And if this is not a tullys and expanding to jason spot were hearing that. Yes. Section 178 describes the situations where a formula retail use operator can convert from one use to another and allows for formula retail use of the same type to enjoy that nonconforming status with the conditional use authorization so if tullys wanted to be base hardware thats not the same thing. Im generally supportive of that i actually go around the world with my iphone and take a picture of starbucks bylaw is hardly a starbucks so i am generally supportive. Commissioners there is a motion and a second shall i call the question. On the motion with conditions commissioner antonini. Commissioner johnson. Commissioner richards commissioner president fong. So moved, commissioners, that motion passes unanimously 4 to zero which will place us in general Public Comment there are no speaker cards. Any general Public Comment . Seeing none, meeting is adjourned. Thanks. Perfectission regular hear wednesday october 7, 2015. I would like to remind the public that the commission doesnt tolerate any disruption or out burst at any time and please silence all cell phones and if you care to state your name for the record. President wolfram. Here. Vice president hyland. Here. Commissioner hasz. Here. Commissioner johnck. Here. First item is general Public Comment. At this time members of the public may address the commission within the subject jurisdiction of the commission and your opportunity is when the item is reached in the meeting. Each member of the public may address the commission for up to three minutes. I have no speaker cards. Does any member of the public wish to speak so a non agenda item . Seeing none Public Comment is now closed. Great. Commissioners that places us under department matters. Item 1 directors announcements. Good afternoon commissioners. Just one item i thought might be of interest to you. Last week the mayor introduced legislation called the Affordable Housing Bonus Program which is legislation that will allow density and if necessary height in return for additional Affordable Housing units. This is one piece of a much larger package of policies and legislative actions that we are putting together to try to address the issue of Affordable Housing. This is a two piece program. There is one piece that would allow us to comply with state legislation which requires us to provide additional densities for development that does provide Affordable Housing. There is a second piece of the program that is designed to Incentivize Development for middle income housing. This will apply to many parts of the city where we havent done area plans in years, places we didnt change the zoning in a long time, so we think its a program thal create incentives and pools of Affordable Housing in the city in areas that havent seen a lot of development and growth. The impact on Historic Resources we think is minimal. Conceivably would allow for additionos existing buildings. We think its more likely to be new development from the ground up but if youre interested were happy to have a hearing and get you information about the program. Thank you. Commissioners if there is nothing further we can move to item two, past events of the Planning Commission staff report and announcements. Commissioners time frye staff and a few things to share with you of updates and housekeeping things. I wanted to give the advance consent calendar for the cultural hearings and we will have one in november and december. It is my understanding were moving the november hearing to the 18th to accommodate commissioner matsudas schedule. Right now we have lined judy from the Sf Arts Commission to talk about the cultural program. This was a request by the committee a couple of months ago and shes the Program Director at the arts commission. Does december 2 members from supervisor campos office as well as regina from the office of Small Business will come and present an overview of the legacy business Historic Preservation ballot fund measure and the assumption is if it does past we thought it would be great to have an overview before it goes into effect with the commission since theres a rule for the commission as part of that ballot measure. The University Mound ladies home is scheduled for a Land Use Committee hearing. The Committee Hearing will be on october 26, and the Department Staff will be there representing the commission on that proposed designation. Also last when we there . September 28 Department Staff, myself and ms. Shannon ferguson we attended a buildings grounds and services Committee Hearing at the board of education. This was to give the board an update on the proposal to locally designate washington high school. As you recall that supervisor mar gave the department 10,000 to hire a consultant to prepare an article 10 designation report for that high school. The committee was very interested in the report and eager to work the commission and forwarding the designation they did have a number of questions how a designation would affect a state owned property like a high school, and we agreed just to keep them in the loop, invite them to a future hearing. Once this Commission Takes up the matter and we will go back and share the designation once consultant has been secured. There was discussion on including Roosevelt High School since its the same architect and likely period of significance, so there maybe an expansion of the designation and i will let you know as more information is available to us, and if we can secure additional funding for that part of the project. And then i thought there was one more thing oh, there is one more thing. Sorry. Yesterday this is more just for your information. Yesterday at the board of supervisors, supervisor breed introduced an amendment to the fillmore sign ordinance and primarily to allow Entertainment Venues like the fillmore to install signs that are much larger than what is allowed today. The department is supportive of the measure because we feel it helps define neighborhoods much like the castro theater sign defines that area and currently the sign requirements do not allow for signage in excess of 24 feet, so we were able to work closely with the Supervisors Office in drafting criteria to make sure that residential windows arent impacted by flashing lights or bright lights from one of the signs and that the architectural features of the buildings wouldnt be impacted either. We dont anticipate this will come to the commission for review and comment but if youre interested were happy to reach out to the Supervisors Office to see if theyre willing to present. That concludes my up dates to you and happy to answer any questions. Commissioner hyland. Commissioner matsuda. No, no im sorry. I just wanted to ask. You were referring to roosevelt middle school. Yes, middle school, thank you. Commissioner hyland. Yes mr. Frye when the Cultural Assets meeting for december has supervisor campos update could we ask his office to update us on the legacy registry legislation. Yes. And there was a deadline of december for the Small Business commission to do some recommendations. I would like to know what the status of that is. Okay. Or have that in advance of the meeting. Yeah. And i had a question for you related to past events of the Planning Commission. This commission wrote a letter regarding the 5m project at the time we saw the preliminary draft eir mostly regarding the demolition of the building of the name i cant remember and look at that and i am wondering if that project is now approved and tell us what happened with that Historic Building . Certainly and that is a large item to neglect. I apologize. And i will certainly get more information. I believe youre talking about or referring to the camline buildings. Thats right. I dont recall the specifics that occurred at the hearing, but maybe mr. Ram is able to fill that in but i know from discussions with the project sponsor we were able to confer the preservation of the building and as part of the central soma survey and the area plan we are now proposing that building be designated under article 11 of the code so once the area plan moves forward and comes to forward for neerkz you will see an initiation to protect that building and as you know heritage was very initial in providing influ yecial and protecting that project. The Planning Commission approved the smaller alternative that allowed for the retention of that and i think a couple of other smaller buildings in the process. Okay. Thank you very much. Commissioners that places us under commissions matters. President s report and announcements. I have no official report but i want to tell the audience were planning on moving item 12 to the ging of our regular calendar. There has been a request for a continuance from the submitter of the landmarks report and make senses to take it up as a regular item before item 7 so item 12, the item 11. Im sorry. No, item 12. Or is my calendar out of date . Youre looking at a draft. Okay. Item 11 which is at 815825 tennessee street will move forward before item 6. All of the numbers are off. Sorry about that. Commissioners if there is nothing further we will move it to item 4. Consideration of adoption minutes of september 16, 2015. Commissioner. Yes, i have a suggestion. My recollection is for the Hunters Point informational presentation we had a recommendation to denor and the staff lenore and the staff here of what we would like to see in the future with Hunters Point and my recommendation is that the minutes include or sentence along the lines of commissioners expressed great interest in the plans for the Historic District at Hunters Point and would like Progress Reports from lenard regarding i know we were interested in security, interim reuse opportunities and potential preservation of buildings [inaudible] so thats the sentence i would suggest adding to the minutes if that is appropriate. If its too much detail we can narrow it down but do you agree with that . Totally and we clarified what security meant and not only physical security of the premises but the longevity of the building being [inaudible] stabilized so it doesnt deteriorate. I am wondering if a member of the commission can confirm is the name spelled correctly . [inaudible] so mr. Turney is churny . Its item 6 on page three of eight and it occurs in numerous places there. Cher . Just a point of clarification. Theres no e. Its just y at end. Yes. Yes, i believe thats it. Its not the [inaudible] attorney no. Okay. Does any member of the public wish to comment on the draft minutes of september 16 . Seeing none we will close Public Comment and bring it back to the commission. Do i have a motion . Motion to approve yeah, second. Great. Thank you commissioners. On that motion then to adopt the minutes as amended and corrected for september 16. Commissioner hyland. Yes. Commissioner johnck. Yes. Commissioner matsuda. Yes. Commissioner wolfram. Yes. Excuse me, commissioner president. Yes. Commissioner. Yes. And commissioner president wolfram. Yes. Thank you commissioners. That motion passes 50. And places us under item 5, commissioner comments and questions. Any . Commissioner johnck. I have a question about the minutes and doesnt require a change in the minutes but about the Cultural Landscape inventory. We spent a lot of time looking at the issues that mr. Hasz brought up about the inaccuracies and wondering how that is going to be handled . In the revised report . Commissioners, time frye Department Staff. We have been meeting internally to talk about editing will be made without throwing off things and we got a revised edits to make them in house. I think we saw that that. He may have copied you on the email. I cant recall but he sent a follow up email which has been helpful. Our goal is have it done in the next month and send you a finalized report but we think we can handle it internally fairly quickly. Great. Thank you. And make all of the ed r edits suggested. Are there any disclosures commissioners . I received communication from Tara Sullivan regarding the tennessee street landmarking as well as members of the dog Patch Neighborhood Association. Ive also received an email from Tara Sullivan. So have i. Okay. Thank you commissioners. If there is nothing further we can move on to the regular calendar and the Commission President has requested to pull item 11 out of order so we will take that up now for case 2015oo 2015oo718 upon first at 815825 tennessee street. Thank you. Good afternoon commissioners. Shannon ferguson planning Department Staff. I wanted to clarify a few points regarding notification and meeting requirements for this type of hearing item. There is no required notice for this type of hearing item and i just wanted to also point out that the applicant was informed