>> steve: listen to this. there's a fight brewing in new jersey where essentially it's the new jersey governor phil murphy's own backyard. the dispute is three school districts there. one of them in a town where murphy lives implementing new policies to require schools to november -- rather, to november parents if their child formally wanted to change their gender identity, pronouns, or name, use different bathrooms or even change the gender of sport teams they play on. joining us now are parents and school board members of the middletown district, frank capone and jacqueline tobacco. good morning to both of you. >> good morning. thanks for having us. >> you bet. jacqueline, this started about a year ago. explain. >> it did. we had been in a policy meeting and heard from the administration that test scores were being -- the names were being whited out to send home to parents and we were a little
concerned saying are we actually being do you duplicitous to pa. we weren't telling parents when children needed mental health. hiding if it was a gender related reason. we were telling them it was anxiety or another reason. so we were a little concerned as the board that this was what was going on and we were not being truthful with parents. >> steve: right. exactly. frank, don't parents have a right to know if something like that is going on? >> you know, i have to say there is absolutely a right. the fact that we're actually even having this discussion concerns everyone. the parents and the children do have a right to know. that's the backbone of education in america in our country. and it's crucial in developmental stage of child and education. and as elected official, that's not our job to take on parents' rights away. >> steve: jacqueline, i
understand the attorney general for the state we live in the attorney general is trying to block the guidelines of those three school districts. they apparently think this is a okay. >> correct. yeah. within 24 hours of us passing our policy, we were -- the a.g. filed a lawsuit against middletown, and marlboro. it was a little shocking. >> steve: no kidding. >> said our policy was discriminatory. >> steve: sure. frank, what's your message to governor murphy? >> well, to begin with, you know, we have a governor who is consistently putting politics ahead of children and i will say this: you know, is he a lame duck governor to begin with. and the legislators on both sides of the aisle really need to wake up here. and take charge here because these are not laws. these are just guidelines that are in place. and our children and parents need to know it's time for them to take action. >> steve: okay. jacqueline, real quick. i know you haven't done any scientific polling but you have
