Department. now, scavino and three other trump aides, mark meadows, steve ban no one, cash patel, they are all supposed to give witness testimony next week. it sounds like at least some may be willing to cooperate. unclear what their legal strategy will be. however, we have heard from the former president in the past that he is ready to use executive privilege to try to muck up this investigation. can he do that? does he have authority as a former president? i think there is a very weak argument there. the executive authority belongs to the president of the united states, and right now that is joe biden. so it is the president s authority to assert executive privilege. now, sometimes presidents do assert executive authority because they want to preserve that for the presidency itself. but in this case, so far the indications are from the biden ....

Next week, when all four of those witnesses have been subpoenaed to testify. that to me, is the more vital subpoena. and it s the subpoena that if i were in the house, i would be focused on. because the recent mug and that wound its way, during the last congress all the way through, the d.c. circuit. ultimately, nullified donald trump s assertion of something he called, absolute immunity. which just prevents top executives, or top crp officials to the president, trump testifying altogether. that does not exist. so if you are not subpoenaed by congress, you must show up, at a very minimum. you can assert executive privilege, there can be a representative from the executive branch, who can exert executive privilege to particular questions. but you still must show up. so when benny thompson talks about criminal referrals, i ....

Congress and the house can go to court to enforce the subpoenas, which we saw in the last congress. it takes inordinately long, perhaps longer than we have left in this congress to find its way to the courts. they can discuss with the witnesses, lawyers, some accommodation to have them give some documents but not all. but, i think it s all going to be academic, because i would expect donald trump to file a lawsuit to prevent the witnesses from providing the documents that are asked based on executive privilege. now, that is going to be legally baseless, it s not his decision to make in the first place. it s joe biden s decision to make. and biden has already indicated that he is not going to assert executive privilege. but that doesn t stop donald trump from litigating it. so, the next big day will be ....

MSNBC Alex Witt Reports September 26, 2021 16:30:00

The white house is shutting down donald trump s attempt to shield his white house documents from the january 6th committee. for weeks, trump has vowed to fight the release by evoking executive privilege, that s a notion white house press secretary jen psaki refuted during a briefing on friday. i would say that we take this matser incredibly seriously. the president has already concluded that it would not be appropriate to assert executive privilege. and so we will respond promptly to these questions as they arise. and certainly, as they come up from congress. joining me now, msnbc political analyst and chief white house correspondent for the new york times, our really good friend peter baker. so, peter, as i welcome you on this sunday, what could posable be in these documents that is of interest to the january 6th committee? i m sure it s kind of a wide range of things. so where do you start? right, exactly. well, the committee asked the national archives to identify ....
