A Black firefighter who worked at this fire house in Washington, D.C., is back at home with his family after spending nearly two years falsely imprisoned. 
“He was really happy to see his mom and dad and then spend some time with him yesterday and last night. Today, he's with his 2-year-old, and I'm sure he's happier than many people in the world get to be,” Marvin Miller told Newsy. 
Marvin Miller represents Elon Wilson, a firefighter sent to prison after his arresting officer falsified documents.
Partnering with a local prosecutor in Virginia, Miller said they discovered Fairfax County officer Jonathan Freitag had falsified documents in more than 400 other cases, even planting evidence.

A former Black firefighter was released from prison on Wednesday after a Fairfax County Circuit Court overturned his 2019 conviction on drug and gun charges. The judge wrote in the decision that the case had been built on “false statements.”
Judge Daniel Ortiz threw out the conviction on Tuesday, April 20, writing, “Freitag’s false statements undermined judicial integrity in the public’s eyes and left a man sitting in prison for almost two years.”
Elon Wilson, 26, was a respected member of the Washington D.C. fire department with no criminal rerecord when he was pulled over by former Fairfax County police officer Jonathan Freitag in April 2018. He was released from Nottoway Work Center in southern Virginia on Wednesday, The Washington Post reported.

"We don't see the vehicle cross the solid line," Sgt. Jason Chandler of Fairfax County Police Internal Affairs told Freitag.
“Well, let's play the video but we played this literally at the suppression hearing where you can see his tires touch the solid line," Freitag said.
“So they touched the solid line?" Chandler asked Freitag.
"Yeah, they touch, they literally touch it,” Freitag replied. “He's crossing over the line."
Freitag pulled Wilson over and claims he smelled marijuana and that the windows are too tinted.
Freitag told internal affairs he never actually tested the window tint to know if they were too dark. In fact, he was never trained on how to do it.

A former D.C. firefighter was released from prison Wednesday after evidence surfaced that a Fairfax County officer lied about the reason for a traffic stop.
Elon Wilson, a Black father and a respected member of his community, was released Wednesday after almost two years in prison. Judge Daniel Ortiz tossed Wilson’s conviction writing “Freitag’s false statements undermined judicial integrity in the public’s eyes and left a man sitting in prison for almost two years,” according to NBC Washington.

A former D.C. firefighter who spent more than 20 months in prison on gun and drug charges has been released after the arresting officer was accused of lying. 
Elon Wilson is officially a free man after a Fairfax County Circuit Court judge overturned his 2019 conviction, saying evidence in the case revealed the incident was racially motivated and built on lies from former police officer
Jonathan Freitag.
Freitag reportedly pulled over Wilson in 2018, claiming he “drove over the solid line” and had “very dark-tinted windows.” Police found drugs and a gun in the car and Wilson was ultimately sentenced to three years in prison. Freitag later admitted that Wilson never went over the yellow line and the ex-cop never tested the window tint,

Ex-DC Firefighter's Conviction Overturned – NBC4 Washington


Former Fairfax County police officer Jonathan Freitag is accused of racial profiling and lying in the police report that lead to Wilson's conviction.
Judge Daniel Ortiz threw out the conviction, writing, "Freitag's false statements undermined judicial integrity in the public's eyes and left a man sitting in prison for almost two years."
Freitag resigned from Fairfax County police and is under investigation by Fairfax and the FBI for building cases on lies.
"What occurred in this case exposed a failing in our criminal justice system,” Ortiz said. “When the rules work together, they turn the gears of the judicial machinery towards justice. Instead, this officer's false representations disrupted the entire mechanism."

Former D.C. firefighter Elon Wilson was released from prison Wednesday after evidence surfaced that the Fairfax County police officer who pulled him over in 2018 lied about the reason for the traffic stop.
Wilson was freed after spending nearly two years in prison.

A Brevard County deputy who was on the job since last August was abruptly let go in March. The Brevard County sheriff recently found that the deputy shouldn't have made it into the agency to begin with.Jonathan Freitag received a termination letter from the sheriff early this month.A copy of it says, "this agency has determined that you intentionally provided inaccurate, incomplete and blatantly deceptive information" before getting the job.Freitag previously worked for the Fairfax County Police Department in Virginia. The Sheriff's Office in Brevard County received a memo indicating he'd resigned from the job in good standing.However, the office took another look months later after reports of an investigation into his cases in Virginia with prosecutors reviewing hundreds of convictions.NBC 4 in Washington, D.C., reports a firefighter has been serving a prison sentence after an arrest by Freitag in 2018 but he could be released soon with his case overturned now that Freitag's been accused of lying in police reports and racial profiling.Now, the sheriff's and state attorney's offices are reviewing cases connected to Freitag in Brevard County.Brevard County Sheriff Wayne Ivey wrote a letter to the interim police chief in Fairfax County and called the police department's involvement in the hiring process misleading.The sheriff says, "it is outrageous that an individual such as Mr. Freitag, with a history of alleged misconduct at the Fairfax County Police Department, had become a member of our agency and placed in a position that may have negatively impacted our citizens due to your agency's misrepresentations."

Judge orders release of Black DC firefighter, says conviction obtained by fraud


A Fairfax County Circuit Court judge has overturned the 2019 conviction of a Black D.C. firefighter, saying the case was built on false representations from the arresting county police officer.
The opinion and ruling from Judge Daniel Ortiz was expected after he announced Friday he was inclined to rule in favor of the defendant, Elon Wilson.
Ortiz wrote Wilson had “demonstrated by clear and convincing evidence that a fraud was committed upon the Court in obtaining Wilson’s guilty plea.”
Commonwealth’s Attorney Steve Descano had filed a motion in support of Wilson’s petition to vacate judgment and release Wilson from prison.
