Judges are like architectural designers while deciding a case: Chief Justice

Srinagar, April 13 (Scoop News)-The Jammu and Kashmir Judicial Academy organized a one day interactive programme on “order/judgment writing, application of the law, sharing best practices and finding solutions to practical problems faced by them in justice delivery” for Civil Judges (Junior Division) of Kashmir Province.
The programme that was inaugurated by Chief Justice, High Court of J&K and Ladakh and Patron-in-Chief, J&K Judicial Academy, Justice N Kotiswar Singh, aims to provide a platform for Civil Judges to exchange ideas and share experiences as well as learn techniques from the experts in the field of law.
Yash Paul Bourney, Registrar Vigilance, High Court of J&K and Ladakh, M K Sharma, Director, J&K Judicial Academy and Jatinder Singh Jamwal, Special Judge, Anti-Corruption (CBI Cases), Srinagar were the resource persons for the programme.
Delivering the inaugural address, Chief Justice stated that it is the primary duty of a Judge to write judgement understandable by a litigant and not for the higher courts. All focus must be on the litigant who has come for justice, he said adding that judgement should be clear, lucid and with good reasoning. He said application of mind is important to make any decision because we are dealing with human sufferings. For a good judgement the facts of the case should be properly marshalled and the law should be applied with clear reasons for accepting or rejecting any claim of the litigant, he asserted.
Chief Justice emphasised that the judges are like architectural designers while deciding a case. Though in the criminal cases, charge-sheet is the basis for decision but the facts of the case must be taken care of while deciding the case, he added.
Justice Sindhu Sharma, Chairperson, J&K Judicial Academy, in her special address, while quoting a Greek Philosopher said that the qualities of a judge are to hear courteously, to answer wisely, to consider soberly and to decide impartially. She emphasised that while deciding a case and writing a judgment a judge must consider the arguments and claims put forth by the parties. Further quoting Justice H.K. Sema, former judge of Supreme Court of India, she said that Judgement is best when given with reasons. While quoting Justice R.C. Lahoti, former Chief Justice of India, she said that while writing a judgement don’t go into the verbosity of the document.
She also deliberated that a litigant must understand that why a case is in his favour or against, that should come out from the judgement. The basic factors that should be considered, is to maintain integrity while passing a decision and it should not be influenced by any other matter even our own prejudices and biases. We have to consider the facts while writing a judgement that it should be based on the provision of law, the aspect on which we are doing and how we are going to write the judgement.
Justice Javed Iqbal Wani, Member, J&K Judicial Academy, in his special address, citing the case of Barender Kumar Gosh said that the trial Judge quoted from the sonnet ‘On His Blindness’ of a famous English poet John Milton i.e., "They also serve who only stand and wait" while turning the plea of innocence of Barender Kumar Gosh in a robbery and murder case quoting that even if you were guard at the door still you were guilty of the crime for taking no action.
Justice Wani, citing another recent judgement of the Supreme Court of India, said while quoting Justice Roslyn Atkinson, former judge of the Supreme Court of Queensland, who had said that there are purposes for any judgement that is written, i.e., to spell out judges own thoughts; to explain your decision to the parties; to communicate the reasons for the decision to the public and to provide reasons for an appeal to consider. Every judgement has to have various basic elements such as statement of material (relevant) facts, legal issues or questions, deliberation to reach at decision and the ratio or conclusive decision, he added.
Director, J&K Judicial Academy, M.K. Sharma, in his welcome address, underscored the importance of organising this program. He said that writing judgments and orders is virtually an art and often varies from judge to judge as no form or format has been provided in law as to how judgments and orders should be written by the judges.
The day long interactive programme was divided into two technical sessions and an interactive session for feedback.
The first technical session was chaired by Yash Paul Bourney, Registrar Vigilance and M.K. Sharma, Director, J&K Judicial Academy who analysed the art of order/judgment writing and application of the law.
The second technical session was chaired by Jatinder Singh Jamwal, Special Judge, Anti-Corruption (CBI Cases) who explained by Sharing best practices and finding solutions to practical problems faced by Civil Judges (Junior Division) in justice delivery.
The interactive programme concluded with an interactive session during which the participants deliberated and discussed various aspects of the subject topic and raised queries which were satisfactorily settled by the resource persons.