of the hearing date on september 29, 2015, and packets and hearing agenda were forwarded to the applicant and the dog Patch Neighborhood Association on october 1, 2015. Once it was published online. After several calls and emails with them the dog patch neighborhood respondod october 2 they would like a continuance. Regarding meeting for the landmark designation application this meeting is not a requirement. It is discussed in the application as an opportunity for the department to work with the applicant in case there are any Unanswered Questions questions or Additional Research requirements regarding the application. Given theyre two consultant reports on the property and the Central Waterfront survey form there were no additional questions to warrant a meeting. So this item is a Community Generated landmark designation for application for 815825 tennessee street. This subject property was designed by August Nordin in 1926 with bowie switch company and addition of william muser the second or third. The commercial building is located at the Southwest Corner of tennessee and 19th street. Its two stories tall with one story addition to the south and that is the tennessee street facade. The 19th street elevation has a partial basement due to the slope of the street and primarily one story with the second story to the west. The North Elevation has two signs. The property is outside of the boundaries of the dog patch Historic District. The Historic District boundary is actually across the street. It has been the subject of numerous previous evaluations and determined to be a contributor to the potential third Street Industrial district but not individually eligible for the california registrar. The Planning Commission approved this demolition with part into a five story residential unit with 69 units. The application lists the permits and ownership history, a description of the subject property and neighborhood, copies of patents by the original owner and photographs. Not include are things historical photographs and maps and drawings and other references. A statement of significance is provided for events, persons, architecture and as a valued visual landmark. So first the property is nominated for its association with historic events. Its nominated for the Cultural Association with ethnic workers in the area. Documentation does not support the unique role in the electrification of the United States as the first new technological enterprise of the bay area and early precursor to sill sill nor valley really and the property is nominated for the association with an important person who had dants on electric switches. Staff peoples that bowie switch manufactured the inventions in the building but invented and patented the products before construction of the building in 1926 so the important achievements are not directly associated with the property. Furthermore his roll in the development of Silicon Valley is unlikely. Its nominated for the classic architecture by architect August Nordin and represents an architectural shift in response to the shift from light to heavy manufacturing. Staff finds its not a strong example of strong revival architecture but example of utilitarian warehouse with minimal classical detailing and typical of the businesses in the area during this time period. Department staff agrees that hes an accomplished architect and designed buildings with revival styleornment and with heavy decoratives and this property doesnt appear to be one of the significant works. Its designated as a landmark and the two graphic murals on the 19th street elevation which you can see. Staff believes that the futures are signs, not murals. Murals genuinely serve as communicating ideas and hopes and aspirations of the people and alternative vision of history and social medium of protest. The features conform to the definition of a business sign while sign type with parallel copy painted directly on the wall. Staff acknowledge signs can be defining futures in some situations such as landmark 264, the twin peaks tavern sign but staff doesnt find its a feature based on this with documentation. Staff doesnt find that the property rises to individual significance as required under article 10 of the planning code for an individual landmark and doesnt appear to meet the Historic Preservation commissions priorities for designation and properties associated with under represented Cultural Association, property type and neighborhood and modern design. Commissioners you may take action today to add or not add 815825 tennessee street to the landmark Designation Program. Direct staff or sponsor to give more information or give landmark designation based on the application. This concludes my presentation and i am happy to answer any questions. Thank you. Go questions for ms. Ferguson . I think its helpful to for continuance on the item so when we go to Public Comment the public is likely to know if we continue it or hear it today. When do we need to decide . We can give a general sense. We need to hear Public Comment if there is a motion but if we are not likely to continue the item the public will know this is the opportunity to hear the item today that we will hear the item today fully and have discussion about it. Im sorry. I didnt follow why considering continuance . There is a request from the applicant and to continue it and theyre not able to be here today. I am in favor of hearing it today and i think the staff report was clear on that. Thank you for that. Im not necessarily in favor of continuing but i will hear others. Mr. Hasz, mr. Hyland. I would like to understand why they have a continuance . We have the information we need. Yeah, i personally know where i am going with this so i am happy to hear it today. Okay. I think we will hear the item today so i have speaker karsd from a number of speaker cards for Public Comment. The first is janet carpnelly and you will have three minutes and there will be a warning bell 30 seconds before the time is over. Good afternoon commissioners. My name is janet, president of the dog Patch Neighborhood Association. The reason we asked for the continuance because john lummus who is the applicant for us had a family emergency and had to go out of town. At any rate when this project came before us last year we believe that we were mislead by the then developer who said that they had gone through the historic evaluation again, and that though earlier the building was said that it is significant and that the whole building should be kept and the design should be made around it and thats what the original developer actually showed us, but we didnt get very far with that and they sold the project a year later. When they came in they reevaluated it and the only part of the building worth keeping was the original part of the building. Well, we thought those were nice people and honest, but having been inundated with tens of projects in dog patch over the years we feel like were a Quasi Governmental Agency looking at the projects and do our Due Diligence and we dont feel we can do that nor do we feel that the staff did the Due Diligence on reviewing those evaluations, so we feel that the building actually should be kept as the original historic evaluation said that the original building should be kept with the addition and that the two Story Building should be left, and any additions should be done around that. Unfortunately for some reason during the Rome Development evaluation they were still considering what tim kelly evaluation had said. He was strictly speaking about the entire two Story Building being kept when he said it wouldnt be a problem to demolish part of the building. He was talking about the later additions. That mistake wasnt actually taken into consideration by staff until much later and thats when tim kelly went back and tried to reason why even going down to the demolishing everything but the original building was okay. I dont feefl that was proper of the situation so were asking for a continuance. Thank you. Joe boss. Hello. My name is joe boss. I live in dog patch, worked very hard to have dog patch designated as a Historic District, and was successful at that. In the meantime im sure youre all aware there is a lot of Development Going on in San Francisco, and that dog patch and potrero hill under went eastern neighborhoods rezoning which i was involved in very closely and currently sit on the Citizen Advisory Committee for the impact fees, but as time has gone on the character of dog patch is slowly changing. I understand we need to refresh everything, and we have done a pretty good job with things like pier 70 and the ord an project and you know, but when it comes to the small grain individual buildings that made up dog patch as a industrial place theres little regard for it, and i think the neighborhood character is an important issue, and in this case i thought we had gotten there with rome and subsequent buyers, seller, blah, blah, blah, we are where we are. Unfortunately dog Patch Neighborhood Association is just an association of hard working neighbors, and we left the project for reevaluation in the hands of someone who certainly has a record of i would say not dealing with the minutiae of dealing with a Governmental Agency and although he is very passionate about saving the historic fabric and Everything Else the project was pretty well booted by his application that was not really listened to by the staff, and i know the staff is inundated with all sorts of requests and projects, but so i request that and you have already heard it today. We were hoping to get a continuance so that we could fix the difficulties in the application, et cetera, so thank you. Thank you. Jackie [inaudible] good afternoon commissioners. My name is jackie braver of Dm Development San Francisco. Were the Property Owners, and San Francisco bays project sponsors for the fully entitled redevelopment of 815825 tennessee street and acquired the property in 2015 and in the letter of support the dna supported the redevelopment plan for this property. We have shared that letter as an exhibit in the staff report and to the commissioners. On september 18, 2014 the cpe was published and approved by the city planning and preservation departments. In a publicly noticed hearing 815825 tennessee street authorization was approved by the Planning Commission. Mr. Lummus filed the landmark designation eight months later this summer. In june and july when we had meetings with the dna and introduction of the project and we enactod the request for Additional Information on the buildings historic significance and gaps in the reports that have been done, the 3hres done on the site. We commissioned tim Kelly Consulting and dated august 2012 and julie mais author of this and the supplemental one dated as listed to fully address the inquiries and offer their professional opinion as to whether or not any new information had been uncovered or unduring the entitlements and planning entitlements. We notified the department we would commission the studies and share our findings with the city staff after evaluation of the material. We informed janet carpnelly of the dog Patch Neighborhood Association we were waiting for some of the research and consupting the community and gain feedback from the city planning and preservation departments. Janet expressed she didnt feel that tim Kelly Consulting or at the time rotech were qualified consultants and encouraged us to engage another consultant, a third consultant which we did and left coast architectural history and on the city approved pool. He claims that the application he discovered new information not available during the entitlements. Is there is concurrence with the experts and three hres done and the reports we prepared and response to the inquiries included in the city staffs report. All four statements they they all concur that the statements are unsupported that the building doesnt hold individual significance but possession of strong cultural historic event and persons and associations. Thank you. Catherine petrin. Good afternoon commissioners. Im an architect url historian. This is a rather confusing matter so i hope i lend some clarity to understand the situation better. I dont have the background on the project going back as far as dog Patch Neighborhood Association. I was i am sure today at the request of Professor John lummus who prepared the application for lands mark designation of the bowie switch company building. He prepared the nomination on behalf of the dna. He cant be here. Hes out of state and wasnt able to change his plans. I think it would be far more beneficial for you to hear from him as the planner as the preparer of the application as to some of the nittygritty but i can offer my opinion about it, and just give