the bind also extends to the white house. it s easy to get turned upside down here. it s not clear to me which is more damaging to president trump, if he s wrong or if he s right. as rebecca said, the president cannot unilaterally order the wiretapping of anyone. which means president trump has either made a wildly unfounded accusation, with no evidence to support it, or door number two is that a court, either a fisa court or a federal court found sufficient evidence of collusion with a foreign power to justify the granting of a wiretap, the authorization of a wiretap. it s always been a little bit unclear to me why, as this has broken, why proving that happened would be advantageous to the administration, because it would mean enough information was presented to a court to reach that authorization. we have now had a cascade of officials over the weekend saying it never did happen in the first place. again, that is the better outcome, that a court was ....

Now, it s a little harder. the massachusetts court just refused to renew a stay, whereas, the washington courte actually granted a stay. so the granting of the stay is a kind of tougher order than refusing to grant the stay. if i were the lawyer for the justice department and i were being prudent and cautious, i would say you really have to comply with the washington state order. if you want to be aggressive and the trump administration could be aggressive, they could say no, we re going to comply with the massachusetts order. i think the white house was revealing and saying we re going to appeal. that means they re not going to take the law into their own hands and simply comply with the order that s more favorable to them. that s interesting. i m glad you pointed that out. we had the attorney general on earlier from washington state and someone asked him what if the president refused to abide by this and he said, well, the president is not above the law ....

Advisers are in agreement that anyone who don t agree are trump and bannon it seems. right. josh rogan from the washington post did this today and apparently bannon tried to stop kelly from granting that we were last saturday night. he did it anyway and he told bennett, you are not part of my chain of to command and i only take orders of the president. he he was not ordered by president trump from granting the waiver and so he has granted it. since then he has spoken very well and said port of the executive order and why parts of it is legal. right now they have to suspend using it because of a court order, they have to suspend the new rules, but with that said there is a real dissent here be inner team and those in the cabinet who are around these agencies. they they are going to have to clean this up. thank you very much. we appreciate you coming on. ....

Judge, appointed by president george w. bush issued a temporary restraining order, shutting down an executive order signed by the president of the united states. federal judges don t do that lightly. you have to show that you re likely to prevail on the merits, that there s significant harm that will be done if the judge does not take that action. those are steep hurdles and the judge met each of those hurdles. when you say shutting down the executive order, do you know if that means shutting down the rescinding of the visas to whether it s 60,000 or 100,000 people who had their visas rescinded or shutting down the executive order meaning there will be no pause in the granting of the regular granting process for visas from these seven countries. do we know at this stage? i m not sure we can say at this stage, that level of specificity around the visas i ....

Could. would you explain a little bit about the impression of confusion. we heard from some of the airlines that they felt they were getting contradictory guidance. especially with regard to whether or not people who were legal permanent residents would be allowed to board aircraft and where they will get the secondary screening that people started talking about. perhaps you could explain a little bit about that level of confusion and why that develope developed? so, under the executive order section three, there is a provision for granting of waivers when it s in the national interest. so lawful permanent residents are technically covered in the executive order as immigrant visa holders. we ve worked quickly with counsel to devise a waiver process. the secretary had given guidance that a returning resident, their status is dispositive that it s in the national interest to welcome them home. so what we got that guidance, we were able to delegate the ....