Chief Justice visits District Court Complex Ganderbal - Scoop News Jammu Kashmir

Ganderbal, April 01 (Scoop News)-Chief Justice High Court, Jammu & Kashmir and Ladakh, Justice N. Kotiswar Singh, today visited the District Court Complex Ganderbal and reviewed functioning of the court besides taking stock of infrastructural facilities there.
Chief Justice was accompanied by Justice Moksha Khajuria Kazmi, Administrative Judge District Court Ganderbal.
On arrival, Chief Justice was given guard of honour by District Police Ganderbal.
Chief Justice and Justice Moksha Khajuria Kazmi visited all court rooms and observed proceedings of cases. They also visited the office of District Legal Services Authority, Ganderbal and front office DLSA Ganderbal, and gave certain on spot directions to Judicial Officers and Police Department.
While interacting with the Judicial Officers and Administrative Officers, Chief Justice said that the purpose of visiting this district court complex was to assess the basic infrastructure issues here as courts are important public institutions and needs basic facilities including court rooms, enhanced e-court facilities, facilities for lawyers, public and litigants to function properly. He issued several directions for further streamlining of infrastructural facilities in the court.
Chief Justice also reviewed the progress on land acquisition for new Court Complex.
Deputy Commissioner Ganderbal informed the Chief Justice that 40 kanal of land has already been identified and will be transferred after completion of codal formalities.
Chief Justice directed the Chief Engineer, R&B to keep DPR ready as per revenue site plan so that work on new Court complex could be started at an earliest once land get transferred to the law department.
Later, Chief Justice and Administrative Judge of District Ganderbal, chaired a separate meeting of District Bar Association Ganderbal who apprised them of several issues confronting them while discharging their legitimate duties and the Chief Justice has assured them all genuine issues will be looked into priority.

Yogi govt inks deal worth Rs 24,560 crore with Singapore and Australia

VGU, Jaipur becomes the first University in North India to have the Swavalamban Chair by SIDBI

Jaipur (Rajasthan) [India], September 20 (ANI/PNN): Symposium on Innovation Ecosystem for MSMEs and inauguration of Swavalamban Chair by SIDBI was organized on 1 September 2022. The program was inaugurated by Dr KR Bagaria, Founder of Vivekananda Global University, Dr Ravindra Kumar Singh (CGM, SIDBI) and Saurabh Bajpai (DGM, SIDBI), who announced the Swavalamban Chair. Vivekananda Global University has been honored by SIDBI for the Swavalamban Chair for the next 3 years. Vivekananda Global University is the first Private University in India to have received this honour. Recently Vivekananda Global University has been listed in the category of fastest-growing University with NAAC A+ accreditation in all of Rajasthan. VGU, Jaipur, as the Swavalamban Chair, will provide knowledge, logistics support and financial support to budding innovators to help them develop products/services from idea to execution. This scheme will give an additional boost to the startup ecosystem of Tier-2 and Tier-3 cities of the state. With funding from SIDBI, VGU will focus on studying various aspects of developing innovative ecosystems in MSMEs. Will try to solve the problems of MSMEs. Various industry bodies like Fiction, CII, FIGSI, FORHEX, and BNI have joined hands with VGU to take care of the issues. VGU is working with various industrial organizations and ministries for the overall development of the region and undertakes various activities like technical consultancy, cluster development, awareness programmes, soft interventions etc. The University has signed MOU with FIGSI to develop state-of-the-art skilling and innovation centers in Jaipur and Hosur. Under this, FIGSI will develop these centers at the cost of 50 crores. Various startups and innovative products developed by the students and faculty of the University were also showcased on occasion, and Er. Omkar Bagaria, CEO, VGU, informed that the University has filed 96 patents in the last two years and took the local MSMEs to the global level. The following topics were discussed in three panels during the programme. First Round Table Topic - Traditions and Transitions of the Stone Industry Conducted by FIGSI. In this discussion which the FIGSI conducted, he explained how the stone industry can be nurtured and what the challenges are. The theme of the second round table was Guiding the Future of the Indian Handicraft Industry by FORHEX. CA Anil Bafna (Convenor), Dr Ravindra Kumar Singh, Dr Rahul Mishra, Leela Bordia, Jaswant S. Miles, Sunit Jain, Rajiv Akar, Brij Ballabh Udaiwal, Ram Gopal Saini, Rajesh Dangoria, Nitin Sharma, Salaam Mohammad, Sumit Srivastava, and Raja Bhandari attended. In this discussion related to, new ideas in the handicrafts sector were discussed. How can university students help them? What are the innovations in the field? The role of new age technology was also discussed. Finally, the topic of the panel discussion was Sone ki Chidiyaan Jagao ACIC powered by VGU. The main participants involved were Ajay Data, Mahavir Pratap Sharma, Sushil Sharma, Omkar Bagaria, Aditya Nath and Namit Soni. In the panel discussion, the CEO of ACIC Foundation and others talked about building unicorns in the country and how VGU can help. It's India's time, Make in India, Build in India and Consume in India. Dr Ravindra Kumar, CGM, SIDBI, compared Vivekananda Global University with Vinod Khanna and SIDBI with Kishore Kumar for the song "Ruk Jaana Nahi" and said that we have to work together. Dr K. R. Bagaria Taking recourse to the New Education Policy, said, "Students should be given an environment according to them, in which along with studies, the skills inside them should also be promoted so that they can move forward in their life." Dr Shweta Choudhary (Dean, Code) said, "Students come here to grow and study, and teachers also develop here along with the children." Sushil Sharma, in the discussion of the roundtable, said, "It's a matter of "Now or never", and he also said that an entrepreneur should be a "Marwari catalyst." he said, "Ye entrepreneurship nahi hai asaan, bas itna samajh lijiye, ek aang ka dariya hai aur doob ke jana hai."
