The issue was highlighted during a sentencing hearing in Cass County where a man served 90 days of home confinement for his involvement in a crash that killed two people while playing on his phone.
The program has been used in juvenile cases since 1998, but this was the first time in Cass, and possibly the state, that it was used for an adult criminal case before sentencing.
The victims argued for jail time saying distracted driving is the same as drunk or drugged driving but the judge said it doesn't rise to the same level of "egregious."
Jason Olsonoski also participated in restorative justice, during which he met with injured victims and family members of those who died in the crashed.
