kavanaugh s nomination? absolutely not. no matter what happens this week? we firmly believe in judge kavanaugh. we believe in his nomination. we think that he s going to make a fantastic supreme court justice. and the president made a great choice, an inspired choice in july in nominating him, and we re moving forward. and so it appears have several democrats. i think that if he does get on the court, he will be there under a cloud. there will always be an asterisk next to his name. we have dr. ford coming forward. what in the world does she have to gain by putting herself and her family through this? i can t see any positives, other than the satisfaction that she is pursuing what she believes to be true. which brings us to today s big question. if everyone has already made up their minds about kavanaugh, who is thursday s senate hearing for? joining me, washington post white house bureau chief, phil
misconduct but they re not accusing them in a criminal setting, not in a court setting. yeah, it s really a challenging question for me to answer, and it s a challenging thing for the senate to deal with. one of the reasons there are no rules for the senate, there s no burden of proof, there are no rules of evidence determining what they re allowed to consider versus not. and no doubt they will look to civil and criminal rules for guidance, but they re not bound by them, and that s because there s no liberty at stake. due process is not required. this is not a hearing about a man who may go to prison. he s not entitled to the judge kavanaugh is not entitled to the job of supreme court justice. i m going to interrupt you for a moment. we re now seeing on our screens andrea constand. she s now leaving the courtroom. she along with all of the other accusers and victims are now leaving the courtroom. the courtroom is being cleared. cosby has been denied bail.
he ll hand them over and be remanded to custody. that will be that. and of course, it was said earlier, and that s absolutely right, that if his attorneys are successful in bail pending appe had no problem since he s been out on bail. he s not the type of person that s going to violate. that would be forestalling the entire sentence and would be a good piece of strategy by his attorneys, but it seems as though he will not have that motion granted. the judge is not likely to do so, especially because the appealable issues the defense is arguing are essentially mistakes that the judge himself made. so he s not going to look too kindly on those being the grounds for his bail-pending appeal. that is exactly what that means. if his bailed motion is denied, he will be remanded to custody immediately and will go to one of the end up at one of the sci s, state correctional institutions. let s jump back outside to
someone in some place, but what i know is i ve never sexually assaulted anyone. but here is why this particular interview is so extraordinary. it was an interview with the president s favorite media outlet, fox news, and it is worth asking, as nbc s first read did this morning, how impartial can a supreme court nominee be and remember, they re supposed to be impartial when he goes on fox news of all possible platforms to defend himself? on thursday in front of the senate, kavanaugh is expected to continue adamantly denying he did anything wrong while his first accuser, dr. christine blasey ford, will testify that he did. but there s another problem here. lots of those involved in deciding whether kavanaugh gets confirmed seem to have already made up their mind. the president certainly has. i think it s horrible what the democrats have done. it s a con game they re playing.
