A rarely empaneled special grand jury is hearing testimony in the case of john gear, shot and killed right in his home by a fair fax county Police Officer. That happened nearly two years ago. This is what the gear family expected to happen in 2013. John gear says they were kept in limbo and given no information. When the Police Department refused to give him internal affairs reports. It took pressure from a United States senator and finally a judge in the familys civil suit ordered the release of the investigation. Im convinced if it wasnt for that civil suit i dont know if anything would have ever taken place. Reporter don geer says the most difficult part of his son johns shooting death by a fair fax county Police Officer was not knowing what happened for 17 months. Once i was able to finally read the report as to what the other officers had to say and all, that was a tremendous relief. Reporter john did have a gun in a holster but he never took it out or threatened the officers. It wasnt in his hands or on his belt or anything like that. Reporter don geer witnessed the shooting. He didnt know till a year and a half later that the officer who fired was adam torres, a special grand jury is now hearing evidence to decide whether to indict torres who remains on the police force on paid administrative leave. I hope that they find that theres sufficient evidence to put him up for trial. Reporter the day john geer was shot he had had an argument with his long time girlfriend who called police. She left with the kids and geer was the only one home. He stood in the hallway with hands up talking to police who tried to convince him to come outside. His hands were up. They were on the top of the screen. Reporter four Police Officers on the scene that day told investigators they saw geers hands up near his head. Officer torres said he pulled the trigger because he saw geer jerk his hands toward his waist. The attorney reopened his investigation and has subpoenaed at least 20 witnesses to testify before the special grand jury. Don geer says hes been asked to testify tomorrow. It would be a long process because that special grand jury is expected to hear the witnesses over this week and possibly in to next week. Then a simple majority of the panel will decide whether to indict officer torres. The Frederick County sheriff says tonight hes not sure if there is any place safe. Sheriff Chuck Jenkins was reacting to a brutal stabbing murder and assault inside a Korean Church sanctuary in a rural part of the county near sugar loaf mountain. Investigators say 30yearold song su kim admitted he stabbed two cooks at the anna prayer center. Chong wong park and his wife ko. Park died and ko was critically injured. I dont know what to make of it. I dont think people are safe anywhere anymore. Kim allegedly admitted to detectives that he stand park because he was agry and felt all koreans had mistreated and disrespected him and he stabbed ko when she tried to save her husband. The body of a second swimmer who went missing friday night off Cove Point Beach has been recovered. The judge questioned them individually. The defense is concerned that some jurors might want to punish holmes for possibly inspiring a copycat shooting. A florida man faced with a charge of Second Degree murder over a road rage incident that turned deadly.
