Bacolod mayor maintains vow to serve after junking of poll case

"As expected, I had always believed it was not a protest to take seriously," he told reporters on Monday afternoon, but said he has not officially received a copy of the order yet. "We know for a fact it was a clean and orderly elections. There were no reported irregularities. Majority of the votes have already spoken. (We) might as well focus on more important matters in getting our services and commitments (delivered) to the City of Bacolod," he added. In Election Protest Case No. 008-2022, Leonardia had sought a manual recount of the votes in all 450 clustered precincts and asked the Comelec to declare "failure of elections" and conduct special polls due to alleged massive vote-buying and the presence of fake voters. After unofficial copies of the eight-page Comelec ruling circulated on social media last weekend, the camp of Leonardia also said they have not received yet a copy of the order. The Sept. 7, 2022 order, signed by Presiding Commissioner Marlon Casquejo and Commissioner Rey Bulay, dismissed the election protest for "being improperly filed and for being insufficient in form and content." "It bears stressing that the process of manual recount is not a tool intended to replace proof with suppositions or evidence with assumptions. Baseless and unsubstantiated protest remains impermissible in order to fully protect the true will of the electorate as truthfully reflected in the results of the elections," the order further stated. It added that "(t)hough defeat in any election is desolating for the losing candidate, an election protest must not be used as a vindication of a lost opportunity to serve the public, or at worst an unjustified assertion of wounded pride". During the May 9 elections, Benitez, who ran under the Asenso Bacolod party, got 171,893 votes while Leonardia of Grupo Progreso garnered 107,447 votes. In a statement, Leonardia's spokesperson, Dr. Chris Sorongon, said they "cannot comment yet on the reported decision being unaware of the reasons allegedly made by the Second Division". Still, he said their camp will "exhaust all available legal remedies to ensure justice will be done to the voters of Bacolod City". (PNA) }

In a press conference at the Planta Hotel here on Tuesday, Leonardia's spokesperson Chris Sorongon said the incumbent mayor lodged his complaint before the Comelec central office in Manila on May 20. It has been docketed as Election Protest Case No. 008-2022. "The move of Mayor Leonardia to file a complaint was in response to the people's clamor. The people of Bacolod want to know the truth," Sorongon said in a press conference held at the Planta Hotel, where he was joined by legal counsels Marcus Vaflor and Jireh Alimon. Benitez, a businessman and former congressman of Negros Occidental's third district representing the Asenso Bacolod party garnered 171,893 votes while Leonardia of Grupo Progreso got 107,447 votes in the mayoralty race. Sorongon reiterated that their supporters consider the results "mysterious and unbelievable". He said Leonardia, whose political career spans 34 years, is seeking a manual recount of the votes in all 450 clustered precincts and asked the Comelec to declare "failure of elections" and conduct special polls due to alleged massive vote-buying and the presence of fake voters. Vaflor claimed that a supposed massive and rampant vote-buying affected the results in all of the city's 61 barangays. Alimon, for his part, said their client deems it appropriate to file the necessary complaint to know the truth with the prayer that Comelec will conduct a manual recount and consequently declare a failure of elections to pave the way for the holding of special polls. Sorongon noted that during the campaign period, the Grupo Progreso mounted the longest caravan, drew a mammoth crowd during their miting de avance, and had a huge turnout of daily campaigns and handshaking sorties and caucuses as well as of survey results both done internally and conducted by independent institutions. These are on top of the achievements of the current administration and a clear platform of government, he added. Benitez, who campaigned on a platform of change, won along with ally incumbent Lone District Representative Greg Gasataya, who clinched a third and final term. "The difference was simply mysterious and unbelievable, especially in areas we consider our bailiwicks. For now, we will leave the matter with our legal team," Leonardia said in a statement on Tuesday night. The standard-bearer of Grupo Progreso garnered 107,447 votes, which is 64,446 lower than Benitez's 171,893 votes. Leonardia added that "many were in disbelief when the votes were counted and announced over media outlets and social media sites, considering that his numbers and that of his opponent resulted in an almost consistent pattern". "It will be up to the lawyers to study and look into possible legal remedies so that we can have the vote counting machines rechecked to satisfy the questions raised by the Grupo Progreso slate and all our supporters," he said. Leonardia thanked those who stayed with Grupo Progreso and supported his family in these challenging times. "All your efforts did not go to waste. Your love and support are highly appreciated. You have been a source of inspiration and strength for me all these years," he said. Reacting to Leonardia's statement, Benitez, a former representative of Negros Occidental's third district, said on Wednesday that "the truth hurts". "If they want to file a complaint, it's their prerogative. During the campaign period, we can already feel the people coming out, showing their support for us. I knew we were on the winning side," he told reporters after attending the proclamation of Negros Occidental Governor Eugenio Jose Lacson and Vice Governor Jeffrey Ferrera at the Provincial Capitol here. In a stunning upset that ended Leonardia's long-time dominance as city mayor, Benitez, who campaigned on a platform of change under the Asenso Bacolod banner, obtained 171,893 votes compared to the Grupo Progreso standard bearer's 107,447 votes. "This is a win for the people of Bacolod. The change that we're looking for is what I intend to bring," Benitez told reporters after he was proclaimed by the Board of Canvassers at the City Council session hall on Tuesday. Other winners included reelectionist Vice Mayor El Cid Familiaran, who got 128,893 votes, to defeat former councilor Caesar Distrito, with 103,236 votes, and outgoing councilor Wilson Gamboa Jr., an independent candidate, who earned 32,033 votes. Lone District Rep. Greg Gasataya of Asenso Bacolod was elected for a third and final term after garnering 185,470 votes, edging out closest rival Dan Atayde, who obtained 80,591 votes. Familiaran and Atayde ran under Grupo Progreso while Distrito is with Asenso Bacolod. Former vice mayor and councilor Jude Thaddeus Sayson took the number one spot in the City Council, with 134,635 votes, followed by incumbents Israel Salanga and Cindy Rojas for the second and third places, with 123,237 and 122,629 votes, respectively. Former councilor and city administrator Em Ang placed fourth with 116,953 votes while incumbent Al Espino landed fifth with 115,197 votes. Newcomers Vladimir Gonzalez and Jason Villarosa obtained 113,145 and 111,027 votes, respectively, to land in sixth and seventh places. Incumbent Renecito Novero got 113,046 votes for the eighth place while returning Claudio Puentevella, with 108,950 votes, took ninth place.
