She was initially jailed on a charge of tampering with evidence. Two others, 27-year old Dylan Ray Walker an 27-year old Ben Rivera are charged with tampering with evidence. Balboa is the girlfriend of Samuel’s father. The mother of Samuel wants to know why his father isn’t in custody. ABC affiliate KTRK 13 News in Houston is reporting that Theresa Raye Balboa has now been charged with Capital Murder in the death of 5-year-old Samuel Olson. The body of the child was found in a Jasper motel room, along with Balboa, on the evening of June 1st. Balboa, 29, is one of three people charged in the case. She was arrested shortly after the childâs body was found and has been jailed ever since. Her initial charge was Tampering/Fabricating Physical Evidence-Human Corpse.