you a little more background. I also think that a request to continue this might be the best way to go based largely on the process, and ms. Ferguson outlined the dates leading up to todays hearing quite accurately, but from what i understand from professor lummus he submitted his application on july 21. He was relying on the departments Information Online in terms how to hes a first time nomination preparer which i think is something to be considered. I dont think anyone has spoken to his professional qualifications but he is also a faa architectural professor at san jose state, but his understanding was following the departments process online, and it was his understanding that a meeting between himself as the applicant and hp staff would forthcoming after his submittal on july 21 to determine what information maybe missing or to answer any that staff may have. In addition it says online and all of the department process information that reasonable period of time is allowed for the applicant to respond and amend the application, and after that the application goes to the hpc. That isnt exactly what happened. I understand from ms. Ferguson who the departments thoughts are on that but he should have the opportunity to amend the designation. I also think that thank you very much. Kara fortune. Hi. I am representing tim Kelly Consulting and prepared the hre for the project. Primarily i want to go on record saying we support the staffs findings regarding this lummus statements of significance. The building is not within the dog patch district strict. The business designs were painted in 1983 so fall outside of the Historic Preservation realm of consideration, and mr. Lummus primary patents were issued a good decade before the building was built so its outside that period of significance. I also wanted to address the concern that the two story portion of the building be retained as recommended. In the initial hre the permits were issued based on the at the time rotech hre and a different project and as we analyzed it it was with the two story portion and we didnt advocate that but as the project stood at the time. Thank you. Thank you. Are there any other members of the public that wish to speak on this item . Seeing none Public Comment is now closed bring it back to the commission. Commissioner hyland. Yes, i have two questions. One is the project this is for mr. Frye. The project as its proceeding whether or not this goes forward is added to the landmark Designation Program that will not delay or hinder projects; right . It wouldnt put a pause on the project, would it . Time frye Department Staff. Potentially it could. If the commission were interested in initiating designation then the project would have to be considered by this commission for a certificate of appropriateness and compliance with the secretary of the interior standards. So if we continue this to give mr. Lummus an opportunity to present and i guess the other thing that i am understanding now is the desires for him to update his designation report, application. Is that correct . He may have a desire to update the application. Staff felt with the departments analysis and the analysis of three other consultants that there wasnt any new information we felt would be necessary for us to render a recommendation to this commission which is why the meeting wasnt scheduled. As you know in other situations where we have a first time applicant and theyre still preparing information and theres a lot of unknown or Unanswered Questions we will generally help them but we felt with the Additional Information as long as with the subsequent information and evidences evaluations we had enough to bring it to you so if he was to update it im not clear what that information would be. Let me clarify the question. If we initiated it there is 180 day hold on the project and during that time period it could be approved as if it was a landmark and give it a certificate of appropriateness. Is that correct . Thats correct. But if we continue it to some future date then we just make this decision later and the project proceeds. [inaudible] off mic i dont think my mic is on. Is it . Okay. Sorry. Once you initiate designation there is 180 day hold on any permits. Theres no permits understood. My question is if we choose today to consider it then there is no consequence. Right. So its just a matter of either making the decision now or making it later and the information might not change. Right. But the project is submitted for a Building Permit . Is that correct . Thats correct. We have the permits in our office and out of the respect for the applicant and this body in making a decision or having an opportunity to review it we have been holding off on approving any permits until you were able to render a decision. Commissioner johnck. Yeah, i think this discussion is important for clarifying the options are. We take action to initiate or do something about this landmark application, to initiate further or we continue. I mean and i guess the reason i might lean towards continuance i am concerned about the process as the representatives of the public have described here, but frankly i read whats been submitted to date and the staff evaluation and i have no quarrel with what youre saying that this doesnt warrant landmark status, so i would be prepared to do it today but the only thing about continuance is postponing. I dont know what will happen that will change. How significantly would it change the staff recommendation at this point . I dont see too much evaluation that the staff evidence that the staff recommendation would change. Go ahead. I am waiting for you. Commissioner. Thank you. I am going to follow the lines of commissioner johnck. This area and building seems to have quite a bit Research Done on it previously and i dont see what would change anything and to me it would have to be incredibly significant information that would have been uncovered by now and i would be voting against the landmark designation anyways. Commissioner matsuda. I think im in favor of a continuance just to provide the opportunity for mr. Lummus to share whatever new information he has and i would like to decide at that time because you never know. There might be. And i would like to make sure that opportunity is available to him. Hes done a lot of work so far. I guess i am leaning to that way as well. I think it would be just listening. Thats i didnt was asking what it would do to the actual permit, so currently youre holding the permit out of respect, so you would have to decide whether youre going to issue the permit whether or not we continue this. And also lets be careful about precedence so now all of a sudden it becomes a tool, right, to hold up any permit. Lets be real careful here. Yeah. We do it for this project where do we stop it . I want to Say Something for the public in landmarking. The process is if the Historic Preservation commission chooses to initiate a landmark we have two hearings and we make a motion to go to the board of supervisors and the board of supervisors ultimately makes the final decision and the mayor signs it. So my concern is that even if there was interest in a landmark designation which i am not hearing strong interest in the commission it seems like this is something that is going to drag out a process that is unlikely to be approved by the board of supervisors at least. Again thats how the board would go and unlikely the board would go that way given the desire for more housing in the city and would cause delay and cost to the project sponsor but not a benefit to the community but sounds like we have a desire for a motion about continuance, so why dont we hear if there is a motion and a second for that. I would like to make the motion to continue. If i might ask well, anyway do we hear a second . I understand the dog Patch Neighborhood Associations desire and i just dont see based on the Information Available that would change our decision later, so no. So i stand alone . Okay. So we dont have a motion to continue so let us discuss whether we want to add this to the landmarks program, so we could can we take no action today . Do we have a make a motion about this item to add it or if we dont want to add it is there no motion at all . Commissioners i would defer to the secretary and the city attorney, but i think as a benefit to staff is taking a formal action on whether or not to include something in your program is a signal to us on whether or not you want us to prioritize and work on something so i think its helpful for us to know definitively. Because it says review and comment under this. Youre not required to take any action. However, as the preservation coordinator mentioned it would give direction and clarity as to how to proceed and its it to you whether or not you want to add it to the work program. Yes . I think adding to the work program implies you think there is potential merit to the building to be landmarked so that would take much more time and we are sitting on a permit thats been in our hands for some time so its an awkward situation. I want you make you aware of that. Its unusual to have such a situation after the project has been entitled and i want to point that out. Yes. Yeah, the likelihood we would add to the work Program Based on the priorities we established and the work load that is backlogged and keeping the program moving and if we continue it and the likelihood to add it to the program i wouldnt support that. I concur. Unfortunately. And i recommend you want a motion . I recommend that we do not add this item to our work program. Second. Thats a motion. Yes. We have a motion and a second. Okay. Additional speakers. Sorry. That was they have already spoken. Shave spoken. Very good commissioners. There is a motion and a second not to add to the work program. Commissioner. Yes. Commissioner. Yes. Commissioner hyland. Yes. Commissioner president wolfram. Yes. That passes unanimously 50. Commissioners that will place us on to the regular calendar on item 6 for case number 201400327ocu at the 1126 Howard Street. This is also a request. Good afternoon commissioners. The project before is on the proposed project at 1126 Howard Street. The proposed projects seeks a change of use from retail to office use. Within thes Zoning District the Zoning District office use is not permitted unless its within a qualified historic property. Under the Code Qualified Historic Properties include those that are determined eligible, individually eligible for listing in the register. This property was determined to be eligible for the listing in the register as part of the south Market Research survey and adopted by the hpc in february 2011. Under the code the plan offing Department Seeks the advice of a Historic Preservation commission to inform the Planning Commission in their determination of the projects ability to enhance the feasibility of preserving the Historic Building. The project needs conditionallal approval to proceed. As part of the project the project sponsor will remove exterior features and restore important elements and new ground floor and windows and compatible wednesday on the second and third floors of the facade facing Howard Street and replace the entry way with a wood one and match the design in the historic photograph. It would construct a new mechanical platform over the roof and setback over the street facades and not visible from the rights of ways. To support this the project sponsor has submitted a Maintenance Plan for regular maintenance, prepare of exterior materials and windows and glazing and the roof. To date the staff hasnt received any Public Comment on the project. We find it in compliance with the standards for rehabilitation. Further the Department Finds that the project would enhance the feasibility of preserving the building and removing exterior features and insuring for regular maintenance and repair. The project sponsor is present and available for questions and this concludes my presentation. Thank you. Thank you. Are there any questions . Does any member of the public wish to comment on this item . Seeing none Public Comment is now closed and bring it back to the commission. Commissioners. Commissioner hasz. Thank you. I am in support of this change of use, not always in support of an office on the ground floor but on this block it could use more pedestrian traffic to liven that block up and maybe other Retail Locations will be more viable because right now that block is really would be difficult for retail, so im a big fan of it and i think its the best thing for this building for maintaining it. Thank you. I have a question. With this change of use so lets say there is a Office Tenant and they have a five year lease and they leave is this change of use is granted in perpetuity