Charges that the committee is going to vote on whether or not to refer donald trump on. let s assume that they do. tell us about these referrals. so, jake, there s no legally binding impact to these referrals. prosecutors can and do take referrals all the time from all manner of sources. it doesn t require doj to do anything. doj does not need a referral to do anything. however, this would still be enormously significant if the committee decides to make this referral. we would have a bipartisan committee saying to the doj, we have done our work. we know they have uncovered all manner of evidence. i don t think it s at all a coincidence. they re under consideration. the doj has already gone in front of a judge and said not to brianne indictment but enough to get certainly investigative material. and the judge agreed. they re trying to sing off the same play sheet. that s the judge carter case ....

Fine. red is obviously not. indeed criminal. and what we learned, want to leave this up on the screen for a second, is there were a lot of different plots to overturn the election. some might have been allowed at first. some were clearly criminal by the end. how important do you think as someone who is writing about this is it that this committee ends, they end with this hearing and a written product that is volumous. how important is it they end with a story for the american public? and is that story about one insurrection or riot or broader? the story is the thing here. because this recommendation is not legally binding. the justice department is going to conduct its own investigation and make the charging decisions on its own. this is much more of a moral statement. but, you know, how the committee sees its findings and sees what trump s culpability should be. so much of the investigations into trump, the likely you know, what i think is probably ....

Judges, all federal judges, and it s just that it s not binding on the supreme court. and so they consulted, that is the word that the chief justice used, but they don t, they are not able to enforce it against one another. and they certainly don t appear to be enforcing it as against themselves. and so i think that this goes to this kind of cardinal, ancient principal that no man should be a judge in his own case. they are left to police themselves, and they, i think, do it by ways of feelings. if they feel it s okay for them to fly out with donors and have dinners at their mansions or at their clubs, and i think it is okay to pray with people who have interest before the courts, and that s where the inquiry stops. i think the solution is to make some version of the cannons encodes binding on them and have a way to enforce it. jeff, what is your take on ....
