joining us now is fox news legal editor, and we love the new role that you are playing here at fox news. we had you on a lot when you were at the department of justice. so the house ways and means and judiciary committees have subpoenaed four officials, michael, the irs director of field operations, special agent in charge, and another special agent in charge, and fbi assistant special agent in charge to talk about david weiss and a meeting in october of 2022, he allegedly said that he wanted to bring charges against hunter biden but was told that he couldn't. what do you think the committees could learn from these individuals if they comply with the subpoenas? >> they are going to try to corroborate weiss's account he did not have final charging authority and that he was not able to bring charges in other districts.
has a charging authority. so, if he has that charging authority, why does he need to be given this special counsel authority? it's just confusing. >> well, you said he was told -- you were told that he was turned down. who told you that? >> united states attorney weiss, october 7, 2022. i documented that right then. >> that's correct, by d.c. u.s. attorney. then he requested special counsel authority from doj. they denied it and told him to follow the process. that is corroborated. there were seven people there. two people at that meeting have corroborated what happened so far. and there's been no contradictions that what he said during that day is not accurate. >> well, i think there is confusion here because you said that after this meeting that you had asked about it and that weiss stated he is not deciding person on whether charges are filed. but he hasd the opposite of

june 7th of this year and june 30th. the june 7th letter says i have full authority. before special agents testified in front of the house ways and means committee. the june 30th letter, it's released after our testimony was voted out by that committee and made public. and it was clear that the united states attorney weiss changed his story because he says i have full authority to charge. the june 30th letter he says i have full authority charge. it's an important paragraph where he says after that, he says i don't have the authority to charge outside of delaware. i would have to partner with a u.s. attorney where a venue exists. and this announcement yesterday is unquestionable vindication of the special agent coming forward. this is the crux of the issue we forward to the committee. >> in that june 30 letter, he makes reference to his charging
-- joins me now with more. was anything new learn today, melanie zanona? i >> would say anything new, necessarily, was learned, but the hearing did bring to light estimate that was previously behind closed doors and that really cause a firestorm among republicans on capitol hill. you have these two irs whistleblowers who testified publicly today that the doj interviewed and slow walked the criminal case into hunter biden, over attacks and gun charges, at that they didn't take recommendations for more serious charges. and at the center of these allegations, really, is this october 2022 meeting involving david weiss. he is the trump-appointed u.s. attorney who is overseeing it is hunter biden case, and one of the irs whistleblowers, gary shapleigh, was in that meeting. and he claims that, during the meeting, whitehead said he does not have charging authority, and that he sought special special counsel status but was denied. now, weiss himself has vigorously denied the account of that meeting. the doj has also denied all wrongdoing. but clearly, there is still a lot of questions around this

"my charging authority is geographically limited to my home district." you just told me you have ultimate authority. now you change it. then again on july 10th, mr. weiss wrote "senator graham, to clarify, i have not requested special counsel designation. rather, i had discussions with departmental officials. "he cannot get his story straight. three different stories in a five week time frame.
nominee for president of the united states. therefore the election clauses with the doj policy took place and were in effect. it was not until september 4th that the department of justice public integrity said that we can no longer take any actions on that case, and as early as -- -- as early as april to june of 2020, the department of justice and the delaware attorney's office was invoking the election as a reason not to perform those search warrants. >> time has expired. the chair now recognizes the gentleman from ohio. >> he said i've been granted ultimate authority, including responsibility for deciding where, when, whether to file charges. later that same month, the second letter where he said no, i don't. now, i don't have that charging authority. so he says i'm the boss, i can
expand. he says my charging authority is geographically limited to my home district. if venue lies elsewhere, it's common department practice to contact the usa attorney for the district in question. he says and determine if they want to partner on the case. well, the testimony of shapley is clear that he did go and seek the biden appointee in the district of columbia, the u.s. attorney for approval and that was denied. now we're getting to a point that he's talking about talking to the other u.s. attorney but he's not getting fully to the story. what happened when he went and talked to the u.s. attorney. then he says, i've been assured that if necessary after the above process that i would be granted authority. that's not the same thing as having been granted the authority like attorney general garland says or like weiss said in his first letter. >> martha: it's a lot of careful wording here and a lot that you can read into these -- the way
