Help substantiate what im saying that the hummer ran in the front three times, hitting a man in his 70s in front entryway. We heard he had trauma to lower half of his body. At some point then the hummer started to smoke. And then orange flames were seen emitting and shooting through the roof. Customers had to use a knife or some sharp object to cut the seat belt and get the driver out in time. They then dragged his body across the parking lot and pinned him down until police arrived. Police then cuffed him, took him to a hospital because he had burns on his face. This was more than chaotic inside of the restaurant. This was the height of the lunch hour. We talked to a number of witnesses. Here is short medley of what they had to say. I said, oh, my god. This guy has just ran into the building. It scared me to de would blow. He didnt stop. Sounded like a bomb going off. People were screaming. The people next to me in the next booth fell over and passed out. Kevin Fairfax County police tell us four people in total injured. The driver of the hummer, that man who was pinned up against the vehicle. The third Person Injured witnesses told us was one of the men trying to get the driver out of the hummer. The hummer was still moving around and one of those individuals got hurt in that process. The fourth person did not get taken to the hospital. Minor injuries for that person. We are told all four people expected to survive. But i will tell you from everyone we talked to, the man pinnedded against the silver diner in his 70s, it sounded like his injuries were severe. The driver in court in police say keith loving took over the bus and ran over anthony payne. Payne died. Today, Stephen Tschida is outside the courthouse. Those who knew payne are especially devastated because this is a man who was just doing his job when he became a victim. Stephen that is right. Right now 30yearold the 30yearold charged with seconddegree murder in this case, keith loving is appearing before the judge. We have video of just what went down yesterday in northeast d. C. According to charging documents which were just released investigators maintained that loving hijacked a bus with the needlenose pliers. He went after the driver, forced the driver off. The passengers fled. He took the bus on a wild ride and stopped at a gas station where payne was working. Surveillance video shows payne next to the stopped bus. They maintain that loving backed up and intentionally to ground by a dumpster where he was working. We caught up with one of paynes friends laying flowers a it a makeshift memorial. This is what he said about his friend who was killed yesterday. He never bothered nobody. He always was a helper. Yesterday he pumped my gas. We was talking. Its just sad. Stephen now we also learned from the charging documents that prosecutors maintain that when loving was taken to Howard University hospital because of his behavior, because he had resisted arrest and was acting belligerently and angry, they took him to Howard University hospital. They say they overheard loving tell medical staff there he had smoked p. C. P. And taken another drug named k2. The drugs are often linked to aberrant and violent behavior. According to the fed, 3 of students 12 to 18 years of age say they have been victims of a crime at school in 2014. 1. 3 Million Students were suspended for a day or more for alcohol violations. This is the shocker. Between 20012013 the number of sex crimes on campus more than doubled. What is still unclear is if that reflects increase in Sexual Violence or reporting of this kind of crime. He doesnt deny the murder but his legal team argues he wasnt sane at the time. North Virginia Bureau chief Jeff Goldberg reports from the fredericksburg courthouse. Jeff both the prosecution and the defense resting their cases today as we now get closer to a verdict in the murder trial of steven briel. The final witness for the defense testifying for several hours this morning, trying to build the steven briel is not guilty by reason of insanity. U. V. A. Forensic psychiatrist eileen ryan spent 121 2 hours evaluating steven briel and came to the conclusion he did not understand the consequences of his actions when he killed his roommate and fellow Mary Washington student grace mann in april of 2015. Dr. Ryan testifying that briel is schizophrenic and leading up to the murder his delusion and paranoia intensified. According to ryan, briel felt a group called the organization was trying to kill him and his three female roommates, especially grace mann were planning his murder. Grace is the one that is out to kill me, he told ryan. On the day of the murder, while home alone with grace, briel said to her why are you trying to kill me . And grace loudly responded in disbelief and he pushed her, ultimately leading to him stranglal and killing man strangling and killing grace mann. Dr. Ryan believed he knew the difference between right and wrong but he believes he was incas pating her to keep himself from being killed. This afternoon we heard doctor for the prosecution countering the claims of dr. Ryan. He believes that steven briel was sane in the murder of grace mann. Dozens of trains were passing through the smokefilled tum until the yellow line train that carol gloveer was on stopped. As a result she died. Brianne carter has more. Brianne Patrick Reagan the lawyer representing the family of carol glover, the woman who died in the smoke incident in Lenfant Plaza in january of 2015 speaking to us tonight. After the ntsb issued more than 30 recommendations for not only metro but other agencies here in this city. He said he was looking for information specifically related to what was in that smoke that filled not only the tunnel but the train. While t mr. Reagan says the report is still a positive step. He said until the report was issued, the law preventing him from moving forward in this case and now he expects that all the lawyers in the case will be able to meet with a judge in a matter of days. He says then depositions could begin as early as next month. He said until the ntsb investigation was finished and the report was, issued, they were prohibited from doing that. Glover son filed a lawsuit against the transit agency. Their lawyer again today saying the goal is to make metro safer. We are hopeful. The problem has been that safety was a last priority and not the first priority. The new head of metro i think now is appropriately placing safety at a higher level of priority than it has been placed before. So, yes, there is reason for optimism. We will have to see how it ends up translating into whether there is improvements.