for the building or how does that work . Correct. As long as they dont abandon the use in the future it would be considered office use regardless of who actually is there. All right. Thank you. Commissioner johnck. I thought the applicant and their firm submitted an excellent plan for historic maintenance and it looks quite beautiful and i am wondering what is our enforcement on maintenance . There were a lot list of iterations and five years do this, ten years do that, and i should be maybe know this, but enforcing maintenance. Are they coming back to you with a Progress Report during certain periods or time . Commissioners, time frye commission Department Staff. In the permit tracking system were able to flag certainly milestones like a mills act contract. Okay. And there are milestones that have to occur at different ifert rales and this is a project were reminded we have to follow up with the project sponsor to ensure theyre adhering to the commitments they made under the change of use. So i move approval of the staff recommendation for this and the Maintenance Plan. Second. Is there an actual motion associated with this one . [inaudible] thats right. All right. So this is thats right so that is fine. Right. So on that motion then to adopt Findings Findings under the resolution. Right. On that motion commissioner hasz. Yes. Commissioner johnck. Yes. Commissioner matsuda. Yes. Commissioner hyland. Yes. Commissioner president wolfram. Yes. That passes unanimously 50. Commissioners that will place you on items seven, eight and nine and called together as theyre all mills act items. Oh im sorry san marcos. We have one more, sorry. Item 7 case 20110685l at 171 san marcos avenue. This is a landmark designation. My apologies. Shannon ferguson Department Staff. I am here today to present the departments recommendation regarding designation of the house located at 171 san marcos avenue and added to the work program in 2011. Landmark designation occurred in 2015 and president wolfram, Vice President hyland and staff conducted a site visit of the exterior and interior of the property. Staff has updated the landmark designation report to include more current photos of the house. 171 san marcos avenue historically known as the cow house is significant for the association with henry call and composer and pianist and major force in music and introducing sounds and techniques into music during the 1910s to 1930s. His association with the house and commissioned by the step mother is reflected in the design including the modern style and a living room design to enhance the acoustics of the performances there. The house is also significant as the first modern Single Family home constructed in San Francisco and work of master architect morrow morrow and. His wife was the designer of the Golden Gate Bridge and was an architect of the house is a rare example of morrow morrows work and the influ ecial collaboration. The house retains the design features present during the established period of significance as listed. A list of character defining features can be found on page 39 of the report. Interior features such as the living room are ineligible because theyre not accessible but the strong recommends that the interior is preserved through an easement or sensitively designed. Theres no known public or neighborhood opposition to the designation of 171 san marcos avenue as an article 10 landmark. The Property Owner Christine Williamson was unable to attend the hearing but in support of the designation. You will find her letter in the packet. The department believes that the building meets the eligibility requirements and landmark status is wandered. The department warranted. The Department Recommends designation to the board of supervisors. This concludes my presentation. I am happy to answer any questions. Thank you. Commissioners any questions for ms. Ferguson . Commissioner matsuda. Im sorry. You mentioned a conservation easement for the interior. Is that part of the it is not. Its something that the Property Owner may explore if she wants to be an conservation easement on the interior as well as the exterior. So how do we do that . Do we encourage her pursue the conservation easement or how does that work. Time frye staff. We have been in contact with the owner and the group in the city and there appears to be some general interest but not much of a role for the department or this body other than strong encouragement. Do we include that in the license of the motion . Its not included. If you would like to amend to do that we are amenable and help clarify things. Just looking at the beautiful photos here it would be a shame not to strongly recommend that. Yeah, we agree. Thank you. Oh im sorry i did have one other thing. Thank you very much for the recommend. It was a great report and such a Beautiful House inside and outside. And we should thank the owner for allowing us to peek inside the house. One thing i am hoping we could add and i hope the commission supports me on this under the article 10 landmark designation, the actual that report, under statement of significance of association of significant person i was wondering if we could add a paragraph about olive call. I know you shared information about her in the report, but i thought we could possibly add her here because she had such a huge influence on the creation of the house. She was one of the first woman to be a professor of international relations. I think thats significant and we rarely for this time period recognize women and their role in many different areas and i think this would be a Good Opportunity to make sure that its part of the record that she be included because i do think shes an important person in our San Francisco history. Thank you. I think we will move Public Comment. Any member of the public wish to make Public Comment. I see ing ga horm an approaching the mic. Good afternoon commissioners. I strongly support the landmarking of 171 san marcos avenue, and it is really marvelous building, and also Christine Williamson did a marvelous job in maintaining it and restoring it. And i agree with commissioner matsuda that i would like to have see as a Significant Association included olive call and i am concerned about limiting the significance of time period [inaudible] was incarcerated. I mean that doesnt take away from the house, and okay. Thats my comment. Thank you. Thank you. Does any other member of the public wish to make comment on this item . Seeing and hearing none we will close Public Comment and bring it back to the commission. Commissioner hyland. Thats actually a good point brought up. Ms. Ferguson can you elaborate on the period of significance and what the options are and whether you would recommend expanding or changing the end date i guess it would be. The end date does reflect henry calls association with the house ending when he was incarcerated. We had said before that she was an interesting person but didnt rise to the level of a significant person with criterion b. We can look into that a little more and perhaps San Francisco state might be closely associated with her productive life, so we would have to look into extending the period of significance if we wanted to include her as a significant person. She died i forget when she died 84 i think. So she was living in the house up until she died so it would extend the period of significance quite a bit. That would be great. Mr. Frye. Commissioners time frye Department Staff. If the commission is amenable or believes that olive was significant and should be considered under criterion b its totally within your authority to amend the resolution, include that. We could provide Additional Information in the final designation report that goes to the board of supervisors. That way you wouldnt have to have another hearing on the item if you wanted to move forward. Its just a suggestion but were happy to do that Additional Research if you choose to amend the resolution to one, include her, and two, extend the period of significance to 84. I would be in favor of that. I would support that. I would support that. Sorry physical ferguson more work. Before we have the motion i want to thank staff for a fantastic job with this report. I know ms. Ferguson worked on it and marry brown did an amazing job. May i add ar . I met the owner and its definitely in good hands. Shes taken great care of it and has a huge desire to maintain the building and i dont know if its appropriate here but she should also look into the mills act for the exterior conservation issues. Yeah. Shes only the fourth owner, right, or third owner . [inaudible] beautiful. Do i have hear a motion . Are you going to move . [inaudible] i move to approve the designation as amended with the extension of the period of significance and inclusion of olive. And also the recommendation for the owner to pursue conservation easements. Okay. Second. Very good commissioners. Then there is a motion to adopt a recommendation to the board of supervisors as amended to include extending the period of significance and adding her as a person of significance and pursuing conservation easements so on that the motion. Commissioner hasz. Yes. Commissioner johnck. Yes. Commissioner matsuda. Yes. Commissioner hyland. Yes. Commissioner president wolfram. Yes. So moved unanimously. That passes 50. Commissioners now it places you on the mills act items. Items eight, nine and ten for case numbers as listed at 722 steiner street, 761 post street and 807 montgomery street respectively. Mr. Frye are you making a presentation . Oh ms. Ferguson. Good afternoon commissioners. Shannon ferguson planning Department Staff. The last items are three mills act historical property contracts and submitted to the Planning Department on may 1, 2015 and ready for your recommendation. This authorizes local governments to enter into agreements with the properties and provides property tax reduction to owners of the Historical Properties and allocate the savings towards maintenance and restoration plan. To date the department holds 18 contracts. The staff receives five mills act by the filing date. All applications were reviewed by Department Staff for completeness. Comments were provided to the applicant and Department Staff conducted preapproval inspections. One applicant decided not to move forward this year and another application was withdrawn on december 10, 2015. The remaining Property Owners will enter into a mills act contract with the city and revolving contracts renewed annually. The packets contain a draft evaluation for each property outlining the potential tax savings and by the Recorders Office and by the board of supervisors. Each Property Owner outlined a rehabilitation and Maintenance Plan ensuring that work is conducted with the standards for rehabilitation. Okay. 722 steiner street is a two and a half story raised basement Single Family dwelling 89ed in the queen anne style and by Master Builder Matthew Kavanagh and in the landmark district. The owner did upgrade and repair of walls and roof and setting and painting. It includes annual inspection of windows, doors, wood siding and trims and any elements as necessary. Staff recommends that the hpc recommend approval to the board of supervisors for the following reasons. Its a Historic Resource under the planning code. The rehabilitation and Maintenance Plan was appropriate for the Historic Resource and all works meets the secretary of the interior standards. 761 post street is an 18 story hotel sro building designed by Architecture Firm weeks and day in the ark deco style and constructed in 1930 and a contributor to the tenderloin district strict. 761 post street is valued at over 5 million, a report was submitted and demonstrates that granting the exemption would assist in the preservation of the property that is in danger of demolition or oolt alterations and completed upgrades and roof replacement and concrete to the fas sad and includes concrete repair to the elevations and window replacement. The plan includes inspections of all windows annually, inspection of facade and roof every five years and repainting every ten years. Staff departments the Historic Preservation commission recommend approval to the board of supervisors for the following reasons. As a contributing building to the National Register district its a ris toric resource. The plan was found appropriate for the Historic Resource and all work is meeting the secretary of the interior standards. 