The Magnolia Boulevard eatery filed a countersuit in July 2021, arguing in their court papers that Tinhorn Flats "suffered immensely" while other non-essential businesses were allowed to stay open.
Tinhorn Flats, which did business in Burbank, and Cronies Sports Grill in Agoura Hills were the subjects of a public nuisance suit filed against the businesses in January 2021.
"The restaurant closed two years ago," Judge Armen Tamzarian wrote. "There is no longer any need to enjoin defendants from operating it."
A countersuit filed by the former owner of the Tinhorn Flats Saloon & Grill and his children against the city of Burbank over the city's shutdown of the eatery in 2021 during the coronavirus pandemic can move forward.
Los Angeles Superior Court Judge Armen Tamzarian said that of the nine causes of action in the countersuit, only the one for violation of the First Amendment can proceed without any revision.
