MPs pass bill on compensating unlawfully sterilised women

A bill to compensate women unlawfully sterilised mainly by the former regime passed a second reading in the lower house of Parliament on Thursday. If the bill becomes law, victims – mainly Romani women – could apply for a one-off payment of CZK 300,000.
Beginning in 1966, Romani women and others where systematically sterilised without their full and informed consent as a way of controlling their birth rate. State policy in Czechoslovakia fully regulated the practice in 1971, as the Czech Public Defender of Rights noted in a 2005 report.
The statute of limitations on financial compensation for non-pecuniary damage is three years. Without special treatment from a judge, hundreds of victims would therefore be ineligible for compensation. Women who underwent sterilisation between 1 July 1966 and 31 March 2012 are eligible for compensation. According the bill’s authors, up to 400 people could apply.

Hundreds, potentially even thousands of Roma women were involuntarily sterilized in the Czechoslovak Socialist Republic in the 1970s and 1980s. Even after the fall of communism in 1989 and the country's split into two independent states in 1993, forced sterilizations of Roma women continued in the successor states, the Czech Republic and Slovakia.

The draft law stipulates that women who were sterilized against their will must prove their claim, which will be assessed by a Health Ministry commission. "The procedure was necessary to make the draft enforceable," Valkova argued. The Czech Commissioner for Human Rights underlined that an estimated four hundred women are entitled, not thousands. "So contrary to previous contentions, the compensation will not cost billions of Czech Koruna," she said.
The amount of compensation was decided on the basis of a 2011 ruling by the European Court of Human Rights on a case brought by Slovak Roma women against Slovakia for their forced sterilizations, when they received a similar sum, said Valkova.

According to the director of the Open Society (Otevřená společnost) organization, Marta Smolíková, the Czech Public Defender of Rights (ombudsman), Stanislav Křeček, should resign for refusing to acknowledge the existence of discrimination against Romani people. She told him so on a program broadcast by the Proglas 13+ radio station.
An open letter signed by representatives of organizations that promote human rights, people facing adversity and the Romani minority called on Czech Prime Minister Andrej Babiš (ANO) and members of the lower house to distance themselves from the anti-Romani remarks made by the ombudsman and was raised as a topic of discussion. "During the 30 years that we have been doing the integration of Roma, nothing has changed. The situation keeps getting worse - more Romani children dropping out of school, many not preparing themselves for future employment, unemployment growing, excluded localities increasing. However, when I critically mention that we must not continue this, that we have to change the situation, it's considered an anti-Romani attack. That is an example of where the discourse on the integration of Romani people finds itself at this time," the ombudsman said when asked to comment on the open letter.