807 montgomery street is a two story over basement wood frame brick commercial building in 1909 by j butler and used as a smokehouse and meat packing plant. At the time of the application date the property was valued under 5 million and didnt require a structure report. The plan includes structural evaluation, resetting and repair of bricks and window sills and sky lights and bracing. The Maintenance Plan includes a cycle of inspections of the walls, roofs and windows. Department Staff Reports that the Historic Preservation commission recommend approval to the board of supervisors for the following reasons. Thank you commissioners, i appreciate this opportunity ill start with a short video then well get into it. It effects everyone in our city in many different ways is a is 2013 San Francisco Homeless Center 64 homeless individual in the city to try to address the issue to the citizens are a program to provide a solution to combat homelessness in San Francisco welcome to the Navigation Center. This Pilot Project is aimed at People Living other than the streets it makes a it different from other shelters able to accompany entire Homeless People allowing us to keep and bring their personal bloomgz. It is a whole program that people dont want to be homeless and from the services dont meet them where they are are theyre not relevant to where their lives are theyll for the be successful in the embarcadero people can assess twentyfour hours a day for the laundry and the Navigation Center is designed to be an impactful dynamic residential experience where on this site we have for families and sign up for gentle think assistants and food stamps and medal those he knows issues are complicated. The thing the agency actually coming on site to provide services and that is exist with the goal streamlining the hole process of how to get people into general assistance as quickly as possible. Truly different way totally different you can come and go as you, please while your servicing showers anytime you can 24 7 a day wherever you want to do it not like any other other. Thats an example when a for what they did for the entire mission and they reach out on the other hand, and do what they can to where do we have to get you set up and straight i couldnt imagine were doing this this place is different and a lot better. The Navigation Center is a collaboration of partnerships between several nonprofits in the Department One of those project sponsors is the homeless partnerships from the district 2. Air force weve well have our partners go out and try to bring you guys in dont go anywhere early the next day well send out our team into the population and hang out with them and transport people in the process with them when they get there inaudible myself and all do you have really. Being homeless and bring the belongings you with wherever you go this place here is for storage i dont have to worry about it. Youre here you get things done that need to be done to get people off the street a lot of hopelessness is gone. An accomodation to if youre hurry go eat need a shower go get one. Your hanging out. The Navigation Center was fund for a 3 million unanimous donation as of may 2013 an additional 3,000 arrest warrant was in the program inaudible . When you go there you see people come out theyre ready to go into the future homes and know how valuable the Navigation Center is. My message for the constituents is that, yes something has to be down to address homelessness and it is being done. Theyve set an example for San Francisco to take an area that was funky not looking great what were trying to do is help their neighbors getting sicker and more frail and broken down on the street and theyve welcomed us to come here thats. Powerful state. People are excited people will beginning to see for folks theyre able to find housing. We want to help them theyre in survival mode and inaudible and theyre much more kind of inaudible . To i mean, the first days that i was here he had appointment to go to appointment and everything was made all i had to do was go to them thats different. Settled in a helping hand, get on my feet and take care of issues i had and this is so wonderful. Even though the Navigation Center has been open since may 2015 creating successful outcomes for the clients. A month ago we came and asked me to come into a program so i have been here and three weeks later im in my own place i feel great it is all mine i can lock the door and not worry about my stuff i feel like a human again like part of this. Okay. So thats just a little brief update ive passed out some of our weekly dashboard and one of the great things youve been wlorl with the project so not a report 2 years ago later as stated in the video this was funded with the 3 million gift to the city and it is nice to be able to design and implement a project where youre kind of free from a little bit of the normal constraints through the budget process and others so because it was a success initially we thought phil an important gap in the services in the city the mayor has backed up with further investment and looking for more locations to open similar programs i think you know people get a chance to look at our weekly dashboard you can see that people are there you know we go from 60 to 75 people at any one time and try to work down and go and invite in a whole group of guests to come in and take advantage of services and you know recently just today, we had invited 5 people in from district 3 and district 2 right close to the waterfront area here and previously we have gone and invited in the guests from the Justin Herman plaza area and you know a couple from up around the cable car turn around if you look at the map on the second page some of the earlier activities collected here and as you can see where weve been grabbing or inviting people in and a lot of that it clustered around the Mission District where the Navigation Center is thats natural a lot of people in the Mission District and can vascular and working well with them to rove their homelessness if there was an opportunity to open up something here on the portland it will cluster up like that around the embarcadero and thats an in violation of section i want to you know really make for the port i think we can do some Amazing Things to find a great facility to house that at as you can see further on depending on the path of the client there is different average lengths of stay overall 50 days right now people come into for various reasons and as you can see the tracks of work in and out for each week weve been really proud and tomorrow morning you know the hud secretary will come and invite curious i was present at the National Alliance to end homelessness an industry in d. C. Will be this project and its spurred a lot of interests in other cities i know it comes as a little bit of a shock to san franciscans but you know chronic homelessness is a National Epidemic especially in the california climate the climate is bad la a 12 percent increase and 87 percent in encampments the la county was 44 thousand they did a survey and found that using all their administrative data 10 thousand people a most are fwaul into homelessness a chronic systemic problem in the itself especially in high rent community and in San Francisco it is nice to show we have approaches were not going to surround but really lead with a helping hand and reorganize our resources to make sure that we can resolve peoples homelessness on the street so ive been very excited about the Navigation Center and id like to talk about it but this is not even the limit of what were doing the Mayors Office of homelessness we have a tremendous effort with federal resources to try to reduce homelessness among the veteran population a goal at the end of this year the resources in place to end veteran homelessness which maples veterans that have been homeless a year or more and weve been able to house hundreds of veterans were down to our last hundred and 60 veterans that are eligible for federal support we have vouchers in their hands weve worked with the leader pelosi to raise the reimbursement of those vouchers to assess units on the private market opened a great building on 250 green hundred and thirty units with private baths and veterans have moistened there were proud we have more to go and well be able to get there a family homelessness and experiences a little bit different in our city a long wait list for families to get into settlers were working with a great grant from the School Foundation and able to target homeless families or faemsz at risk in schools together without initiatives were cut the wait list in half for the families seeking Emergency Services through homeless families and saturating them opened up a number of building with transitional age youth but the chronic street homelessness is still i know a pressing issue were seeing everyday and received can you do if our staff and responded to the Homeless Outreach teams to get a sense of what is going on here ive also been spending some mornings walk arenas the plazas and around the support area for the last month and a half to get a sense of how people are experiencing homelessness i know we have work to do and so i think over the next few months well be spending more time with the Homeless Outreach team and bring people into the thats correct center this is you know going to be as closed to a sure thing was we can get for an el nino winter and in the 7 not an el nino in San Francisco San Francisco opened up a monster shelter which i dont think anyone was proud of only happy to have people in the shelter but didnt workout that well, if were strategizing about what we do lead into this el nino year well void that in not well be coming you, you guys likely and looking to open a big Emergency Shelter i hope we can think pro Telegraph Hill and straechl to help to reduce homelessness and get people into the safe and secure housing thank you. Thank you. Any Public Comment . Seeing none, Public Comment is closed commissioner adams. Thank you very much for that presentation its really exciting to have the Navigation Center and actually seeing people that are using it and that is absolutely wonderful i know that the city has had long time issues with homeless and it seems to be getting worse it is great to have a resource like that if you want to look to the port where would you look to open a shelter. Ill have to rely on our expertise you know the great thing is that you know the Navigation Center was a pop up it has got were going to do build affordable Family Apartments there, there is runway for june at least but at some point well have to break ground so that was an abandoned school site it was hell converted with a a little bit of capital work you know working on a laundry facility a shower and raising up things to be acceptable so you know, i think that we need to free over minds of what a traditional shelter has been a lot of it has to do with with how were treating each other and what were doing with people once weve invited them the Navigation Center weve committed to housing them once that is established you know you start to take away the other rules no Security Guard no curfew and no strict time people dont losses their beds the only really obligation to treat them with respect and the result has been an incredibly reactions it takes a lot of the amth of anxiety down and not this thing youre turning people through every night but really work with people towards the housing so i could see very easily many of the port areas working as a place for a Navigation Center you know we have those bun losses at the current site they can be moved ive seen the ambition sheds and maybe work inside those i think theres many spaces anything to park a car in basically, we, get it to work thank you. Same thanks for coming out and congratulations. Thank you. You know kind of like hell has come to the waterfront nobody said something nobody wants Something Like that in their neighborhood i get this when the delanceycy street up to Pacific Heights didnt want them we cant have excons and ellen and others remember that so people like jim herman and nancy pelosi and john burton and me we said okay. Well bring them into down to the waterfront and look at the success it is a good thing to do but take it somewhere else they had the political courage to do who was right we had a shooting on the waterfront it was so sad i was down here that day having a meeting with director moore and some of the staff megan was there that day it i remember the waterfront and a lot of time we dont talk about the all the people with the mental problems lawful people with mental problems reagan shut down the Mental Institution so our San Francisco Police Department do the best they can and do a great job but it is epidemic and the mayor cant do it alone and people are so step up im sure the people returning for wants whether democrats reasonable person republicans they have to address the issue of homelessness and most cant relate theyre rich anyway and dont live in the neighborhood or not effected by homelessness so