The complaint is filed in Federal District Court in Akron. No trial date has been set. Margaret Montgomery of Wooster filed the Fair Labor Standards Act and state Minimum Fair Wage Standards Act complaint on behalf of herself and all others in a similar situation, according to court documents, and seeks damages, which include back overtime pay, from Homes County Sheriff Timothy W. Zimmerly. Montgomery submitted her notice of resignation to the Sheriff's Office in early September.
