A patient has no obligation to pay a hospital for the period he or she is detained for failing to foot a medical bill.
The declaration was made by High Court judge Weldon Korir in a case filed by Emma Muthoni against Nairobi Women’s Hospital for detaining her over Sh1.7 million bill.
Ms Muthoni spent two months at the city hospital and her bill was Sh3 million. At the time she was discharged on May 14, 2018, the bill had shot to Sh4 million.

Rights groups suffer setback in Covid-19 isolation billing suit

Rights groups suffer setback in Covid-19 isolation billing suit
Thursday January 07 2021
Summary
The Kenya Legal and Ethical Issues Networking on HIV/Aids and the Katiba Institute wanted the order to be directed to Health Cabinet Secretary Mutahi Kagwe and the Kenyatta University Teaching, Referral and Research Hospital (KUTRRH).
The groups moved to court in October last year on behalf of two individuals whose medical bills amounting to Sh108,000 they claimed the government failed to settle. They claimed the two individuals were detained at KUTRRH after they were unable to clear the bills.
The High Court has thrown out an application by two rights advocacy groups seeking to restrain the Ministry of Health from detaining individuals who are unable to pay the costs of testing, isolation and treatment for Covid-19 incurred in public hospitals.

Gulf Bank to pay Sh2m for discrimination

Former Head of Mission of the League of Arab States has been awarded Sh2 million as compensation for discrimination by a local bank.
Justice Weldon Korir
(pictured) in a landmark judgment ordered Gulf African Bank to pay Mustafa Abdulrahman Khogali Sh2 million after finding that the lender closed his bank account on the account of being a Sudanese national.
Gulf Bank issued the diplomat a cheque for the money he had in his account in 2017, and informed him that it was unable to meet his banking needs.  He was then informed that owing to sanctions imposed on Sudan by the US, the bank feared associating with any Sudanese national to avoid repercussions.
