North Battleford Crown Prosecutor Oryn Holm and defence lawyer Don Smith entered a joint submission to the court for a nine-month conditional sentence. Charges of discharging a firearm with intent to endanger life and assault of a police officer with a weapon were withdrawn. McAlpine and four others were charged after an incident on Onion Lake Cree Nation on Jan. 1, 2021. Holm told the court there was no evidence McAlpine in any way encouraged the flight from the police or shooting at the police, and she was in the vehicle when the incident happened but not a willing participant. He said her culpability comes from the knowledge that there were firearms in the vehicle. ....
“I was convinced that day it was only a matter of time until the accused’s SUV or bullets killed someone,” said RCMP Const. Jacob Isaac who was involved in the pursuit on Onion Lake Cree Nation Jan. 1, 2021. “This was a feeling very few will experience and was a heavy burden on all of us to accept that we had to potentially die trying to stop this out-of-control threat to society. “I can remember hearing the updates on the radio as we all pursued and I think to myself ‘how do we stop this before someone dies?’ As various scenarios ran through my head on how to stop them, very few had the likelihood of coming out uninjured or (not) killed,” said Const. Isaac. “I’m confident my co-workers had the same gut wrenching thoughts.” ....
“I just have to meet with (McAlpine) to discuss it,” said Smith, who requested a one-month adjournment. North Battleford Judge Daniel O’Hanlon, who was presiding over Lloydminster Provincial Court, granted the adjournment. McAlpine, along with Glynnis Larene Chief, 37, Twaine Derek Buffalo-Naistus, 39, and Tyler Ryan Wolfe, 35, all from Onion Lake, along with Danny Lee Weeseekase, 38, from Makwa Sahgaiehcan First nation, were arrested on Onion Lake Cree Nation Jan. 1, 2021. RCMP say they were pursuing a black SUV on Onion Lake Cree Nation when a firearm came out of one of the SUV’s windows and multiple shots were fired at police. No one was injured. ....
Judge Kim Young asked the Crown what its position was on the requested adjournment. “She is making progress so that’s good,” said the Crown who wasn’t opposed to the adjournment. The Crown added there are new charges of breach of curfew on Jan. 24 against McAlpine. In connection to the Jan. 1, 2021, incident, McAlpine is charged with discharging a firearm with intent to endanger life, being an occupant of a vehicle knowing there was a firearm, and assault of a police officer with a weapon. McAlpine, along with Glynnis Larene Chief, Twaine Derek Buffalo-Naistus, Tyler Ryan Wolfe, and Danny Lee Weeseekase, were arrested on Onion Lake Cree Nation Jan. 1, 2021. They allegedly shot at Onion Lake RCMP who were pursuing the SUV they were driving on Onion Lake Cree Nation. One of the occupants allegedly pointed a rifle out of a window and started shooting at the police. Police continued to pursue the SUV, which eventually stopped in front of the high school on Onio ....
“There’s quite a bit of moving parts,” he said adding there will be 14 witnesses. Holm said the Crown is proceeding by way of indictment, the more serious offence. He also said the Crown continues to be opposed to Chief’s release. Chief and four others were arrested Jan. 1, 2021, after allegedly shooting at the RCMP pursuing them on Onion Lake Cree Nation. RCMP were pursuing an SUV on Chief Taylor Road when one of the occupants allegedly pointed a rifle out a window and started shooting at the police. Police continued to pursue the SUV, which eventually stopped in front of the high school on Onion Lake. The driver, Tyler Ryan Wolfe, 35, and a front passenger got out of the SUV and fled. Police soon found Wolfe hiding inside a garbage bin and the passenger was found in a nearby baseball field. Chief, Twaine Derek Buffalo-Naistus, 39, Danny Lee Weeseekase, 38, and Melissa Lee McAlpine, 32, were arrested and charged with numerous offences. ....