i dont think those politicians they can get their head around this is something that effects everybody people are that are Common People like might have ordinary people that have money we cannot turn our back on this initially thirty million tourist sometime its a lot of money floating around but people need help and sometimes, people have to take one to the team and i dont care if i have Something Like that in my neighborhood but deal with the issue it is so political you know it is sad why would Something Like that b be so political i dont get it there is about right or wrong this shouldnt even having to question yourself this is something that people debate i dont understand i appreciate director moore contacting you did i wanted to know more and some of the commissioned e commissions a lot of people didnt see it on our doorstep people get in their cars and go hope yes, maam to the saved i see it everyday i feel this is part of fiber of this community we all have to pitch in with the mayor and businesses and everybody weve got to get solutions we ought to be taking the leads and at the forefront you know were not going to say go into the corner like about super bowl comes were a leader we have the sense and resources and weve got to political encourage 80 counselor to deal with this issue homelessness is not good not a good issue we have to deal with it thank you. Thank you. Thank you for coming and congratulations we look forward to working with you in your new role very exciting so where to start thats where a lot of people feel when they look at the homeless situations it is not one category that people fall into i think one of the reasons we also wanted to have you back its an opportunity sincerely users this platform that things are beg done not a simple solution i was struck by beven came to us last time with the numbers of homelessness in the city it has remained a stagnant number ive shared that strategic with people it means we are doing something to move people out of homelessness and this incredible expensive city so many working homelessness people dont see them their visible folks on the street that are there for varies impairment be that Mental Health and other families do so People Living in their cars and working cant get housing in the city it lets remind people given the numbers of the thinking fluctuation of homeless and the numbers are increasing it stated means were getting people housdz i want to reiterate you can put it more articulately than i but take advantage to highlight again, all the work youve been doing and the programs clearly are actually making a difference in the people are getting housed so were not seeing the numbers skoekt because of people being sent here a cough i wanted to ask you in terms of specifically with the port replacement we set up the center in the 7 we had lessons pointed out in the Navigation Center people show up with their pets and accommodated and that was something were struck by in the 7 the coordination is animal control to allow people to have a safe place for their tare pets humanity people have a connection with theyre pets and wouldnt come off the streets theyll losses theirs animal xhoomz so a slew of new people into the system and able to assess services and help because we met them on their terms hopefully not have a stormwater like this we need the water but the impact of living on the streets the storms was scarey to make sure we save lives if youre looking to the port as ball park if we dont have all the Solutions Start the discussions sooner rather than later so were prepared and act when the times comes there will, a lot of steps well needing need to go through so i encourage you and your staff to encourage the discussions and if feasible what well need to do or a smaller facilities where it works. Theres a lot of questions you could ask profoundly not jermaine for the port but weve finished fleet week and percentage wise how many of the homeless are veterans i dont know if you got those numbers but just interesting to see if we have you know immigrants living on the street veterans and others we see if there are other programs we can start to help in that way but struck with fleet week and speaking to some of the leaders in the military involved in disaster preparation he had lynch reason with a retired general during the 1989 earthquake necessary brought up a ship and the military the navy actually helped to run a program to get people housed during that time if this is something in discussions but they have beds and births and people that run the mess haul and got compliments on food if were facing a potential disaster if we have the kind of storm everyone is predicting this is the last point and continue to have you come back and doing periodic reports as we do with planning and thank you commissioner adams for starting this process important to let the public know what is happening especially people see a lot of homeless along the waterfront we have the facilities and i think along those people want to help and often dont know how im going to ask you if you will calling the 311 i call if someone is a danger to themselves but the public to know who to contact it in the different situations take advantage of our opportunity to get this information out you know if there is someone walking along the port if there is a Different Number or entity what people can side im going to turn it over to touch on things. Thank you wonderful on your comments i agree that is as commissioner adams you know made clear it is a moral issue and something we can change and we have the tools to change you know so we talked about the numbers and recently this last january we did a point if time study by the government we have a population at one point of 6 thousand 8 hundred Homeless People and 3 thousand 5 hundred are building on the streets so thats tremendous. You you know so our veteran population is although dropped dramatically it is still around 5 hundred and you know so theres still a lot of work to be done there. Recently last week, we did Media Attention the 36g app can be used for homeless assistance call 311 and get the Homeless Outreach team and get other assistance to help to deck but use the app and the go locates and the first police are First Responder they help bring in the Homeless Team or decide to bring in an ambulance 911 is not a wrong number if youre worried about someone being a danger to themselves they cant be in theyre good stage you know extremely agitated dont seem to be responding to stimulus or in traffic i think it is the right number to call a lot of times and its okay to that but sometimes, people you know want to shy away from that and use the app and call 36g i call the Homeless Outreach team with a dispatch number that number 4157344233 it is great they come out and assess and help to direct people to what they do as the case when i came out with them to work with a woman living in the vicinity here and they knew her very well from the ficus emergency. Other types of things she participated it was nice to see them interact with her and have this Background Information i really encourage that. Get that number. Psa we have it running across 4147344233. So also today, we had at honor of a Ribbon Cutting and Baldwin Hotel it is a fully renovated hotel on 6th street hundred and thirty units were moving people in and especially the Homeless Population the homeless first and really exciting were part of an effort for the mayor to add 5 hundred unions to our portfolio this year 4 thousand units ultimate this is where we need to go and we do almost 200 units and three hundred more by the end of the year i look forward to working with you and returning. Thank you for inviting me for coming. Thanks very much. Items on this consent calendar item 10 a. Commission report. Port commissioners report. Commissioner adams. Commissioner brandon. Thank you. Any further Public Comment . Seeing none, Public Comment is closed all in charge of the consent calendar its approved. Item 11 informational presentation on the contracting activities in fiscal year 20142015. The matter before you is an informational contracting activity in the fiscal year 20142015 this is a period covering july 1st, 2014, to june 30th, 2015, there are a number ever ordinances that govern contracting in the city and county of San Francisco today ill focus on 3 the local business ordinance and the local hire ordinance and finally ill discuss the changes made to chapter 6 the Construction Contracting ordinance. As you may know the local business lbe levied the certify lbes have advantageous in the skrauth goals the Contract Monitoring Division certifies the firm and clays classes them as Women Business enterprise or other business xrisz 1300 lbes have a 3 percent dropped and minority have clarified by a ethnicity and the representation of the firms the same as a year ago with 46 asianamerican and 20 percent africanamerican and 20232 percent latino owned businesses we were what did you do 16 now contract 26 million only 8 contracts governed by the lbe and 64 percent of contract were what did you do to lbe firms this is 6. 6 million or 69 percent of dollars annulment awarded going to local certified firms the lbe were expediting on the size and scope the projects awarded dwurg the record were sued and 86 percent of dollars went to lbe the 6 contracts were exempt from the lbe ordinance due to take our small size or waivers 51 percent of exempt went to local businesses. Over 12 million was paid out for contractors during the fiscal year additional 47 percent went to lbe firms on average were studying the sgraukt goals it is 14 percent awhile 18 percent of payments went to lbe sgraushths this is important to note that each the categories are individual contract with their subcontracting goals the open contract and their lbe performances are included in our staff report and the corresponding attachment overall the late numbers are continuing the trend established in the first half the fiscal year and informal lbe participation. By comparison during in fiscal year 20142015 both our lbe ward and percentages were higher than the Previous Year last year the contract went to lbes that was 69 percent your our expenditure sees in 20132014 were greater in last year part to payments made on the cruise ship terminology 60 millions of is 67 millions in the table was related to the cruise ship terminal projects, however, the percentage of lbe payments to lbes were 14 percent higher than the Previous Year. Two contracts were firmly closed both lbe set aside and exceeded the ordinances the greenway was hundred Percent Complete and completed its set goal and 3 additional prongs are very near competition and all of our meeting the lbe goals Construction Projects over one Million Dollars are subject to the citys local hire ordinance since the inception of the ordinances in 201114 projects have been subject to the ordinance and met the citys local hiring process and the local threshold is thirty for better or worse start at 22 percent. All of the contracts are stooeftd the requirements one of the contractors cal state has been given a waiver for offsite waivers to meet the lbe local hire goal. Two of the citys chapter 14 lbe ordinance and chapter 6 the Construction Contracting ordinance were amended during the reporting period the new lobe ordinance is effect on july 1st some of the legislation highlights are an inclusion of citywide lbe goal of 40 percent the port exceeded that in the last two reporting periods well be able to do that as long as the soundproofed firms are the same or increase additionally the new ordinance has a San Francisco First Program a program that mandates we solicit bids if local firearms prior to local small firms for the contracts additionally the agreement adopted by the board of supervisors have to have lbe plans those are similar to the plans at the metro peer 27 and pier 38 ill be including update to those plans in future update in august the Zoning Administrator kicked off the pro she and 14 mentors and thirty pro shes their matched with two pro shes with a Steering Committee put together and as mentors meet certain provisions or deliverables and my name is within the work plans they are afforded waivers of certain provisions of the lobe ordinance two port Staff Members serving on the Steering Committee in august the board of supervisors passes the legislation to reform the contracting ordinance of chapter of the majority of provisions apply to Large Department that have construction protocols over 6 million, however, changes that impact this year at the port one significant change the increase in the threshold from 4 hundred to 6 hundred thousand that allows us to issue smaller contractors and micro settled contract a bit faster