COVID-19: District to hold hearing after De Soto School District receives challenge to mask requirement

The De Soto School District said it will hold a special hearing at 8:30 a.m. on Thursday to review its mask mandate after somebody challenged the district’s face covering requirement.The hearing will take place after Kansas Gov. Laura Kelly’s executive order aimed at encouraging Kansas counties to keep COVID-19 mask mandates was revoked recently by the Republican-controlled Legislative Coordinating Council. The LLC’s move comes after Senate Bill 40 was passed. Senate Bill 40 provides that employees, students and parents or guardians of students who are aggrieved by an action taken, order issued or policy adopted by a board of education of the district in response to COVID-19, may request a hearing to contest the action.The law states that hearings must be held within 72 hours after a request is received. The De Soto School District said it received the request for a hearing on Tuesday.“It is important to note that decisions on any of these matters will be made by the Board of Education within seven days after a hearing,” the district said in an email to parents. “Additionally, there is no public comment option during a hearing. If an individual who files a complaint is not satisfied with the outcome of the hearing, then they may file a civil suit in district court pursuant to Senate Bill No. 40.”[ READ FULL KANSAS SENATE BILL 40 ]The hearing will take place Thursday morning at the district’s office in in De Soto and only individuals participating in the hearing will be allowed to attend.Similar hearings have taken place in the Blue Valley and Olathe school districts.
