Former u.s. attorney elie honig is outfront with us. he sat in on both hearings today. in neither case did a judge rule, but that doesn t mean what happened today was significant in terms of what could happen with witnesses testifying. i want to start with the former white house counsel don mcgahn s case. he was subpoenaed by house democrats in april. he ignored demands to appear. what did the judge in this case signal? it was so interesting to see fist of all, pam. it was like battle of the branches in action. on the right-hand side, you had a team of lawyers for the house, for the congress. and on the left-hand side, you had a team of lawyers for doj, the executive branch, all happening within the judicial branch. the judge asked a lot of pointed questions about the white house doj s theory of absolute immunity. essentially her line of questioning was how can you maintain this position that no executive branch official ever has to answer if the president says no? and candidly doj ....