in conclusion that was a strong year for lbe 64 percent of dollars went to lbe and others to local firms meeting the local requirements and working with the colleagues and other city departments to implement the changes project sponsor pass by the board of supervisors that concludes my presentation. Im available to answer any questions. Any Public Comment . Seeing none, Public Comment is closed. Commissioner adams. I guess i made sure you have time to talk. Oh, yeah and commissioner brandon. Thank you so much for this wonderful report it is so exciting to see were doing a wonderful job a couple of things regarding the new or new ordinance and when San Francisco First Programmed small informal contracts it that below 6 hundred thousand. And for professional Services Contract below one hundred 10 thousands. The new protouch live lobe firms can sign up and basically, thats their work plan whether the professional service the Steering Committee has milestones for instance, billing or the mentor show the protouch how to submit invoices to the city those types and once the milestones are met the mentor is giving advantages on future contract bids with the city some advancing with waiver of the citys good Faith Outreach requirements. So basically like a Training Program. A Training Program right. It is unpaid. Right. Only voluntary. Great thats wonderful i see that the c m. D. Breaks down their classification by lbe type and ethnicity so we do that. Those are the designations we use. Right but as far our contract do we know how many are late night and africanamerican and asianamerican. We dont give preferences that is all tracked. Im asking can we report it by lbe type and mbe firms. It is included in the attachment weve identified. Is this for us are the city. This is for the city. Right im wondering if we can do it for all contractor. Yeah. Thats wonderful. You did it already. It is in the attachment ive identified each the primer contractors as lbe, mbe or w b e in the actual staff report noticing not in the presentation. Not saying the ethnicity thats what commissioner brandon is saying i saying correct commissioner brandon. Yes. So i didnt see that in the staff report or this. Thank you. I like this report but want to see the breakdown of the ethnicity of the report broken down so we can track it and city to know that sometimes things get put in numbers. Stuff like this i want to so how much for asianamerican and latino americans. Weve done a racket job at the port i want to commends the numbers and the focus has been made i want to thank everyone for that great report can you kwok go back to the professional services. And you know thats where again, our numbers are higher than average but lower than on the construction is that because of the size of the firms that get hired do qualify. Many more lobe firms that are construction than professional service and the contracts we awarded are under 4 million where lbe tends to do really well, that is the primary reason. And on the professional services this is a smaller amount that qualifies. Correct one and 10,000 some of the professional contracts with a certain expertise or not certified within not lbe certified workplace this realm and therefore, no lbes to compete for the contracts. And then if this is in excess of that amount not constitute or quality for the lbe. Correct. Given the cost of professional services would that account for this of that added. Correct. Thank you very much. Any other questions . All right. Oh, actually do i have any sense of how many contracts recidivism for the next year. 12 last year and 14 this year it will be in the same ball park. Thank you. I have one more question usually in our report a list of the businesses that were contracting with and exactly how much they got i dont see that in here i see the gateway. On each four of the report addressed the contract activities each the contracts and the type of firms and the firms that was awarded the contract and in the attachments at the ends that includes the prime contractors and the apartments. I dont think we got that that wasnt included. You dont have the attachments commissioners. Thats 11 a i got it. This is what youre talking about 415. What page. Panning 4 thats not all the contract for the quarter no, i dont have that. We didnt get that. You can just send is to us. Thank you laughter . Tests an different report something else. Thank you. I really appreciate it. Thank you. Thank you next. Item 11 b for the approval of executive director salary. Good Evening Commission im Elaine Forbes the Deputy Superintendant of the administration and joined by my colleague and as you may know charter section b3. 481 grants this Commission Executive authority for the compensation of the director provides guidance in that compensation shall not exceed the salaries of maritime employment do a Salary Survey to help you decide on the rate of compensation for the port director and make recommendations the same as the increases or changes to the Municipal Executive Association our capital hill executive director is not represented but many are and ms. Holmes completed the Salary Survey finds that our port director is paid less than other seaport director by an average ever 31,000 and less than Department Heads on average about 25,000 we do make a staff recommendation we considered a policy decision if he were to correct that issue we made the recommendation for you to increase the executive director salary 3. 25 percent consistent with a m e a contract agreement that would bring the executive directors salary to about 200 and a 71,000 and then for next fiscal year to increase it between 2. 24 a 3. 25 percent that rate has not been negotiated for they employees thats staffs recommendation following the mbe guidelines you have exclusive authority to set the executive directors director salary shes earning less than her peers and ann and i are here to answer any questions. I move. Second. Public comment . Seeing none, Public Comment is closed commissioner adams. Yeah. I like to make a motion if i could get a second id like to see two increases of 3. 75 one in october of 2015 the next in july of 2016 the package will result in a salary of 20,087 in july of 2016 that brings our executive director up to pair still other port directors throughout the country and others above her with her stellar performance i hope i can get a second. Second. So im sorry so the first increase is its a effective june 2nd or retroactive. Effect 1010 of 2015. Thats retro as a written in the resolved clauses weve set it up like any employees so the increase for the employees was october 10th it says effective and so for the chance that you recommended commissioner president lazarus well trike 3. 25 and put 3. 75 and the similarly changes to 271, 827 and then in the next resolve clause it will say effective july one 2016 the port executive director will receive a base salary of 282021 rep a 3. 75 percent increase. Not retroactive those are only guidance for you you have the executive. We do it recommending but and when do we make it effective is it usually 10 one. It changes from year by year whether july one or october 10th. What of the directors last increase. I am sorry to ms. Holmes. Good afternoon, commissioners Human Resources director the last was effective 7, one of 2014. We should make that retro introduce. Yeah. To 7, on one. A motion to make it retro. So that means the first resolve clause is july one 2015 instead of 2016. Perfect. And then that makes all the changes motion want to make sure we have all itself adjustments here so without fallout discussion. All in favor, say i. I. For the resolution as amended. I. I. Opposed thank you monique for all our hard work we hope this is somewhat symbolic our appreciation and lets you know how much we appreciate the hard work and what youve done to steer the port interesting creative difficult times and done weve been personality all youve done and this is a smalltology of the accomplishment how much we value our contributions. Thank you so much im a little bit speechless ill think of something thank you all very, very much. Make sure the Port Commissioner got a raise i dont make 50,000 thousand dollars a year and state legislators make in washington show us a little bit of love help us. laughter . So thank you next item. Informational update on the earthquake vulnerable study on the waterfront seawall. Good afternoon, commissioners executive director mirror and port staff and members of the public my name is stephen real an engineering project manager and today iceland give an earthquake study on the northern seawall this is for information on and a review of the seawall function and history describe the earthquake vulnerability study and highlight work completdz to date and describe the next steps this is a graphically heavy preparation arrived by boat this is a shallow mud flat and piers and wafers and commissioners to control the title of lands in 1863 and comprehends into a mecca of maritime commerce a great seawall as sometimes no one was proposed by thomas j arnolds in 1873 and lefgd in 1887 and constructed beginning in 1878, 4 miles long and located self feet from the shoreline and helped to create largo portions of downtown. Today, the seawall anchors the northern waterfront slightly providing support for the head wharves and building and protecting the shoreline and hold back the lands carmen infrastructure including the embarcadero promenade and roadway and muni lighting and key areas serving the city every day thousands of people enter and leave it by crossing over the seawall by ferries and criticizeships ships or traveling under the sea level and they run and bike and skate to ball park are to experience the sarin beauty of bay. Seawall was constructed by a trench through the mud several hundred feats through the shoreline it is 20 feet deep filled with rock to create a pyramid shaped dike with the bulk head wharf and the lands behind was filled to create a thoroughfare in the embarcadero later most of timber an engineering drawings from 1909 showing section 11 this is one of the concrete walls and wafers this is over by pier 38 the bryant street wharf many say a bulk head beyond and this is the concrete bulk head today there are 22 sections of wall over 55 combination of bulk heads and wafers one time over 40 piers and now half remain the earthquake equivalent study was led by joint venture between engineering communication g hd a national modestly firm and a local enterprise Geotechnical Firm the Contract Value was 425,000. 25 percent of sub consultant participation goal the scope the contract includes a comprehensive view of information that work is complete and phase two the vulnerable analyze it in progress and largely complete and the mitigation recommendations this work is in process speculate contracts for pier review the specific scopes establishing the zone of the influence both bay ward and landward and section maps and generating sites predictions with the ground shaking and analyzing the rock for stability and the uplands formulate i cant tell supernatural analysis of bulk head wafers and this recent for performance oar mapping of utilities within the zone of influence and work with the utility providers to assess potential damage and impacts from the land subtleties and assessing the posts earthquake flood hazards due do the ground settles a highlevel Impact Analysis conceptually designs associated with the cost based analysis and finally recommendations including ranking and prioritizing areas for irrigation and detailed information thats a full plate. So what have we found the zone of influence the zone in which the seawall impacts the soils and supporting structures it extend up to 12 hundred feet beyond the seawall towards downtown sub surface mapping the red dots are atms exciting geotechnical boards this is based on existing information not budget to go out and do new geofunds that runs 10 to 15,000 a piece great information this map shows the thickness of artificial soil this is a cross up it is 25 feet thick in pier one it is sandy in nature and liquor fax a phenomenon that the soil is fluid like in this case is increases the pressures on the seawall young bay mud victims this is the thickness of the young bay to mud i mud it is saturated clay deposited two thousand to 7,000 years ago there is from monique deposited during 3 stages of flooding and draining of the bay rally during and after the wisconsin innovation the bay filled 3 straight times this is highly compressable and offers little sheer resistance not good for foundations this is a closeup it representatives thickness up to one hundred feet near the Ferry Building this is the bedrock it varies from 40 to 200 feet below the seawall near the Ferry