Dublin pub fails to stop action against it over water leak Action arises out of leak believed to have caused loss of one million litres of water a day about 4 hours ago The operators of Dublin’s Leopardstown Inn have failed to get the High Court to dismiss an action against them arising out of a major water leak seven years ago outside the premises. The leak, allegedly caused by damage to a main during a drilling operation for a water source, was estimated at the time to have caused the loss of one million litres of water a day for a fortnight before it was discovered in February 2014.
FBD disputed this, arguing that the closures did not occur as a result of an outbreak of disease at the premises or areas where the pubs are located. It said it has never provided cover for pandemics and no-one in Ireland has ever asked for it. Speaking on the result, Noel Anderson, managing director of Lemon and Duke, told The Journal.ie: “It should never have come to this. I specifically had taken out a business interruption policy to protect us against Covid-19 and its potential impact on our business. As the court heard during the trial, this was acknowledged in writing by FBD.”
