而现在撤销其罪行，根据法院长达79页的书面文件可得出，主要有两个原因。第一，是康斯坦德与科斯比达成民事和解时，科斯比曾和检察官布鲁斯・卡斯特（Bruce Castor）达成不起诉协议。法院引用了这一协议称，既然这份协议存在，就应当遵守。而且后来对科斯比追究起诉时，采用了当时在不起诉协议下科斯比的陈述，因此在程序正义上对科斯比不公平。第二，法官还发现，与此案无关的证人与证词影响了审判。在第二次审判中，法官允许另外5名自述受害者出庭作证，但他们的经历和证词无法直接证明科斯比性侵了康斯坦德。
