Play the tape, explain how high the bar is and where we have an opportunity to at least have a federal grand jury look at this if at all, in your opinion. kendall? yeah. i m listening closely. what we walk me through. how high is the bar to get a federal indictment? here s the standard. it s not as some have suggested anything to do with an analysis on the spot of the constitution. nor is the civil rights crime require any proof of racism. the use of excessive force. unless a jury has a reasonable doubt, thinks there s no probable cause, that there was an improper chokehold causing the death. remember we know the coroner said death resulted from the compression of the throat, neck and chest. ....

Was, compression of neck, choke hold, compression of chest and prone positions during physical restraint by police. the grand jury was convened in september by district attorney daniel donovan to decide whether or not there was probable cause to indict the officer seen on that tape ignoring garner s cries that he could not breathe and like the grand jury in ferguson, this one was a little unusual. especially convened to consider the specific case and like the ferguson grand jury it also heard all the evidence gathered by prosecutors like the ferguson grand jury. this one heard months of testimony from witnesses including two hours of testimony from the police officer whose indictment they were considering, pretty rare for a grand jury proceeding. last night on this show, i asked new york congressman hakeem jeffries what kind of outcome he was expecting. i can t really imagine a circumstance, chris, where we at least don t get a manslaughter indictment coming out of this grand jury. a ....

But the medical examiner ruled death by homicide, compression of check and compression of prone positioning during physical restraint by police. so i think we re sort of getting into the weeds of whether this was a chokehold or not. i do believe when i look at it from a former prosecutor s perspective, it is clear to me that that was the use of excessive force. i don t know, and i m sure, officer, you will disagree with me, when you talk about resisting arrest, i ve seen a lot of resisting arrest cases and we are having a man with his hands up saying don t touch me. you can t say it is not excessive for an officer to come up from behind, choke him, use a tactic that has been banned by police procedure in police procedure and somehow say that that was an appropriate use of force. i m sort of surprised. how do you let me say something. what a lot of people don t understand is that man was a big ....

Neck and chest compression. if you look at the video, the rough treatment mr. garner was being subjected to not just by one but several officers, it defies belief. on the smallest amount of assault up to second-degree murder. it defies belief that there was no indictment here on one of those charges. the reason police said they were talking to mr. garner in the first place is selling loose cigarettes. is that even to your knowledge an arrestable offense? is that something normally just ticketed or would somebody normally be arrested for that? well, you know, i think it s probably a summonsable offense. i think you can get a summons. but they had a suspicion he was ....

Unarmed man may have come down to a key piece of evidence, a cell phone video that showed what happened during the fatal encounter with the police. while much of the focus outside of the grand jury has been on the moment that officer pantaleo takes garner down in a chokehold, the grand jury may have taken into account the action of the other officers. one officer was seen pushing his head into the ground and while other officers pinned him down. the medical examiner found that it was not just the chokehold that contributed to his death but also compression of chest during physical restraint from the police. garner s pre-existing health conditions listed as other reasons. the other officers were granted immunity. this video taken by a second cell phone shows that even while garner remains unconscious, officers hover over him not doing anything to save him. seven minutes go by with garner ....
