Plush Family, Cincinnati Reach Settlement In Wrongful Death Lawsuit

Cincinnati and the family of Kyle Plush have reached an agreement, ending a wrongful death lawsuit in the death of the 16-year-old Seven Hills student.
Under the agreement, Cincinnati will pay the Plush family $6 million. It also includes a five-year reform plan.
The plan will have Cincinnati bringing in three 911 experts to work with the emergency communications center. The city will allocate up to $250,000 initially for that work.
The city has agreed to the work of three experts - all 911 professionals - who will come to Cincinnati and consult in a way that will help the (911 call center) improve, says attorney Al Gerhardstein. The scope of the agreement includes a thorough examination of all the actions that led to the failure to find and rescue Kyle - identification of the systemic issues, the training, the quality assurance, the protocol issues - and makes sure that those all get fixed. ....

Kyle Plush family gets $6 million from Cincinnati for son's death


On the eve of the three-year anniversary of Kyle Plush s death, the city of Cincinnati has agreed to pay $6 million to the teenager s family to settle a wrongful death lawsuit, the second-largest settlement in city history.
The suit was filed after police and 911 center workers failed to rescue the teen, who died after he became trapped under the seat of the minivan he drove to school. 
Plush voice-called 911 on April 10, 2018 from the parking lot of Seven Hills School where he was trapped inside a Honda Odyssey. Help never arrived. His death prompted months of city hearings and allegations that the 911 center wasn t property staffed or trained, and in August 2019 the Plush family sued the city. ....

CINCINNATI (FOX19) - The Kyle Plush wrongful death lawsuit can proceed against five former and current employees in their individual capacities, but not in their official capacities and not the city itself, the Ohio First District Court of Appeals ruled Wednesday.
The decision partially overturns a lower court decision but still returns the case to that court for a trial. The city wanted it entirely tossed out. ....
