Union's Contract Arbitration Provision Not Valid, Judge Says
Law360 (May 27, 2021, 7:38 PM EDT) -- An arbitrator can't impose a collective bargaining agreement on four contractors because the arbitration provision their union counterpart invoked to break their impasse was similarly forced on them in the last round of contract talks, an Arkansas federal judge has said.
U.S. District Judge Kristine Baker of the Eastern District of Arkansas granted the contractors summary judgment Wednesday in their bid for declaratory judgment that Sheet Metal, Air, Rail and Transportation Workers Local 36-L couldn't force a contract on them again in 2020 after doing so in 2017.
