francisco over the last 10 years two to three construction fires a year on average so in the Fire Department opinion if you have an event in the building next week and you have people four or five will not get out thats the question that we struggle with we take to it very seriously and understand that people get displaced first and foremost thats our main goal ill be happy to answer any questions you may have. Thank you so much for coming this is obviously that is an important issue for a lot of us in the city and even in the bay area the when you determined when i issue an order to vacate was it in the 3 buildings pause the assembly use or because of residential use telling me what okay spurred your one with both an assembly and residential above and the other ones were residential. You know theres been suggestions hey walk through do an inspection and tells you if it is safe lets contact take a 5 thousand square feet warehouse for example, a factor of 5 hundred per person designing that occupancy by design all any safety features to protect the egress now a Public Assembly any factor is not 5 it could be 5 or 7 or 15 now im designing the building for 3 exits and certain types of hardware with the doors, etc. Not so easy to walk in and say its safe thats why in my opinion when the fire code states an illegal change of use we assume that is unsafe not vetted and not reviewed the other was a storage area with 1 beds with styrofoam walls dividing the bedrooms and less than 7 feet with sheetrock exposed wiring and tapes, etc. Bars on the window if theres a fire youll not going to get out what that in mind when you have a fire it is not easy to move most fires most people woman by smoke you cant see your hand in front of your face youll not know with the door is does that answer your question. I have a question which is more suggestive if we as a city involved more in the Code Enforcement program you think that can help situations that program can outreach to the owners and up to code before you get to inspection. Thats a difficult question ive been asked did question what concerns you what concerns me is not what we know that goes a long way to knowing what we dont know, however, from the owner has to go through planning for a change of use with the zoning we dont know essentially your issuing a occupations i think to our the if we Work Together to build fire and planning came up with a program to address all the buildings and have some kind of system in place where speed up the process so people are displaced would minimize the mind as much as possible. Okay. Thank you thank you a quick question just so the 15 complaints you got norman in my given year what is the level of complaint. We dont get those complaints that is all new we dont get them a couple a year at the most we dont get them. No. You dont get them. Were getting more and more complaint and commend the Building Department i hope all the department will deter all the information this is relatively a new issue were dealing with. Commissioner lee please. The origin of those complaints are they from people around the warehouses or People Living in the warehouses. I can speak to the 3 we received directly i cant speak to the Building Department we were referred to. One of them was one of our Engine Companies responded to a medical and it didnt look right or safe this looks like a ghost ship we responded to and an arson team members without outofsight and noticed an issue we get internally and then one, if a complainant from the public we get a mixture. We have had existing buildings for many years and your people go out through i mean it is a tough job to make the decisions i guess the question is would you are you more aggressive than in the past or the same policies i know that is a delicate question because of displacement in the warehouses a major