Building. With sub surface mapping complete the team choose 3 stekz sections this is near photographers im going to flip those through those quickly a variety of conditions that have thick layers of mud you dont below the seawall section one near pier 49 a potential sand under the rock dike and section 3 near pier 29 a section 7 in the vicinity of pier 3 quite a bit of thickness of bay mud and near the Ferry Building 9 a of the vicinity of Howard Street, section 12 which is the vicinity of pier 38, and section 46 near at t park in addition to the geotechnical section the team choose four representative sections for the wafer structures for the dpoe analysis ill quickly go through those this is important to note those are pile structures sometimes the piles are within the rock dike and sometimes blow below it and varies sections of concrete wall at the top this is pier 17 area and pier 26, 28 and the pier 38 area so earthquake hazards we live in earthquake country with an educationally quiet periods following the 1906 San Francisco earthquake all indications this could end soon the United States working gron group on the california kwaeshthd is 72 percent of major earthquakes in the barrier magnitude 6 point plus this is a major earthquake for the 72 percent number. The 1989 loma prieta earthquake was not a major earthquake for San Francisco. Estimate in 1906 it was over 60 million away produced only moderate consists this is what the loma prieta in the 1906 earthquake from loma prieta on the top and 1906 on the bottom to give you an idea of interest it take 40, 1989 so equal the 1906 this is offshore in san o 1906 this is offshore in san to 1906 this is offshore in San Francisco. Waterfront trends in ground shaking the team looked at the fault probability you can see the faults on this map team analyzed the fault and generated the ground motions along the waterfront for a variety of return periods this is call schematic analysis this graph shows the trends in the ground acceleration versus the ground return this is on the left and return periods on the bottom the 1906 earthquake was approximately 200 year return period and what those trends show that quickly you get into high levels of ground shaking at early return periods less than one hundred years after about 5 hundred years they start to trail off. So when we look at risk within the next 10 or 20 or 50 years the probability felt structures on the waterfront this type of information is great for us to consider in risk based recommendations. Then the next steps a complete draft of equivalent results is expended at the end of 2015 the pier review also 2015 and the final draft of the recommendations been released in early 2016 and this will inform efforts to help with the resiliency and climatic change plan. What you see here is the 2014 south napping earthquake as measured by the bryan street whatever we included i believe 10 accelerate obama terrace in the seawall and several are the down hold pile up to 85 feet below the deck tied not strongest you strumentdtion of the south napa valley earthquake this was used to tune the assumptions being made in the seawall with that, that concludes my presentation. And im here for questions. Thank you Public Comment . Seeing none, Public Comment is closed well, i know who laughter . Commissioner brandon i can be first. Thank you this was good its a lot of information and not quite sure what is really saying i know it is not actually predicting when the next differentiate will be but definitely giving us time to prepare i hope he look forward to the result and the recommendations from the study and understanding it further. Thank you. Commissioner adams. Yes. Stephen you and your crew this is good work it says the 1r50u7b89 study it is pretty heavy and a lot to get our heads around and the cautioned one takes and cant say tell life has so much uncertainty but disrespect that will happen and kind of got that feeling what kind of mechanism and prepare for it is a lot of information i hope youll come back to us and just keep us you can informed like i have been doing but i mean, you kind of say what do we do from here to get ready and be out front for that. And pray to god it didnt happen you have a feeling but you dont know when so i appreciate this thank you. Thank you. Thank you. Mixed thoughts i know we dont have the folks on the waterfront that participated but hopefully give them a headsup the studies is come out and not sure what were doing to inform everyone he hope your tenants are thinking about it is not you know something that everyone will have so think about and be prepared we have a lot of tenants along the waterfront and the probability i took my staff classes i dont want to look at what were going to be facing in the future but i think that will be helpful to let our tenants know perhaps sharing the information and give them the heads up and encourage them to do their own preparations so i appreciate well two questions he have and maybe beyond the subject here i know well be getting the results of study hopefully the draft that results towards the ends of this year when we get the recommendations a little bit after that is there some way of getting those to include the ideas on funding to implement the recommendations so not just going to be straight up remedies but approaches towards how to get the funding to implement that. Sure well definitely include that were in discussion with the Capital Improvement Plan Committee regarding the potential goendz and meeting with the u. S. Army of engineering with regards to Sea Level Rise with spending the money at the seawall weve found the earthquake component and theres were still in discussion. And is there anyone from any entity looking at federal grant money that will be applied not just looking at bond money but. We can certainly a lot into that once we understand the magnitude of the problem if there is one. laughter pursue clarify that. And laughter and what types of of fixes in the cost range and look at the option for funding. Thank you. You know if there is a large project the funding is typically federal anticipate on the waterfront from the u. S. Army corp. Or fema but were in discussions. Thank you. And regarding the results we have brought it up with several the key tenants were discussed what were planning and asked them to share information which they have and you know were very careful about releasing information as we dont want to scare anyone. Right. This type of engineering study youre dealing with the urban nonsense the geotechnical conditions the earthquake shaking and the Structural Conditions you get strange results and go back and look at it and poke it look at it a different way and take the engineering experts in the fields about you come forward with good results. Okay. Commissioners and you know stephen our saying that because recently ive been meows especially the last of months all the building in the city everywhere and highrise those report makes me think i think personally so many knows and so much weight i thought that was going to sink into the ocean with all the weight and highrise their throwing them up six and seven i feel the weight so much and the for the gratified on so much like anything you go going along so long and it makes me think more about that i appreciate the things. Ive got the same feeling laughter every time i look at an aerial view of malayan i spent spend a good part of my career looking at structures and really consider the impacts as a whole upon an area. Thank you. Maybe some adams waterfront land those folks by moscone thank you very much. Thank you. Okay. Okay. We can. Oh, yeah. We can go ahead. Want to go ahead. Yeah. Item 13 informational presentation and the port of San Francisco Foreign Trade zones an overview of the zones program. Good afternoon once again. Were trying to not let you get out of here. Thank you for having me, im gym malone this is my last preparation on the result of the Commission Meeting at your request in back in august present at chevy one irony want to give you an overview a lot more detail in the staff report but give a general overview of the Foreign Trades Problem Program and the history of it in San Francisco the Foreign Trades number 3 port of sophistications Foreign Trade established in 1948 when the San Francisco Port Commission got a Foreign Trade zone boards part of u. S. Department of commerce back then well, first of all, as a o grantee with the grant of authority of apart acts a Foreign Trade program in our local area so we tried to identify businesses that could benefit from the program in our area we also worked with them to vest the tint indeed they can benefit and help them with the application and activation and setting up their Zoning Program it was opened in 1948 at pier 45 to help with the coffee imports that was the original produce in the program but eventually that was moved to pier 43 and recent changes that made the changes port able to outside properties with the difficulty of handing large truck activities on the embarcadero waterfront led the port to deactivate the Foreign Trade site in 2009 port staffs priority continues to be leveraging the f t z and the vehicular tool to help skpz to be more competitive and encourage new businesses to locate in our area it coffers all or part the 7 bay area county they can utilize any port Councilmember Reid the port of San Francisco and oakland and Foreign Trades limousine serves 4 local businesses including chevron and exerts international and a fifth site approved by the foreign zone aviation in the International Airport and were awaiting kilograms to activate their site as an f t z greetings the regulars for wire we proclaiming operates it as a public utility and allow assess and charging fees for the operation of the zone were also required to provide auditorium treatment to all businesses in our area that operate in the zone failure to adu her would result in finances up to one thousand dollars a day or risk loss of our Grant Authority altogether so briefly heres how the Foreign Trade zone Program Works sierra club their secure areas and generally within 60 are 90 minute radius of a port of entry and while the zones with inside u. S. Interpreted foreign goods not limited to to zones where are considered outside of u. S. Customs material they collect duties when the the goods leave the zones in a general purpose zone or can be declared a driven site they come to the company it is operating outside of the zone port area once up and running some of the activities are manufacturers, assembling are processing and storing and relabeling and destroying and exhibiting, etc. So a lot of activities can be performed no retail or production of alcohol is allowed in the Foreign Trade zones, however, phone trade operations are under the control of foreign Border Protection and is department of architectural but regulations dont apply until that he leave the don so upgrade the produced in the zone rather than abroad this is to promote u. S. Activities the Program Allows companies to defer, reduce or eliminate duties on key components materials and machinery first of all, companies can eliminate diets on exported goods by u. S. Based companies to produce final goods rather than be reexported the foreign source never interu. S. Commerce and because of that they never also file for duty drawback a program if duty is paid on an item and reexported they possible get duties reimbursed it avoids that process it has inverted tariffs for producers to pay higher duties on products than made aboard the example of autopsy industry for testing beulahs Foreign Trade zones 18 a in from time to time essentially an all costs is assessed at 2 and a half percent duties when it is import into the u. S. Tesla uses burmz or electronic or others have a higher duties it is essentially penalize or puts them an aon a less level the Playing Field and it imports did with the operating in the Foreign Trade don tesla imports those components and when the good leaves and the financial automobile leaves the planted in from time to time it is seated the 2 nature percent car produced in japan or any other cia country so that 11 and on the items all the cars that tesla executors tesla decades 60 percent to the export market trying to develop those market 60 percent of cars known the components will ever have to pay kilograms duty not entering those u. S. Commerce. And then if there is a scrape involved in any production process there is a certain amount of scrape and product that mass to be destroyed that product will not pay a duty either. So duty elimination on executors and duty reduction an components and other duty referral a producer what weight to pay the custom duties until the products leave the site so they can save on
