Denver City Council Approves Group Living Zoning Overhaul


The changes regarding those facilities inspired the two no votes. My concerns with the residential-care side will be too numerous to support, Councilwoman Amanda Sawyer said before voting against the proposal. Councilman Kevin Flynn also opposed the measure.
Council finally voted on the proposal after a meeting that pushed past 1 a.m. and featured testimony from over 100 members of the public. Two-thirds of those expressed support for the measure, while the others had concerns about various provisions in it.
One resident worried that more communal-living situations like the 24/7 frat house next door to her home might pop up: There were four people on the lease, who had ten people living there and fifteen cars, and they turned their garage into a strip club that opened up after the bars closed. Group Living Zoning Overhaul Set for Denver City Council Vote


On February 8, Denver City Council will vote on a group-living ordinance that marks the most significant attempt to overhaul the current Denver Zoning Code since it was enacted in 2010.
After three years of research and preparation and four months of in-depth work with City Council’s Land Use, Transportation and Infrastructure committee we have arrived at a balanced package of amendments that improves Denverites’ ability to seek care and share housing costs, while also making it easier to regulate these land uses, Denver Community Planning and Development says in a fact sheet outlining the group-living proposal.
The measure would increase the number of unrelated adults who can live in the same home from two to five, and also allow service providers to more easily establish residential-care facilities, such as halfway houses, homeless shelters and sober living homes, throughout Denver. There are numerous things to dislike about the Group Living Amendment now before the Denver City Council and scheduled for a vote on Feb. 8. One of the most glaring is the statement made by the city’s Department of Community Planning and Development (CPD) in its presentation material when the Group Living Proposal was first submitted for public review. It read: “We have exclusionary regulations with roots in classism and racism.”
That seemed to me to be a rather harsh and unreasonable statement being that, when I first took up residency in the neighborhood where I’ve lived for 45 years, I was not informed about the racist/classist nature of the neighborhood nor did I become aware of that state of affairs until the truth of the matter was revealed, thanks to CPD. ....

Withheld records about Denver housing advisory committee do not reveal 'give and take' and must be disclosed, judge rules

A judge Monday ordered Denver Mayor Michael Hancock’s office to publicly disclose all but four pages of withheld emails about an advisory group formed to examine single-family housing rules.
The mayor’s office had invoked the deliberative process privilege in the Colorado Open Records Act (CORA) to deny Florence Sebern’s request for documents concerning the Group Living Advisory Committee, and it had claimed the records were protected by attorney-client privilege.
But Denver District Court Judge Michael Vallejos, who examined the emails and attachments in private, determined that most do not reveal a “give and take” and, therefore, are not deliberative. While meetings about the committee and its formation “may have had plenty of robust deliberation, those were verbal and not reduced to writing or a transcript,” the judge wrote. ....
