the fulton county case have surrendered we are getting into the complicated questions about how the trial will proceed. we are seeing that even in some cases the defendants themselves are at odds with each other. for instance, two of the defendants, kenneth chesebro and sidney powell requested a speedy trial. that's something that former president donald trump is opposed to doing. a judge set a case date for chesebro in october. it remains to be seen what that means for the rest of the defendants. now, another issue here is whether this case is kept in state court or moved into federal court. we have seen five of the 19 defendants have made a request to move their case into federal court. this is significant because it would change the jury pool. in state court, it would be in fulton county, a very blue county, but the federal court would expand the district and the jury pool potentially inc including more pro-trump jurors. with monday we will get the first hearing about the venue of

willis wants. the former president and his lawyers do not want to have a trial so quickly so that issue is going to have to be litigated ahead of the trial. another issue is which venue is this trial going to take place in, whether it's going to be in state court or federal court. we've seen 5 of the 19 defendants that have made a request to move their cases to federal course, that includes mark meadows, jeffrey clark, the former doj official, and three georgia officials who served as fake electors. now, one of the reasons they're doing this is that the jury pool in fulton county, it's a very blue county, if you move it into the federal district, you include more of the county surrounding fulton county, which gives you potentially a more pro-trump jury pool. on monday there will be a hearing for mark meadows' request and we could get a preview of the case against meadows and the other defendants as fani willis has subpoenaed

43% of the vote. 43% of 12 jurors is five. all you need is one, trump loyalist on the jury, you can get a hung jury. but still, it's better for the government then in miami or in four pairs. >> and neal katyal, we've heard, i think, on several programs, people making that program. it only takes one to get a hung jury. but a hung jury in this case just means jack smith goes back to court and charge the case against. >> yeah, sometimes, certainly prosecutors do that. on the case of 100. but look, lawrence, i'm sure it's important, as the last guest just mentioned. to think about probabilities, and so on. and which juries might be influenced more one way or another. that's all helpful and interesting, speculation. but at the end of the day, this is an ironclad indictment. i'm a big believer in the jury system. i'm a big believer in it whether it's a red county, or a blue county, or purple county. or some other color. because the american jury system is something i think we should all be tremendously proud of, it generally reaches

i think is best chance of all in fort pierce, even better than in miami, which could be troublesome, or the prosecution, and definitely better for trump than in west palm beach. where i live, which is a blue county. >> so dave, too quick follow ups on. that is it possible that the chief judge in the district would be able to, basically, order the trial to take place in one courthouse or the other, for security reasons? >> it's tricky, lawrence. i looked at the role, and it's vague. now the chief judge can take the case and give it to a different judge. and under the rule, it's whenever it's necessary in the interest of justice. and expediency. when it comes to a change of venue, it's vague. and i think what would happen, if it becomes a security issue, the chief judge would go to judge cannon, and say, hey, can you move it, please? they are not going to force judge cannon to drive 130 miles from fort pierce down to miami, that's three hours in traffic, each day, each way.
